FAR 52.212-2 Evaluation – Commercial Products and Commercial Services does apply.
FAR 52.212-2 Addendum – Evaluation – Commercial Products and Commercial Services:
Evaluation Procedures:
This procurement will use Simplified Acquisition Procedures (SAP) in accordance with FAR 13.106-1(a)(2) and FAR 13.106-2(b). Evaluation procedures in FAR 13.106 provide broad discretion in establishing suitable evaluation procedures. Using price and other factors, these procedures ensure that quotations can be evaluated in an efficient and minimally burdensome fashion using comparative evaluation of quotes. Comparative evaluation will involve assessing quotes against one another, evaluation factor by evaluation factor, based on the specific information required for each evaluation factor. Price will not be evaluated until Non-Price evaluation is complete. Technical and Prior Experience, when combined, are approximately equally important to Price. These procedures will evaluate:
1. Price. A price evaluation will be performed to determine the reasonableness of the quoted price.
Reasonableness will be determined considering methods authorized by FAR Part 13.
2. Technical (Non-Price). Provide a project narrative that demonstrates how the quoter will successfully meet the needs of the performance work statement. At a minimum, include the following items for evaluation:
a. Project narrative that demonstrates an understanding of this requirement including information for how service interruptions caused by traffic congestion, wildlife impact, weather, etc., may be mitigated by the quoter during performance;
b. Information demonstrating that contractor owned containers meet or exceed performance work statement requirements. Photos are encouraged; and
c. Spill Plan in accordance with the performance work statement.
3. Prior Experience (Non-Price). Quoters shall provide relevant prior experience via factual documentation or narrative of a firm’s experience, qualifications, and capability.
a. Provide two examples of most recent projects within the past five years of similar size and scope. At a minimum provide:
i. Detailed description of each example;
ii. Information that describes the geographic and/or service area of the prior experience example; and
iv. Point of contact information for a representative of the customer.
Optional Line Items: The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.
Quotes will receive a preliminary review to determine whether the quote contains sufficient information, as required by the solicitation, to allow the Government to perform comparative evaluations. If the results of the preliminary review indicate that the quote lacks sufficient information to allow a comparative evaluation to be conducted, the Contracting Officer as the sole deciding authority may eliminate the quote from further review and consideration for an award.
NOTE: Quoters are responsible for providing adequate and complete information for evaluation.
