GENERAL INFORMATION:
This is a COMBINED SYNOPSIS / SOLICITATION for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The National Park Service contemplates award of a firm fixed price contract as a result of this combined synopsis/solicitation to the vendor. This announcement constitutes the only solicitation issued as Request for Proposal (RFP) 140P1424R0014. A WRITTEN SOLICITATION WILL NOT BE ISSUED. FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular (FAC) 2024-02 and are available in full text through Internet access at http:// www.acquisition.gov/far/.

This acquisition is in support of the Bighorn Canyon National Recreation Area (NRA) for Refuse Collection and Disposal Services. The Government contemplates award of a contract, including a Base Year plus Four Option Years to result from this combined synopsis/solicitation.
This is a 100% Total Small Business Set Aside. The North American Industry Classification System (NAICS) code is 562111. The small business size standard is $47.0M.
SPECIFICATIONS:
The main objective of the requirement is timely collection and removal of refuse from multiple sites within the Park, along with the subsequent disposal (e.g., at an off-site and state approved/licensed sanitary landfill or recycling center location). Landfill disposal fees shall be the contractor’s responsibility.
Work will be conducted in the south district of Bighorn Canyon NRA, accessible from Lovell, WY.
Dumpsters shall be 3-cubic yard size/capacity for 11 sites, and 30-cubic yard size/capacity for one site.
All dumpsters shall be bear proof.
The successful contractor shall perform refuse and recycling collection, along with transportation and disposal, in accordance with all applicable laws, regulations, standards, instructions, and commercial practices, and as described in the Performance Work Statement (PWS). The Contractor shall furnish all labor, equipment (fully operated), supervision, transportation, operating supplies, materials, and incidentals necessary to complete the work. All work shall conform to the terms and conditions of the solicitation and any resultant contract.

AWARD SELECTION PROCESS:
Award will be made in accordance with FAR Part 13 to the offeror that provides the best value to the government based on price, technical, and prior experience. This solicitation is not stating nor required to state the relative importance assigned to each evaluation factor and/or sub factor (FAR 13.106-1(a)(2)).
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Price.
2. Technical: Technical is the factual documentation of the firm’s ability to meet the specifications.
3. Prior experiences: Prior experience is the factual documentation or narrative of a firm’s experience, qualifications, and capability, along with providing examples of their firm’s most recent projects within the past five years of similar size and scope.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
INSTRUCTIONS TO OFFERORS:
Quotes shall be in accordance with and in the order detailed in this section. Failure to submit quotes according to the instructions provided within the solicitation may result in the respondent’s quote not being considered for award.
(a) The National Park Service (NPS) is seeking quotations for construction services as attached in the accompanying scope of work. The NPS intends to conduct this acquisition by use of simplified acquisition procedures in accordance with FAR Part 13.
(b) To assure timely and equitable evaluation of quotations, respondents are cautioned to strictly comply with all instructions within this solicitation to ensure submission of a complete quotation. Respondents are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to adhere to quotation requirements, at the time of submission, may result in the quotation being unacceptable to the Government and eliminated from consideration for award.
(c) Respondents are cautioned to submit adequate information to enable the Government to fully ascertain each respondent’s capability to perform the requirements in accordance with the requirements of the request for proposal (RFP).
(d) If a respondent believes that requirements in these instructions contain an error, omission, or are otherwise flawed, the respondent shall immediately notify the Contracting Officer in writing (email is the preferred method) with supporting rationale prior to the closing of this RFP.
(e) This RFP does not commit the Government to any costs incurred in the preparation and submission of a quote or for any other costs incurred by any firm submitting a quote in response to this solicitation. Note specifically that the Offeror will not be participating in a sealed bid procurement process under this

(f) Proposal must be valid for a minimum of 60 days.
(g) All interested parties shall be registered in the System for Award Management or SAM at time an offer or quotation is submitted.
(h) Award is subject to and based on the availability of funds. This project is currently funded based upon an independent cost estimate.
(i) Respondents shall not contact any government personnel related to this requirement other than the Contracting Officer and Contracting Specialist.
(j) All questions should be emailed directly to the Contracting Specialist. Only written RFI’s will be considered and responded to by the Government. NPS responses to RFIs will be posted as an amendment to the solicitation.
Offerors shall submit a quote to the contracting specialist by email to Ryan_Haselhuhn@nps.gov no later than 2:00 p.m. CST on March 11, 2024.
SPECIAL CONTRACT REQUIREMENTS
WORK HOURS
The performance period established for this contract is based upon all work being conducted during regular working hours between 7:00am and 4:00pm, Monday through Friday, excluding government holidays. If the Contractor desires to carry on work outside regular hours, including Saturdays, Sundays, and government holidays, a request must be submitted to the Contracting Officer in sufficient time to allow satisfactory arrangements to be made by the Government for access to the work site and inspection.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services.
