52.212-2, Evaluation — Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) price;

(ii) specifications of the item offered to meet the Government requirement

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

EVALUATION OF QUOTATIONS OR OFFERS

Quotes will receive a preliminary review to determine whether the quote contains sufficient information, as required by the solicitation, to allow the government to perform a meaningful evaluation. If the results of this preliminary review indicate that the quote lacks sufficient information to allow a meaningful evaluation to be conducted, the

Contract Specialist/Contracting Officer may eliminate the quote from further evaluation and consideration for an award.

Quotes received shall be evaluated in accordance with FAR 13.106-2. Evaluation procedures identified in FAR

13.106-2(b)(3) specific to comparative evaluation shall be used. The government will review the submitted capabilities statement to determine the most highly qualified offerors that represent the best value to the government price and other factors considered. Offerors considered the most highly qualified and represent the best value to the government will be further considered for award.

BASIS FOR AWARD

The basis for award shall be in accordance with FAR 13.106-3(a). A price evaluation will be performed to determine the reasonableness of the proposed price. Reasonableness will be determined considering other competitive prices received and comparison to the independent Government estimate. If multiple contract line http://www.aptac-us.org/new/Govt_Contracting/find.php items are included in the price schedule, prices will also be evaluated to determine whether any line items are unbalanced. Offerors are cautioned to distribute costs appropriately.
