(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Basis for Award Award will be based on the offeror whose quotation represents the best value to the Government, considering price and other factors as described below. Technical acceptability must be met before price is evaluated. Evaluation factors other than price when combined are approximately equal to price.
Factor 1 - Technical Acceptability (Acceptable/Unacceptable) Quotations will first be evaluated for technical acceptability. A quotation that fails to meet any of the following requirements will be rejected without further evaluation.
The offeror must demonstrate that the ammunition quoted:
1. Meets or exceeds the caliber(s), grain weight(s), and projectile type(s) specified in the requirement
2. Conforms to SAAMI (Sporting Arms and Ammunition Manufacturers' Institute) standards or equivalent
3. Is new production commercially available (no remanufactured or reloaded ammunition)
4. Can be delivered within the required timeframe and to the specified delivery location(s)
Factor 2 - Past Performance / Vendor Reputation (Informational) The Government may consider available information regarding the vendor's record of supplying law enforcement ammunition to federal, state, or local agencies. This factor is informational and will be used as a tiebreaker between technically acceptable quotations of equal or near-equal price.
Factor 3 - Price Price will be evaluated based on the total evaluated price for all line items quoted. The Government will evaluate total price. Unreasonably high or unbalanced pricing may render a quotation ineligible for award.
Price reasonableness will be determined in accordance with FAR 13.106-3(a) based on adequate price competition (if two or more technically acceptable quotes are received) or market research / prior purchases if competition is limited
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
