STATEMENT OF WORK
RAPTOR NESTING SURVEYS
AND POPULATION PRODUCTIVITY ASSESSMENT
BUREAU OF LAND MANAGEMENT (BLM)

I. Purpose
The purpose of this Statement of Work (SOW) is a longitudinal study to conduct an inventory to locate new raptor nests and document raptor nesting activity during the nesting seasons (January to August) of calendar years 2022-2026 on National Landscape Conservation System (NLCS) lands in the Rio Grande del Norte National Monument.
The BLM is responsible for preparing and maintaining, on a continuing basis, a current inventory of the public land and its resources (FLPMA, 43 U.S.C. 1701 Sec. 201 (a)). This inventory information, along with monitoring data collected under a variety of programs, shall be used to evaluate the current status and trends of plants and animals and their habitats on BLM-administered lands, and to respond to U.S.
Fish and Wildlife Service (USFWS) Federal Register Notices of species status review (e.g., 90-day, 12-month, 5-year, and annual candidate reviews). The BLM shall ensure that all actions undertaken comply with the Endangered Species Act (ESA) and the Migratory Bird Treaty Act (MBTA), their implementing regulations, and other directives associated with MBTA and ESA-listed and proposed species.
Benefits of this survey to the BLM include:
1. Determine the extent of the resource (composition and productivity), condition and trends of raptors within the NLCS.
2. At the Field Office level, it will provide relevant geographic population data to help the Taos Field Office (TAFO) determine the best strategy for land management decisions in the Rio Grande del Norte National Monument Management Plan. Updated information and monitoring of raptors, an object of value within the Monument, will not only serve to protect and inform any restoration required for these species, but also provide the scientific basis for management decisions for other resources decisions.
3. At the Regional level, data will help the BLM to analyze cumulative effects, work with partners to develop regional mitigation strategies, report on conservation targets and wildlife corridors, and improve regional datasets.
4. At the State level, raptors are required for monitoring pursuant to the MBTA of 1918 and 1929, Executive Order 13186, New Mexico Bird Conservation Plan, BLM IM 2008-050, Memorandum of Understanding between BLM and USFWS (2010), and BLM Manual 6840.
5. At the National level, these data will provide reporting on distribution, abundance, and trends in raptors for the Rio Grande and Taos Plateau.
The surveys and information from the project will help educate the public about raptors, wildlife and special status species issues, as well as inform recreation, grazing, transportation and wildlife-viewing programs.
Contractor Responsibilities:
Contractor shall be responsible for compliance with the Endangered Species Act of 1973, as amended, and obtain all necessary state and federal permits, as necessary, to conduct the above-referenced surveys.

issued by the New Mexico Department of Game and Fish and/or Recovery Permits issued by the U.S.
Fish & Wildlife Service, if appropriate.
Contracted surveyors should possess experience conducting raptor nesting surveys for the BLM using the appropriate permits as well as NMDGF and/or USFWS surveying protocols. Ongoing surveys shall be conducted by experienced ornithologists proficient in the habitat types used by raptors within the Rio Grande del Norte National Monument.
Contractor shall be trained in identification of raptors and nesting behavior and have experience in the protocol methods.
II. PROJECT AREA AND DESCRIPTION
Raptor nesting survey areas are listed below. The timing and frequencies of raptor nesting surveys differ by species but may be conducted in conjunction where survey dates overlap. However, separate reports for each year are required.
RAPTOR NESTING SURVEY AREAS AND GENERAL DIRECTIONS:
Rio Grande Gorge: Approximately 40 miles in length, from the Colorado/New Mexico state line to Orilla Verde Recreation Area.
Rio San Antonio Gorge: Approximately 5 miles in length, 267 total BLM acres, T. 32 N., R. 8 E., Sec. 25, T. 31 N., R. 8 E., Secs 11, 14, 24 and 25.
Orilla Verde Recreation Area: Approximately 5 miles in length, including the Rio Pueblo de Taos upstream of the confluence with the Rio Grande approximately one mile, downstream along the Rio Grande to the Village of Pilar.
*See attached Map for specific site locations. The Contractor shall contact the Contracting Officer Representative (COR) prior to conducting surveys to confirm directions to sites and access information. Although off-road travel is minimal, a medium-clearance vehicle is recommended at the Rio Grande Gorge and Rio San Antonio Gorge sites due to the possibility of newly formed erosion on dirt roads resulting from winter/spring weather conditions.
Survey methodology published in the literature sources listed below should be followed for general raptor nesting surveys (as opposed to surveys assessing the impacts of a particular project) at the above locations. It is essential for surveyors to be familiar with these documents since they cover a wide range of topics including natural history, habitat and permitting.

The surveys will be for presence/not detected of raptors at historic nest sites during the nesting season (January through July, or as dictated for assessing nest success and productivity), and to locate any new or previously undocumented nest sites or territories within the survey area. Known nest sites will be provided by the BLM and total approximately 75 individual locations. Access is available by designated roads open to the public for vehicular traffic; however, actual data collection would be gathered on foot by walking along the rim of the Rio Grande or Rio San Antonio Gorge, collecting information on the opposite cliffside. There is a paved road in the Orilla Verde Recreation Area and data would be collected along that road from observations made inside the canyon.
Active nests will be monitored to determine reproductive success and productivity, reoccupation rates, diet and habitat use, if possible. Data gathered will assist in making informed management decisions and determining areas where the potential for human disturbance is most critical.
At the active and occupied nest locations, points will be established, and the species identified. Each location will be documented using a Global Positioning System unit, using NAD83 datum, and the UTM coordinates will be plotted on USGS quadrangle maps. Each point will be classified as an active or occupied territory, confirmed breeding or status unknown.
All raptors opportunistically observed or heard during the survey (including migrants) will be documented.
III. TIME FRAME
Surveys for raptor nesting will be for presence/absence, with follow up visits to discovered raptor nest sites, and each site will be surveyed during the breeding season, beginning in January for eagles and continuing through June or July for most raptor species.

IV. DELIVERABLE ITEMS/SCHEDULE
The following information will be delivered to the COR during the respective surveyed year (RSY):
Periodic updates, no less than monthly, should be provided with species sighted, a unique identifier for each location, including name of quadrangle map and UTM coordinates, cliff aspect, nest status, number of nestlings/fledglings and description of activity.
All raptor nest field survey forms will be delivered to the COR by October 1, during the RSY.
One (1) Final report for raptor nesting will be delivered to the COR by December 31of the respective survey year. The raptor nesting report will include a complete species list of all species seen or heard at the established nest sites. In addition, a list of species (not observed at a nest site) that were encountered between points. All species that are encountered that are of special interest (federally listed threatened or endangered species, BLM Sensitive, New Mexico threatened or endangered) will be documented as to activity (e.g., nesting, flying overhead) and any other information that can be readily gathered. Copies of survey forms with raw data will be submitted as part of this report. A copy of current USFWS or NMDGF permit will be required.
One (1) compact disc (CD) or USB drive containing photographs, an electronic copy of the final reports (.doc and .pdf formats), and ArcMap compatible shapefiles of points, lines or polygons collected regarding the location of biological data shall be delivered to the COR by December 31, of the respective survey year. Use of North American Datum 1983 Geographic Coordinate System is preferred for electronic GIS data submissions.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

52.217-8 Option to Extend Services (Nov 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days before the contract expires.
52.217-9 Option to Extend the Term of the Contract (Mar 2000)
(a) The Government may extend the term of this contract by written notice to the Contract prior to expiration of the contract; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 10 before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months.
52.219-14 Limitations on Subcontracting (DEVIATION 2019-01)
(a) This clause does not apply to the unrestricted portion of a partial set-aside.
(b) Definition. As used in this clause-
“Similarly situated entity” means a first-tier subcontractor, including an independent contractor, that has the same small business program status as that which qualified the prime contractor for the award, and this is considered small for the NAICS code the prime contractor assigned to the subcontract the subcontractor will perform. An example of a similarly situated entity is a first-tier subcontractor that is a HUBZone small business concern for a HUBZone set-aside or sole source award under the HUBZone Program.
(c) Applicability. This clause applies only to –
(1) Contracts that have been set aside or reserved any of the small business concerns identified in
19.000(a)(3);
(2) Part or parts of a multiple-award contract that have been set aside for any of the small business concerns identified in 19.000(a)(3);
(3) Contracts that have been awarded on a sole-source basis in accordance with subparts 19.8, 19.13, 19.14, and 19.15; and
(4) Orders set aside for any of the small business concerns identified in 19.000(a)(3) under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).
(d) Independent contractors. An independent contractor shall be considered a subcontractor.
(e) Agreement. By submission of an offer and execution of a contract, the Offeror/Contractor agrees in performance of the contract in the case of a contract for-
(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the
Government for contract performance to subcontractors that are not similarly situated entities.
Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded.
(2) Supplies (other than procurement from a nonmanufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded;
(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 85 percent subcontract amount that cannot be exceeded; or
(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the costs of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 75 percent subcontract amount that cannot be exceeded.
(f) A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph € of this clause will be performed by the aggregate of the joint venture participants.

1452.201-70 Authorities and Delegations (Sep 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the
COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

(a) The Government will award a single contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Basis for Contract Award: This is a best value source selection. The Government will select the best overall quote based on an assessment of technical capability, past performance, and price. To be eligible for award, the vendor must be deemed responsible in accordance with FAR 9.104; meet all requirements of the solicitation; conform to all required terms and conditions; and include all required certifications, unless a proposed exception is accepted by the Government. The Government seeks to award to the vendor who provides the best value in meeting of exceeding the requirements of this solicitation. This may result in an award to a higher-rated, higher-priced quote, where the decision is consistent with the evaluation factors and the contracting officer reasonably determines that the technical superiority, overall business approach, or superior past performance of the higher-priced quote outweighs the price difference. While the Government source selection evaluation team will strive for maximum objectivity, the source selection by its nature is subjective. Therefore, professional judgement is implicit throughout the entire process.
Number of Contracts to be Awarded. The Government anticipates making one (1) award to the vendor that presents the best overall value to the Government.
Technical Evaluation Committee (TEC). The Contracting Officer has established a TEC to conduct the evaluation of quotes received in response to this solicitation. The evaluation will be based exclusively on the content of the quote and any subsequent discussions required. The TEC will not consider any information or data incorporated by reference or otherwise referred to. The identities of the TEC personnel are confidential, and any attempt to contact these individuals for the purpose of discussing your quote (or other competing quotes) will result in the rejection of your quote.
The TEC will evaluate each quote submitted. Price information will then be considered, and a best value analysis performed.
Evaluation Criteria. In evaluating quotes, the Government will make tradeoffs among the factors to select the quote that is most advantageous to the Government. To arrive at a best value decision, the Government will assess each quote in accordance with the following evaluation factors and criterion:
Factor 1 – Technical Capability
Criterion 1 – Technical Approach
Criterion 2 – Management Plan
Criterion 3 – Organizational Experience
Key Personnel Resource Capabilities
Factor 2 – Past Performance
Factor 3 - Price
Relative Importance of the Factors. The relative importance of each factor is as follows: Factor 1:
Technical Capability (each criterion of equal importance) is more important than Factor 2: Past Performance which is more important than Factor 3: Price. When factors 1 and 2 are combined, they are significantly more important than price. However, price is still a major consideration in the source selection decision. The price factor may become more significant in contributing to the source selection decision if competing quotes offer comparably evaluated technical capabilities and past performance ratings.
Evaluation Approach.
A “Pass/Fail” rating system will be used to evaluate the Technical Capability factor and a “Relevant/Not Relevant” rating system will be used to evaluate the Past Performance factor. Adjectival ratings shall not be used for the price factor, instead price quotes will be evaluated to determine if prices are fair and reasonable.
