SECTION 2 - GENERAL INFORMATION
2.1 DESCRIPTION
This Request for Proposal (RFP) is issued in accordance with FAR Part 12-Acquisition of Commercial Items and FAR Part 15-Contracting by Negotiation.
2.1.1 The solicitation is a 100% set aside for small businesses.
2.2.1 The Government contemplates award of a contract for Hydrocarbon Engineering Support
Services with a one-year base and four one-year options resulting from this solicitation.
2.2.2 The level of effort of each position is a full time equivalent.
2.3 TERMS AND CONDITIONS
The Contractor shall perform the work identified in Section 4 in accordance with the terms and conditions of this solicitation and resultant contract.
2.4 NON-PERSONAL SERVICES:
This contract is for “non-personal services” as defined in FAR 37.101. Therefore it is understood and agreed that the Contractor and/or the Contractor’s employees:
2.4.1 Shall perform the services specified herein as independent Contractors, not as employees of the government.
2.4.2 Shall manage and administer the work required and bear sole responsibility for complying with any and all technical, schedule, or constraints in the performance of this contract.
2.4.3 Shall be free from supervision or control by any government employee with respect to the manner or method of performance of the services specified
2.4.4 Shall, pursuant to the government’s right and obligation to inspect, accept, or reject the work, comply with such general direction of the Contracting Officer, or the duly authorized representative of the Contracting Officer as is necessary to ensure accomplishment of the contract objectives.
2.5 INHERENTLY GOVERNMENTAL FUNCTIONS:
In accordance with FAR Part 7.5, Inherently Governmental Functions, this contract shall not be used for the performance of inherently governmental functions.
2.5.1 No Contractor employee shall hold him or herself out to be a Government employee, agent, or representative.
2.5.2 No Contractor employee shall state orally or in writing at any time that he or she is acting on behalf of the Government.
2.5.3 In all communications with third parties in connection with any task under this contract, Contractor employees shall identify themselves as Contractor employees and specify the name of the company for which they work.

2.5.4 In all communications with other Government contractors in connection with any task under this contract, the Contractor employee shall state that they have no authority to in any way change the contract and if the other contractor believes this communication to be a direction to change their contract, they should notify the CO for that contract and not carry out the direction until a clarification has been issued by the CO.
2.5.5 The Contractor shall insure that all of its employees working on this contract are informed of the substance of this article. Nothing in this article shall limit the Government's rights in any way under the other provisions of the contract, including those related to the Government's right to inspect and accept the services to be performed under this contract. The substance of 2.11 shall be included in all subcontracts at any tier.

3.1 PERSONNEL
The contract personnel must possess the education, training, and/or experience described to successfully execute Hydrocarbon support for the Bureau of Land Management (BLM). Resumes must be submitted for the personnel. References and/or previous employers may be contacted by the Government to verify qualifications of individuals.
The contractor(s) must have at least five (5) years of technical experience in hydrocarbon measurement and meter analysis. The BLM requires the contractor to have a Bachelor of Science or Master’s degree in an engineering program. The contractor(s) must be well-versed and have a thorough background knowledge in onshore oil and gas facilities for production measurement. The contractor(s) needs extensive knowledge of the standards from the API, the American Gas Association, the American Society for Testing and Materials, and the Gas Processors Association.
In order to meet the requirement to provide technical reports and recommendations, the contractor(s) must possess a significant and demonstrated knowledge for at least two (2) of the following:
• Coriolis meters,
• Positive displacement meters,
• Automatic tank gauges,
• Differential meters,
• Electronic flow computers,
• Transducers, and
• Other similar oil/gas field equipment.
The contractor(s) must possess excellent technical skills and experience in hydrocarbon measurement and flow analysis for oil and gas practices used by onshore operators. The contractor(s) must work well independently and with remote teams and provide strong communication and writing skills in order to articulate concerns, findings, and recommendations. The contractor(s) will be expected to work independently, meet deadlines, attend all required meetings, and communicate effectively via email and phone. The contractor(s) must maintain all confidentiality of documents and communications. The contractor(s) will furnish all necessary equipment, materials, and personnel necessary for the completion of tasks outlined in this PWS.
During the first 180 days of performance, the Contractor shall make no substitutions of key personnel unless necessitated by illness, death or termination of employment. The Contractor shall notify the Contracting Officer (CO) within fifteen days after the occurrence of any of these three events and provide the information required by paragraph below. After the initial period, the Contractor shall submit the information to the CO at least fifteen days prior to making any permanent substitutions.
The Contractor shall provide: A detailed explanation of the circumstances that necessitate the proposed substitution, and any additional information requested by the CO. The Government retains the right to interview proposed substitutes. Proposed substitutes should have comparable qualifications to the individual being replaced. The CO will notify the Contractor within fifteen days after receipt of all required substitute's personnel information. All proposed substitutes will be subjected to a two-week trial period. Proposed replacements that do not satisfy the Government during that trial period will be removed from the contract at no cost to the Government. The contract will be modified to reflect any approved changes in key personnel.
SECTION 4 - PERFORMANCE WORK STATEMENT
1.0. GENERAL INFORMATION.
This Performance Work Statement (PWS) identifies the engineering support services and activities that are to be furnished in support of the Bureau of Land Management’s (BLM’s) mission.

2.0 BACKGROUND
The BLM is responsible for ensuring the accurate measurement and proper reporting of the volume and quality of oil and gas removed or sold from Federal and Indian leases in order to help ensure proper payment of royalty.
Prior to January 17, 2017, Onshore Order 4 (oil measurement) and Onshore Order 5 (gas measurement), both of which became effective in 1989, established standards for oil and gas measurement. The Government Accountability Office and the Office of Inspector General recommended the BLM update these regulations to incorporate latest industry standards, latest measurement technology and fill in regulatory gaps of Onshore Orders.
On November 16, 2016, the BLM published 43 CFR 3174 and 3175, which replaced Onshore Orders 4 and 5 respectively. Both regulations became effective on January 17, 2017. For Facility Measurement Points (FMP) in-place prior to January 17, 2017, these regulations include phase-in periods for operators to bring existing equipment up to new 3174 and 3175 standards. For gas measurement (3175), these phase periods range from one year to three years, depending on the average flow rate of meter gas measurement. For oil measurement (3174), the phase-in periods also range from one year to three years. However, the oil FMP phase-in periods were tied to FMP application process, which the BLM delayed as a result of issues with Automated Fluid Minerals Support System 2 (AFMSS2). On January 17, 2017, the BLM Headquarters (HQ) issued Instruction Memorandum No. 2017-032, “Partial Delayed Implementation of 43 CFR 3170 Regulations,” providing guidance for the implementation delay.
As mandated in these 3170 regulations, the BLM assembled a team of subject matter experts, named the Production Measurement Team (PMT). The PMT is a panel of members from the BLM, including BLM-contracted experts, that reviews changes in industry measurement technology, methods, and standards to determine whether regulations should be updated, and provides guidance on measurement technologies and methods not addressed in current regulations. The purpose of the PMT is to act as a central advisory body to ensure that oil and gas produced for Federal and Indian leases are accurately measured and properly reported.
The PMT was established in 2017 and has had contract engineers involved since its formation. This contract is expected to provide contract engineering support to the PMT.
3.0 OBJECTIVE
The BLM Division of Fluid Minerals (HQ-310) has a need for two (2) Senior Hydrocarbon Measurement Engineer(s) or Specialist(s) to provide support in the area of measurement and meter analysis as part of the PMT’s implementation of 43 CFR 3170-75. The assigned engineers shall be committed for a minimum of one
(1) year.
4.0 SCOPE OF WORK
Hydrocarbon Measurement Engineers: This position provides engineering support to the BLM HQ-310. The specific tasks are:
Task 1. Develop testing protocols and standards for measurement and metering devices and maintain the
PMT website by describing PMT role and authority; describing the application process including an application submittal portal; describing required testing protocols for each device; describing the PMT review process and conclusions; displaying review status and conclusions; and completing other necessary tasks for development of a process to accept, review, and approve manufacturers’ and operators’ applications for measurement equipment and methodology.
Task 2. Review PMT equipment applications for completeness by ensuring all required components as outlined in the PMT Application Guidance document are included in the application; verifying https://www.blm.gov/policy/im-2017-032 https://www.blm.gov/policy/im-2017-032

submitted testing conforms with applicable American Petroleum Institute (API) standards or standards provided by the PMT; communicating application submission deficiencies to the applicant in an official manner through the PMT; and completing other necessary tasks related to efficient, thorough, and documented review of all submitted applications.
Task 3. Complete data analysis to determine measurement equipment meets BLM standards by independently analyzing applicant’s data in accordance with applicable standards and sound statistical methodology and practice; verifying or invalidating applicant results and conclusions based on impartial, and transparent statistical analysis of applicant data; and completing other necessary tasks to ensure that PMT reviews are complete and thorough; and ensuring changes in industry measurement technology, methods, and standards are accurately reflected in the required testing protocols to ensure that oil and gas produced from Federal and Indian leases is accurately measured and properly reported on.
Task 4. Prepare a report of findings for each PMT measurement equipment analysis by preparing written summary of analysis presented in PMT application; preparing written summary of verification of applicant findings or; preparing written summary to invalidate applicant findings including specifics of application shortcomings; and completing other necessary tasks to document and communicate findings for each application received as well as respond to data requests from BLM, Department of the Interior (DOI), congressional inquiries, industry, media, etc., on PMT activities and accomplishments.
Task 5. Prepare recommendation to approve or deny PMT measurement equipment application by either preparing written recommendation for the BLM to approve application for use of measurement equipment including any specific installation requirements/limitations or operating requirements/limitations in Conditions of Approval or preparing written recommendation for the BLM to not approve application for use of measurement equipment including justification for non-approval and statement of applicant appeal rights and process; transmitting report of findings and recommendations to approve or not approve measurement equipment application to BLM Authorized Officer for final approval and notification of applicant; and completing other necessary tasks to approve or deny submitted applications and transmitting a final decision.
Task 6. Participate in application decision appeal process providing technical expertise for requests for discretionary review by the DOI Assistant Secretary for Land and Minerals Management (ASLM) as delegated by the Assistant Secretary and completing other necessary tasks (which may include additional referencing and indexing of the administrative record above what was required in Tasks 1-5, working with the DOI’s Office of the Solicitor (SOL), and providing additional information as requested by the BLM, ASLM and SOL).
Task 7. Attend and participate in industry meetings, conferences, and standards-writing work groups such as, but not limited to the API Spring and Fall Committee on Petroleum Measurement (COPM) meetings, the International School of Hydrocarbon Measurement (ISHM), the American School of Gas Measurement Technology, the Natural Gas Sampling Technology conference, and any other meetings determined by the PMT Lead as in the BLM’s best interest to fulfill our mission for production accountability. The purpose of participating in these meetings is to:
a. Provide input to the development of measurement standards that the BLM may incorporate in regulations;
b. Review changes to measurement technology, emerging issues, and trends in the measurement industry to provide guidance to the BLM;

c. Provide operator outreach relating to the status of the PMT, regulations, and policy;
d. Meet with operators and manufacturers to discuss specific issues related to the PMT reviews of devices, processes, or methods they have submitted for review;
e. Discuss measurement issues with world-renowned measurement experts who also attend these events; and
f. Attend other meetings as necessary to accomplish PMT’s roles and responsibilities (defined in section A.1) in order to accomplish requirements of sections A.4.1 and A.4.2 and meet the production accountability needs of BLM’s mission.
Task 8. Assist with training BLM personnel on inspection and enforcement techniques on the phone as well as in-person, as required.
Task 9. Develop tools and contracts related to development of Information Technology (IT) applications to assist BLM personnel in their inspections related to BLM-approved equipment and procedures.
Task 10. Assist with industry and BLM outreach and training sessions related to 43 CFR 3170, 3173, 3174, and 3175 regulation revisions.
Task 11. Assist in the development and interpretation of regulations, policy, briefing papers, data calls, hearing materials, and other matters in which the PMT is assigned to work related to BLM oil and gas measurement and verification.
Task 12. Assist with other tasks as related to BLM oil and gas projects.
5.0 CONTRACTOR PERFORMANCE ASSESSEMENT
After completion of this contract, an evaluation will be completed in the Contractor Performance Assessment Reporting System (CPARS) at https://www.cpars.gov/. A CPARS shall be done for contracts over $250,000.00.

7.0 PLACE OF PERFORMANCE
The contractor engineers are expected to be remote staff and are not required to report to any BLM office.
The contractors will work from their workplace or residence.

Normal hours of operation are 6:00 a.m. to 6:00 p.m. in the time zone the contractor is located, Monday through Friday, except for Federal holidays.
9.0 OVERTIME
Exceptions for travel to attend meetings, outside the normally scheduled hours on weekends will be allowed with approval. Weekend travel will be paid at an overtime rate. If a contractor is required to work in excess of 40 hours in a week, they will be paid at an overtime rate with approval.
Request(s) for overtime must be submitted from the PMT Lead, with concurrence from the HQ-310 Division Chief, and must include specific task(s) and target date(s) associated with each request. These requests should be rare and must be submitted from the PMT Lead through the Contracting Officer Representative.
10.0 FEDERAL HOLIDAYS
Holidays observed by the contractor shall include all legal holidays observed by the Government, including any Federal Holiday established by Executive Order. These holidays are:
New Year's Day Martin Luther King Day Columbus Day President's Day Memorial Day Juneteenth Day Independence Day Labor Day Veterans' Day Thanksgiving Day Christmas Day Any Federal Holiday Established by Executive Order
11.0 GOVERNMENT FURNISHED EQUIPMENT (GFP)
Government-Furnished Property is all property furnished by the Government to which the Government retains title. Work performed off-site or virtually will require access to the BLM network. Currently this can only occur through the use of Government-provided laptops with Virtual Private Network (VPN) connection which is provided by BLM. The contractor shall propose only the minimum quantity of laptops and any software installations outside of BLMs standard configuration necessary to facilitate the technical requirement to meet the support services.
BLM will not ship any government provided laptops, or mobile devices outside of the continental U.S. or Alaska. The contractor shall not use the government provided laptop, or mobile devices outside of the continental U.S. or Alaska.
The contractor shall be responsible for complying with all existing BLM practices for maintaining and updating their laptop for which all other BLM virtual employees are required to comply. This may include logging into the computer frequently. Typically logging into VPN frequently to receive all updates will ensure the computer remains secure and available for use. However, there may be instances where traveling to and logging directly into the network at a BLM or DOI facility becomes necessary. The contractor shall comply with all requirements to properly use and maintain a BLM laptop.
All government furnished equipment, software, and information will be returned to the government upon completion of this contract.
12.0 GOVERNMENT FURNISHED INFORMATION (GFI)

The Government will furnish to the contractor all necessary current task working papers, project descriptions, program briefing material and other pertinent information, and other documentation or material required in performance of this contract.
During the performance of this contract, the contractor may be granted access to information, such as plans, policies, reports, studies, financial plans, and internal data, or data which has not been released or otherwise made available to the public, the contractor agrees that without prior written approval of the CO it shall not: (1) use such information for any private purpose unless the information has been released or otherwise made available to the public; (2) submit an unsolicited proposal to the Government which is based on such information without full disclosure of any internal information used in preparing their proposal; or (3) release such information unless such information has previously been released or otherwise made available to the public by the Department.
The contractor agrees that to the extent it receives or is given access to proprietary data, or other confidential or privileged technical, business, or financial information under this contract, it shall treat such information in accordance with any restrictions imposed on such information.
13.0 COMMUNICATION
The contractor shall maintain courteous, professional, and quality communications across all areas. This would include communications with other contractors, Government employees and staff members, as well as any other personnel they interact with while conducting business. All work shall be conducted in a team environment and all contractor staff shall cooperate with team members. Contractor staff shall conduct meetings within each technology group to share new technologies, processes, and procedures to ensure consistency of knowledge. The contractor shall make staff available to provide consulting and communication services to local and enterprise-wide teams, boards and working groups on a continuing or ad hoc basis. When working on tasks or projects, the contractor shall transfer knowledge to the Government staff concerning the details of the task or project.
14.0 TRAVEL
The contractor will be required to travel to meetings, conferences, and/or BLM offices. Please plan on a minimum of six (6) travel meetings per year and at least monthly travel may be necessary. Each meeting will be for approximately five (5) days and may include travel on the Sunday and Saturday of the week. Travel should be consistent with the General Services Administration’s (GSA) government travel policy. Please refer to https://www.gsa.gov/travel-resources website for latest rates and policies on Per Diem, Meals & Incidentals (M&IE); Passenger Transportation (airfare and privately owned vehicles); and Lodging.
15.0 IDENTIFICATION OF CONTRACTOR EMPLOYEES
All contract personnel are required to identify themselves as contractors. Whether attending meetings, answering Government telephones, or working in other situations where their contractor status is not obvious to third parties, they must make their status known to avoid creating an impression that they are Government employees. To assist in the identification the following shall be implemented:
15.1 Each contractor employee shall be provided, and shall wear in plain sight, an identification badge which clearly indicates they are a contractor employee while in a Federal facility.
15.2 Contractor employees shall identify themselves as such in all correspondence, such as e-mails or faxes, originating from a Government provided source.
15.3 Contractor employees shall not attend Government all employee meetings or other inherently Governmental meetings unless specifically notified. All such notifications shall be coordinated through the Contracting Officer and contract manager. If attendance at a recurring meeting is necessary for accomplishment of contractual requirements a blanket notification may be executed.

15.4 To the maximum extent practicable, consistent with their duties, contractor employees shall identify themselves as such in telephone conversations using a Government provided telephone.
16.0 SECURITY
The contractor shall be required to obtain the required contractor identification badge and sign any releases and participate in any training required to use Government equipment and operate Government hardware and software. The Government will retain rights to all intellectual property produced in the course of this contract.
If violated, the Government reserves the right to require dismissal of the contractor.
17.0 SECURITY REQUIREMENTS
The BLM places the utmost importance on IT Security to ensure that Information is safeguarded. The BLM uses multiple layers of security starting at the Internet gateway all the way down to the individual user's permissions/privileges and their desktop configuration. The BLM also has a very active IT Security monitoring and analysis program in which systems and users’ activities are logged and analyzed.
17.1 Security Background Investigation. Performance of this contract requires contractor personnel to have a federal government-issued Personal Identity Verification (PIV) credential before being allowed unsupervised access to a DOI [facility and/or information system].
17.2 Initiate the Request. The Contracting Officer Representative (COR) will be the requesting official and will make arrangements through a DOI Access Card Sponsor for personal identity verification and DOI Access Card issuance.
17.3 Initiate a Background Investigation. The Bureau uses the e-QIP for all background investigations or reinvestigations. To initiate an investigation, the Contractor, in collaboration with the COR, will complete an e-QIP Request Form. This request form is available through the COR. The COR will submit the completed request form to the Bureau Personnel Security Officer (PSO). The PSO will enter the information into e-QIP to either establish a new applicant profile or determine if an existing investigation that meets Bureau requirements is on file. The PSO will then contact the applicant to provide additional information and instructions. Generally, the Contractor is required to complete the following forms:
• e-QIP application (on-line)
• Fair Credit Release
• OF-306
• Fingerprints via USAccess Credentialing Centers
The Contractor shall complete the required background investigation forms and submit them to the PSO. The PSO shall determine if individuals meet the required background investigation standards and citizenship requirements, and then make a suitability determination. Minimum standards used in suitability determinations are contained in the DOI Departmental Manual Part 441. The Government will pay for any background investigations required for contractor employees. If the Contractor employee’s background investigation is returned as unfavorable, the Government reserves the right to request reimbursement of the actual costs for the investigation from the Contractor.
17.4 Contractor employees must give, and authorize others to give, full, frank, and truthful answers to relevant and material questions needed to reach a suitability determination. Refusal or failure to furnish or authorize provision of information may constitute grounds for denial or revocation of credentials. Government personnel may contact the contractor personnel being screened or investigated in person, by telephone or in writing, and the Contractor must ensure they are available for such contact.

17.5 The background investigation should be requested well in advance of the start of work for Contractor employees as even the basic level of investigation can take up to 30 days to complete.
The requirement to obtain a favorable background clearance requires U.S. Citizenship and could also be validated by a previous U.S. Federal Government clearance. In addition, the Contractor should assess all prospective Contractor employees in advance of initiating a background investigation as the success of prospective Contractor employee's in obtaining a satisfactory adjudication is not likely if the answer is "Yes" to question 9, 10, 11, or 13 on the OF-306 Form for the prospective Contractor employee.
17.6 At least two weeks before start of contract performance, the Contractor must identify all contractor and subcontractor personnel who will require [physical and/or logical] access for performance of work under this contract. Physical Access means routine, unescorted or unmonitored access to nonpublic areas of a federally controlled facility. Logical Access means routine, unsupervised access to a Level 3 or 4 Federally controlled information system.
17.7 Before starting work under this contract, a National Criminal History Check (NCHC) will be initiated to verify the identity of the individual applying for clearance and to determine the individual's suitability for the position.
If the NCHC adjudication is favorable, a DOI Access Card will be issued for that individual. If the adjudication is unfavorable, the credentials will not be issued, and the contractor must make other arrangements for performance of the work. In the event of a disagreement between the Contractor and the Government concerning the suitability of an individual to perform work under this contract, DOI shall have the right of final determination.
17.8 Contractor employees who have been successfully adjudicated will be issued DOI Access Cards, which must be activated at a USAccess Credentialing Center. Those Contractor employees not located within a reasonable travel time of a USAccess Credentialing Center will be screened and issued alternate credentials, such as temporary access badges.
17.9 During performance of the contract, the Contractor must keep the COR/COTR apprised of changes in personnel to ensure that performance is not delayed by compliance with credentialing processes.
Cards that have been lost, damaged, or stolen must be reported to the COR/COTR and Issuing Office within 24 hours. If reissuance of expired credentials is needed, it must be coordinated through the
COR/COTR.
17.10 At the end of contract performance, or when a contractor employee is no longer working under this contract, the Contractor must ensure that all identification cards are returned to the COR/COTR.
17.11 This security requirement must be incorporated into any subcontracts that require subcontractor personnel to have routine unsupervised access to a federally controlled facility for more than 180 calendar days or any unsupervised access to a federally controlled Level 3 or 4 information system.
a. Access to Government Facilities. Access to BLM facilities will not be granted to Contractor employees until approved by the BLM Security Office and the individual requiring access has a security background investigation initiated.
b. Access to Information and Systems. Access to BLM Information and Systems will not be granted until approved by the BLM IT Security Manager and the individual requiring access has an adjudicated security background investigation. In addition, the Contractor employees will be limited to the roles/privileges necessary for the Contractor employees to perform his/her work assignments. c. Connection to BLM's Internal IT Network. Only BLM owned and approved IT equipment is authorized to connect to and access the internal network and resources. Connection of non-BLM approved equipment must be requested, well in advance of the need, and approved by the BLM IT Security Manager.
18.0 TRAINING:
In the performance of work under this PWS, the contractor is required to provide fully trained personnel to perform the required services. No direct cost reimbursement will be made by the Government for training contractor employees who are not proficient in the applicable technologies that the contract supports. In cases where the Government replaces equipment, systems and software or introduces new equipment, systems and software which are significantly different from those previously supported, reimbursement may be considered.
In advance of any training, the contractor will work with the COR to request the type of training necessary, for which personnel, quantity, and estimated costs from 3 different sources. This information will then be provided to the CO for negotiation and modification to the contract.
18.1 BLM Training. The following training will be required to be successfully completed by all CONTRACTOR employees, as applicable. After initial successful completion, the training is required annually.
18.1.1 . All contractors who create, access, or dispose of BLM data or information are required to complete web-based training courses on Records Management, the Freedom of Information Act, and the Privacy Act. This training takes approximately two hours.
18.1.2 . All contractors who are given BLM IT accounts, have access to BLM's internal IT network or IT resources are required to complete web-based general IT Security training and web-based role-specific IT Security training. This training takes approximately two hours.
18.1.3 All contractors are required to take the No Federal Employee Antidiscrimination and Retaliation (FEAR) Act Biennial Training. The training takes approximately two hours.
19.0 NON-DISCLOSURE AGREEMENT
As determined by the CO, prior to beginning work under this contract the contractor shall submit, to the COR and CO, a signed Non- Disclosure Agreement (NDA) from all employees that will be working on the contract.
19.1 . Application / Data Security. Contractors may have access to privileged and confidential materials of the United States Government. These printed and electronic documents are for internal use only and remain the sole property of the United States Government. Some of these materials are protected by the Privacy Act of 1974 (AMENDED) and Title 38 Code of Federal Regulations (Title 38). Unauthorized disclosure of Privacy Act or Title 38 covered materials is a criminal offense. Each contractor employee will be given access to only the information and facilities needed to perform the work associated with the contract.
19.2. System Security. The contractor shall comply with all the Federal, Office of Management and Budget (OMB), and DOI policies, directives, procedures, and memorandums in effect at BLM. Copies to be provided upon award.
20.0 DATA

All information generated and maintained under this contract, to include government- furnished information, must be available for Government review upon request. The contractor concurs that all information collected as a result of efforts under the contract are the property of the US Government and shall not be released either formally or informally without the consent of BLM. The Government has unlimited rights to all data and deliverables under this contract. The Government shall retain custody of all records associated with contractor deliverables and shall have exclusive control in the distribution of all written deliverables. If the contractor uses proprietary data in their proposal or in any other communication, it shall be marked appropriately.
21.0 Website:. Any updates or modifications to the BLM websites shall be in compliance with Section 508 of the Rehabilitation Act. The contractor shall also comply with applicable specifications and standards found in the National Institute of Standards and Technology's (NIST) Federal Information Processing Standards Publications (FIPS PUBs) (http://www.nist.gov/itl/fips.cfm), and the use of ANSI/EIA Standard 748 (As Amended) Earned Value Management System (EVMS).
