Questions received by October 6, 2023
1. In §4.0 SCOPE OF WORK under Task 7, item f. There are references to A.1, A.4.1, and A.4.2. These sections are not in the Solicitation. Can you provide clarity as to what these items reference?
Answer: The solicitation was renumbered and the references to those sections were not updated. A.1 is in reference to 3.0 Objective.
A.4.1 and A.4.2 are Section 4.0 Scope of Work.
2. Would a subcontractor be required to be registered with SAM.gov?
Answer: Yes the subcontractor shall be registered with SAM.gov.
3. If so, would the subcontractor be required to be registered before the bid is submitted, or before work began in April of 2024?
Answer: The subcontractor shall be registered in SAM.gov when the proposal is submitted by the offeror.
4. What is the sample being measured?
Answer: the solicitation is requesting Hydrocarbon Engineering technical support for the BLM.
5. What do you what measured, ie. composition, heating value, viscosity?
Answer: Measurement includes both quantity and quality.
6. Location of the project
Answer: The location of the Hydrocarbon Engineering support is remote.
Section 3 Price Schedule
3.1 Personnel
1. If the Offerer is able to provide more than 2 qualified engineers, does this solicitation allow for this? The idea is that the BLM may interview and select from the Offerer's qualified personnel.
Answer: The offeror may submit more than two qualified engineers.
2. It appears the Government may interview proposed substitutions, but not key personnel. Is that correct?
Answer: Per the solicitation: During the first 180 days of performance, the Contractor shall make no substitutions of key personnel unless necessitated by illness, death or termination of employment. The Contractor shall notify the Contracting Officer (CO) within fifteen days after the occurrence of any of these three events and provide the information required by paragraph below. After the initial period, the Contractor shall submit the information to the CO at least fifteen days prior to making any permanent substitutions.
The Contractor shall provide: A detailed explanation of the circumstances that necessitate the proposed substitution, and any additional information requested by the CO. The Government retains the right to interview proposed substitutes. Proposed substitutes should have comparable qualifications to the individual being replaced. The CO will notify the Contractor within fifteen days after receipt of all required substitute's personnel information. All proposed substitutes will be subjected to a two-week trial period. Proposed replacements that do not satisfy the Government during that trial period will be removed from the contract at no cost to the Government. The contract will be modified to reflect any approved changes in key personnel.
3. The solicitation states, “References and/or previous employers may be contacted by the Government to verify qualifications of individuals.” Would the contractor officer consider contacting the selected engineer prior to contacting a current employer?
Answer: per the solicitation: Resumes must be submitted for the personnel.

Section 4 Performance Work Statement
4.0 Scope of Work
1. For Task 1, will background HTML maintenance and/or IT-related support for the website beyond technical writing and communicating application status and BLM decision be within the scope of this contract?
Answer: Information Technology will be supported by the BLM IT Division.
Website content may be requested to be drafted by the contractor.
2. For Task 3, does the BLM prefer any specific software to be used to accomplish this task?
Answer: Data analysis will be completed with the current BLM software.
7.0 Place of Performance
1. The solicitation states, “The contractor engineers are expected to be remote staff and are not required to report to any BLM office. The contractors will work from their workplace or residence.” Could the contracted engineers work in a BLM office if located in a place where there is a BLM office?
Answer: per the solicitation: The contractor engineers are expected to be remote staff and are not required to report to any BLM office. The contractors will work from their workplace. Work will be performed remotely. BLM Office space is not available for this requirement.
Section 8 Instructions and Conditions
8.1 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL PRODUCTS AND
COMMERICAL SERVICES (MAR 2023)
1. Paragraph (c) states: Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
Later in the RFP in Section 8, 8.9.2 states: The proposal shall be valid for a minimum of ninety (90) days.
Question: How long must a proposal hold the prices in its offer – 30 calendar days or a minimum of ninety (90) days?
Answer: Per the solicitation. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
Per Section 8, 8.9.2-the proposal shall be valid for a minimum of ninety (90) days.
8.11 Technical Proposal (Volume I)
1. This section has the following statement: Even if offeror has an active SAM registration all offerors must 1) print, complete required entries and submit with their quote FAR provision 52.204-24, Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment; and 2) Ensure FAR provision 52.204-26 Covered Telecommunications Equipment or Services-Representation is incorporated into their SAM Registration and if not, they must print, complete required entries, and submit with their proposal.(this does not count against the technical proposal page numbers).
Question: SAM registration no longer includes FAR provisions 52.204-24 or 52-204-26. The direction is clear for how to comply with the solicitation requirement in the event FAR provision 52.204-26 is not included in the SAM Registration. How should the offerer comply the requirement when the FAR provision 52.204-24 is no longer included in the SAM Registration?
Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Nov 2021)
Answer: Per 52.204-24: The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services— Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
2. 8.11.7 states: The technical proposal shall include all subcontractors proposed to work on this contract. Include the subcontractor’s DUNS number and address.
Question: Is a subcontractor required to be registered in SAM?
Answer: Yes.
Question: Does the solicitation require the offerer to provide Unique Entity Identifier (UEI) numbers for subcontractors?
Answer: Yes
8.12 Past Performance Proposal (Volume II)
Question: If a subcontractor from a previous federal government contract will be part of more than one solicitation, should the subcontractor provide a Past Performance Questionnaire for each Offerer or will one Past Performance Questionnaire for the subcontractor suffice for all offers?
Answer: Per 8.12.2.2 The Offeror shall provide past performance examples for all subcontractor(s) proposed to perform work on this contract. The past performance shall reference projects relevant to the scope and complexity of the work they will perform. The work shall be recent (within the last three (3) years.
