STATEMENT OF WORK FOR ROCKY PINE PRE-COMMERCIAL THINNING PROJECT

Statement of Work Rocky Pine Understory Reduction

Sever, Hand-pile, Cover

1. Introduction:

The Turnbull Fish and Wildlife refuge in Cheney, WA is soliciting fuels management (vegetation removal) services to reduce the risks associated with wildland fire and to improve forest health on FWS lands in Washington state.

2. Background:

The Rocky Pine Understory Reduction project area is a newly acquired property that was private property. Rocky Pine has had multiple commercial harvests in previous years. Rocky Pine was analyzed by the Turnbull fuels staff in 2023 and deemed a hazard for wildfire. This forest health assessment determined the need to remove understory (ladder fuel) vegetation to reduce fuels and improve conditions of the forest stand to reduce the chances for a large costly fire in the wildland urban interface.

3. Purpose:

The FWS is proposing to reduce the density of understory vegetation on 614 acres of forestland located approximately 3 miles outside the community of Cheney, Washington. The project area is along the Depot Springs Road. The overgrowth of forest vegetation has heightened inter-tree competition and reduced the vigor and resiliency of the entire stand. Bark beetles are currently infesting ponderosa pine. Mortality is occurring both from competition with other trees for light, nutrients and water, and from the bark beetle infestation. This mortality is creating standing dead material and adding excessive dead fuel to the forest floor. Heavy fuel loadings can increase wildfire intensities and impede firefighting efforts.

4. Scope of Work:

This Task Order is for 614-acre unit. For understory reduction (severing/cutting), hand-pile and covering.

(Line Item 7B - Level II - Canopy Cover of material to be hand severed, piled, and covered is estimated to average between 10 and 30 percent cover)

Project Specifications:

Severing/Felling:

Space understory trees an average of 45 feet apart with a ±10% tolerance to vary spacing from 40 to 50 feet. Tree spacing of understory trees (trees less than 7 inches DBH) is independent of their proximity to overstory trees (trees greater than 7 inches DBH). No aspen shall be cut. In areas where trees greater than 7” DBH do not exist, favor the best leave tree using 40 to 50 foot spacing. Understory trees that would be retained include the largest, best-formed, most vigorous appearing tree within this species preference ranking:

1. Quaking aspen (Populus tremuloides)

2. Cottonwood (Populus deltoides)

STATEMENT OF WORK FOR ROCY PINE PCT PROJECT

3. Chokecherry (Prunus virginiana)

4. Hawthorn (Crataegus)

5. red-osier dogwood (Cornus sericea)

6. ponderosa pine (Pinus ponderosa)

Individually selected trees (regardless of size) that exhibit unique ecological characteristics or that show potential for contributing to the long-term silvicultural goals and objectives of the proposed action would be retained with a wider individual tree spacing (± 40 feet) to ensure their longevity on the site. Unique tree characteristics include:

old growth conifers (> 25 inches DBH) well-formed fire resilient tree species that require more growing space (namely pine) uniquely structured trees (such as flat-topped trees, trees with an open-grown crown structure)

No felling (severing) shall occur within identified stream buffers or other protected sites as indicated on the map and flagged in the unit.

All stumps/stobbs created by severing shall not exceed 6 inches in height above ground level, or 4 inches above natural obstacles. The cut angle shall be perpendicular to the long axis of the stem (flat). Cut stems shall be completely severed from the stump. Low stump along roadways.

All stems shall be directionally felled away from (as not to damage) land ownership markers, project boundary markers, roads, telephone lines, electrical lines, established livestock trails, established recreation trails, monumented corners, bearing trees, fences, watering developments, and streams.

All hang-up stems shall be pulled down and made to lie on the ground.

All flagged and/or tagged trees shall be left standing.

Piling:

All created slash (severed limbs/cut stems) shall be piled by hand. Stems larger than 5 DBH left on the ground laying flat on the ground.

Hand-piles shall not be constructed within 30 feet of the property line or unit boundary.

Hand-piles shall not be constructed in or on road systems, spur roads, on established recreation trails, on established livestock trails, on culverts (or over culvert discharge areas), or within the right-of-way fence clearing (30 feet each horizontal direction from the fence center line).

Hand-piles shall not be constructed within 30 feet of an active stream channel edge, or 30 feet from the inner gorge of an intermittent channel. In perennial fish and non-fish bearing channels, piles will not be constructed within 30 feet of the channel edge.

Hand-piles shall be constructed by stacking horizontal to the ground, and they shall have a base wide enough to keep them from toppling.

Hand-piles shall be constructed compactly. Hand-piles shall have a core of materials consisting of material less than or equal to 2 inches in diameter. Larger material shall be placed on top of this core. Slash that causes large air spaces in piles shall be cut or crushed to eliminate air spaces.

Hand-piles shall have a height minimum of 5 feet, and a height maximum of 8 feet. Hand-pile diameters shall also have a minimum of 6 feet, and maximum of 8 feet. Slash exceeding 6 feet in length shall be bucked into lengths of 4 feet prior to piling.

Material protruding out of the pile beyond the compact portion shall be bucked off and added to the pile to facilitate disposal by burning.

Any piles not meeting specifications shall be reconstructed at no additional cost to the Government.

Pile Covering:

The contractor shall cover all hand piles with waterproof material furnished by the contractor.

Covering material shall not be petroleum based. Waterproof material shall be placed on top of each pile during construction when the pile is approximately 75% completed. This material must cover 50% of the entire top surface of the pile (even if this takes two pieces of material).

Care shall be taken not to puncture the covering material. The waterproof material shall then be secured with slash material comprising the remaining 25% of the pile. This will assure that the waterproof material is not affected by wind and will protect most of the pile from rain and snow.

5. Location of Project Area:

The project area is in Spokane County, WA approximately 3 mile outside the community of Cheney along W Depot Springs Road of Cheney Spangle Road (see maps).

6. Project Boundary:

The attached map defines the Project Boundary for this task order. The Project Boundary will be marked on site with flagging. The COR will inform the Contractor and/or Crew Leader of the flagging color and paper tag description at the pre-work meeting.

7. Access:

The project area can be accessed by vehicle through the town of Cheney, WA, using the following directions:

Turn South on Cheney Spangle Road off highway 904 in Cheney.

In 3 miles turn left (east) onto Depot Springs Rd.

The project area boundary will start on the left-hand side (North) for the north unit and to the right (south) for the south unit.

8. Notification of Cessation or Restart of Work:

The Contractor will notify the Contracting Officer Representative (COR) prior to ceasing operations for three (or more) days. The Contractor will also notify the COR before re-starting operations after a shutdown of three (or more) days. This can be done by phone, E- mail, or in person.

9. Personnel Requirements:

The Contractor must always maintain an adequate work force to ensure timely completion of the work. The Contractor is responsible for the crew knowing the requirements of the contract, and the Contractor is also responsible for maintaining a safe working environment. The Contractor (or designated Crew Leader) must attend the pre-work meeting for this project and will inform the COR of the crew size and identified Crew Leader.

Crew Leader:

The Crew Leader shall have the ability to implement this project with crewmembers in a safe and efficient manner. Safety to all personnel and the public is the project priority. All crew members will wear the appropriate Personal Protective Equipment (PPE) while working on site of the project.

Individual PPE includes: Leather boots (minimum of 8 inches in height), a long-sleeved shirt, a hardhat, eye protection, leather gloves, hearing protection, and chainsaw chaps (when using a chainsaw). A Crew Leader must be on-site always directing work. Failure to produce a qualified and on-site Crew Leader will result in the Contracting Officer (CO) issuing a Suspend Work Order. Prior to any work starting, the Crew Leader will have a documented safety briefing with all crewmembers.

The documentation will be passed on to the Project Inspector (PI) or COR.

Work Camps:

Camping is not permitted on Turnbull Fish & wildlife lands. If work camps are needed, the Contractor may coordinate with the COR for acceptable locations and practices. If camping is expected to last more than 14 days, prior written authorization must be obtained through the COR.

Work Hours:

All work performed under this contract shall be limited to the time between one-half hour before sunrise to one-half hour after sunset each day.

If the contractor observes public within the work area during operation, the contractor will stop work and ask the public to vacate the unit. If the individuals will not leave, the contractor will move his crew to a different location; continue to work and document that the individual would not vacate the area. The documentation will be passed on to the COR.

10. Inspection and Acceptance:

Inspection:

The Government will make periodic inspections as a basis for acceptance and payment and recommendations for adjustments in work quality while work is in progress. The Contractor is encouraged to observe inspections while they are being made.

As the basis for payment, inspections for compliance with specifications will be made for work units reported as completed by the contractor. All plots will be averaged together to determine payment.

Inspections will be made on a series of 1/20th acre plots (26.3 Foot radius) located randomly across each work unit. Enough plots will be taken to obtain at least one percent sample of the work unit.

For example, on a 100 Acre unit, a contractor should expect a minimum of 20 plots randomly distributed throughout the unit. Inspections will be made on the piles constructed throughout the unit. Piles will be evaluated by the COR or PI for contract compliance. A pile outside of specification is equivalent to 1 percentage point that goes into determination of work quality.

The following information will be recorded for each plot inspected:

1. Total number of trees cut and/ or removed from the plot.

2. Number of unacceptable cuttings, either missed entirely, severed, but with live limbs, or stumps greater than specifications.

Determination of Work Quality Percentage:

Work quality percentages are derived from data developed from inspection plots. The final work quality percentage times the bid price determines the pay. A work quality percentage of 90 percent or higher will result in full payment. If high stumps or uncut surplus trees are the primary reason for unsatisfactory work, the Contractor shall rework areas designated by the Government until satisfactory work quality is obtained.

Example: Number of trees cut per plot = 40 Number of unacceptable cuttings = 8 trees 8 divided by 40 X 100 = 20% 2 piles that did not meet specifications = 2% 100% minus 22% = 78% 78% X bid price for job = Pay Rate

Acceptance:

A. Satisfactory Work Quality:

A minimum work quality standard of 90 percent is required.

B. Unsatisfactory Work Quality:

Based on inspection results, if the work quality percentage falls below 90 percent, the Contracting Officer will immediately notify the Contractor in writing and instruct the Contractor to improve the quality of the work. If the quality of the work is not raised to an acceptable level within two consecutive workdays after written notification, the Contracting Officer may issue a stop work order.

11. Government Furnished Property:

The Government will provide the following items to the Contractor:

1. Map (1:12,000 scale) of the project area.

12. Performance Period:

The estimated dates for this project are:

Start Date: 10/1/2024 End Date: 12/30/2025

DOI-AAAP-0050 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (DEC

2015)

1) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.

2) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.

3) We request that you furnish the Contracting Officer (CO) with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official (AO). Information in the report must be protected as source selection sensitive information not releasable to the public.

4) When your Contractor Representative(s) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at https://www.cpars.gov/.

5) Within 60 days after the end of a performance period, the AO will complete an interim or final past performance evaluation, and the report will be accessible at https://www.cpars.gov/.

a) Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment.

b) Your comments should focus on objective facts in the AO's narrative and should provide your views on the causes and ramifications of the assessed performance.

c) All information provided should be reviewed for accuracy prior to submission.

d) If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in the space provided, and then selecting “Accept the Ratings and Close the Evaluation”.

e) Your response is due within 60 calendar days after receipt of the CPAR. On day 15, the evaluation will become available in PPIRS-RC marked as “Pending” with or without comments and whether or not it has been closed.

f) If you do not sign and submit the CPAR within 60 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment."

6) The following guidelines apply concerning your use of the past performance evaluation:

a) Protect the evaluation as source selection information. After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the CO for instructions.

b) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

c) Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.

7) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the CO no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.

8) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.
