Notice will be provided regarding the legal outcomes that impact your agreement.
U.S. Fish and Wildlife Service, Willow Beach National Wildlife Refuge (NWR) located in Willow Beach, Arizona, has a requirement for two (2) Trout Pump Variable Frequency Drives (VFD’s) with Installation on the Floating Platform Pumps system.
This Request for Quotation (RFQ) is a TOTAL SMALL BUSINESS SET ASIDE and is conducted under the procedures of FAR Parts 12 and 13, incorporating provisions and clauses in effect through Federal Acquisition Circular 2025-
06. The NAICS code is 238210 Electrical Contractors and Other Wiring Installation Contractors and the small business size standard is $19 million.
Instructions All responsible small business sources may submit a quote, which shall be considered by the agency. Award will be made as a firm-fixed-price contract. The Government intends to make a single award to the responsible offeror whose quotation represents the best value to the Government, considering price and non-price factors identified. Consistent with FAR 13 procedures, the Government will use a comparative evaluation to determine which quotation is most advantageous. Under this method, the Government compares quotations directly to one another, assessing the relative strengths, weaknesses, and benefits of each, rather than evaluating each quotation against a fixed set of standards or using a formal rating system.
The Government may select a quotation that is not the lowest priced if it provides superior technical value or reduced performance risk. Conversely, the Government may select a lower-priced quotation if its technical value is determined to be equal or close in merit to higher-priced alternatives. Award will be made to a responsible source pursuant to FAR subpart 9.1.

In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment shall be made in the Purchase Order price to cover any increase in costs incurred as a result thereof. Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
'Payment request' means any request for contract financing payment or invoice payment by the Contractor. (a) Definition. Small business concern, as used in this clause—

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations; or similar opportunities that are sponsored or established by the contractor or subcontractor.
Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.
(b) In connection with the performance of work under this contract, the Contractor agrees as follows:
(1) The Contractor will not engage in any racially discriminatory DEI activities;
(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;
(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;
(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer;
and
(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.
(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).
(c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.

Submission Requirements Offerors shall submit a complete quotation that contains all information necessary for the Government to evaluate the offer in accordance with FAR 52.212-2. Failure to provide the required information may render the quotation non-responsive.
Quotations shall include the following components:
1. SF 1449: Provide a completed SF 1449 with signature. Provide all signed amendments (SF 30) if issued for this notice.
2. Company Information: Provide name of firm, subcontractor (if applicable), and the offeror point of contact name, phone number, and e-mail address and SAM.gov Unique Entity Identifier (UEI).
Vendors must be registered and active in SAM.gov to be considered for the award action.
3. Completed Provisions: A completed copy of the provision at 52.212-3, Offeror Representations and
Certifications-Commercial Products and Commercial and 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment.
