(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the Government will consider the certification in connection with a determination of the Offeror's responsibility.

Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror non-responsible.

Document Title

(d) This provision does not require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a). The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If the Government later determines that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

7.6 Technical Evaluation Standards (Section M)

Each technical proposal will be evaluated on an "Acceptable" or "Unacceptable" basis. The Technical Evaluation Team will assign a rating in accordance with the chart below. All elements

(i) through (iv) must be rated Acceptable in order for the proposal to be rated Acceptable overall.

Definition Rating

Passes (or meets) minimum standard requirements Acceptable

Fails to meet minimum standard requirements Unacceptable

a. Technical Standards:

(i) Technical Approach. An acceptable rating is met by a narrative that addresses all of the elements listed under Factor 1 with a realistic and achievable approach that will effectively accomplish the work described in the Statement of Work. An unacceptable rating will result from: omission of any required element; logical inconsistencies or discrepancies between the proposed approach and the Statement of Work; unrealistic or unachievable strategies; factual errors; failure to describe controls that separate construction operations from students and staff

Document Title

WHS Greenhouse Installation Page on an occupied campus; or failure to describe safety and environmental compliance measures appropriate to the work.

(ii) Key Project Management and Technical Support. An acceptable rating is met when the proposal addresses all of the elements listed under Factor 2 with a qualified team of key personnel, teaming partners, and/or subcontractors that collectively can accomplish the work described in the Statement of Work. An unacceptable rating will result from: proposal of personnel who do not hold the licenses or certifications required to perform the electrical, mechanical, or gas work; absence of a dedicated on-site construction superintendent; illogical teaming structures; QC responsibility assigned to production supervision; or resources insufficient to accomplish the work within the period of performance.

(iii) Project Schedule. The offeror is required to provide a progress schedule that is complete, proper, and accurate. An acceptable rating is met if the schedule addresses all elements required by the Gantt form or an alternative form, properly breaks out appropriate major elements of work, describes work elements in sufficient detail, accurately reflects a reasonable timeline, logically sequences major work elements reflecting a sound project approach and understanding of major project tasks, assigns work element percentages of work values that are accurate, reasonable, and balanced, and shows an overall project duration within the specified maximum performance period or sooner. An unacceptable rating will result from: a proposed duration exceeding 120 calendar days from Notice to Proceed; omission of definable features of work identified in Section 4.0; missing or illogical predecessor and successor relationships; durations that are not achievable given the proposed crew sizes and delivery lead times; failure to reflect the milestone dates in Section 7.0; work element percentages that are unbalanced or that do not total 100 percent; or a schedule that omits concrete cure time, utility provider coordination, or background investigation processing.

(iv) Quality Control Plan. An acceptable rating is met when the Quality Control Plan submitted is original and specific to this project and is consistent with the Statement of Work. An unacceptable rating will result from: a plan that parrots the Statement of Work; a plan that is generic or not tailored to greenhouse construction; inconsistency with the Statement of Work;

absence of an inspection and test plan for the definable features of work; or absence of a deficiency tracking and correction process.

b. Price Evaluation.

Price will not be point-scored. The Government will evaluate price for reasonableness in accordance with FAR 13.106-3 or FAR 15.404 as applicable, and will examine the schedule of values for unbalanced pricing. Award will be made to the lowest evaluated price among proposals rated Acceptable on all technical factors. A proposal containing materially unbalanced pricing, or a price so low as to indicate a lack of understanding of the requirement, may be rejected.
