About this file
This is a supplement to the Indian Economic Enterprise (IEE) set-aside clause for a federal solicitation (140A2325XXXXX) that establishes required submission and compliance requirements for offerors responding to Indian-focused procurement opportunities. The document provides a template form that offerors must complete and submit with their proposals, requiring them to describe the percentage of work and costs they will perform versus subcontract, with specific limitations outlined in 48 CFR 1452.280-3. For supplies and services, subcontracting to non-IEE firms is limited to 50%, while construction work allows up to 75% for special trade contractors and 85% for general construction contractors. Offerors must also identify all key personnel assigned to the contract (unless the Contracting Officer determines key personnel are not required) and provide written assurance both before contract award and upon successful completion that they will remain in compliance with all IEE requirements.
Failure to provide the required information regarding subcontracting percentages, key personnel qualifications, and written assurance may result in the Contracting Officer finding the offer non-responsive and rejecting it. The supplement applies specifically to the related solicitation IE181 for Wingate High School Greenhouse Construction (Solicitation Number 140A2327Q0297), a construction project set aside for Indian Small Business Economic Enterprises with an estimated value between $100,000 and $250,000 under NAICS Code 236210, and managed by the Department of the Interior Bureau of Indian Affairs Bureau of Indian Education.
