(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax

Brush Clearing – Chickasaw Agency Page 11 of 15 because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has □ has not □, within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

1. INTRODUCTION

Context of Project The Chickasaw Agency (Agency) is responsible for managing approximately 74,000 acres of trust and restricted lands for the Chickasaw Nation and individual members of the Five Civilized Tribes within the Chickasaw Nation. To support effective land stewardship, the Agency has developed a Brush Control Program to improve pasture and rangeland conditions. The purpose of this program is to slow the growth and prevent the establishment of undesirable woody plants while also preventing the introduction and spread of noxious weeds on trust and restricted lands managed by the Agency.

Uncontrolled woody plant encroachment and noxious weed infestations reduce forage availability, diminish wildlife habitat quality, and compete with desirable native vegetation for water, nutrients, sunlight, and space. By reducing these invasive and undesirable species, the Agency promotes the establishment and persistence of productive grasses, forbs, and other beneficial plant communities. Improved vegetation conditions increase forage production for livestock, enhance habitat and food resources for wildlife, improve soil and watershed health, and contribute to greater overall land productivity.

Proper management of woody plants and noxious weeds also increases the economic return and long-term sustainability of trust and restricted lands by maximizing their agricultural and conservation potential. Through the Brush Control Program, the Agency is working to ensure that these lands remain productive, resilient, and capable of providing lasting benefits to current and future generations of landowners, agricultural producers, and tribal members.

Site Inspection by Bidders Bidders are strongly encouraged to inspect the project area during the open bid period prior to submitting a bid. It is not possible for the Agency to identify or describe all site conditions, access limitations, terrain features, vegetation conditions, operational constraints, or other factors that may affect the work or the Contractor's costs.

Prospective bidders are responsible for obtaining all information necessary to prepare their bid and to understand the conditions under which the work will be performed.

Site inspections may be conducted only during the open bid period and must be completed prior to bid submission. Inspections are limited to observation by foot or by aerial means. The use of motorized vehicles, including but not limited to automobiles, trucks, all-terrain vehicles (ATVs), utility terrain vehicles (UTVs), motorcycles, or other motorized equipment, is prohibited on the properties prior to contract award unless specifically authorized in writing by the Contracting Officer or Agency Coordinator.

2 | P a g e

Submission of a bid shall constitute acknowledgment that the bidder has either inspected the project area or otherwise satisfied themselves as to the conditions affecting the work, including site access, terrain, vegetation, and operational requirements. Failure to inspect the project area shall not relieve the Contractor of the responsibility to perform the work in accordance with the contract requirements.

2. LAND CLASS / DESCRIPTION OF THE PROPERTY

A. Boundaries The Agency has management responsibility for approximately 74,000 acres of trust and restricted lands owned by the Chickasaw Nation and individual members of the Five Civilized Tribes within the Chickasaw Nation. These lands consist of numerous scattered tracts located throughout 13 counties in southern Oklahoma.

To promote effective vegetation management and long-term rangeland health, adjacent properties and properties located within the same geographic area are managed as a common vegetation management unit whenever practicable, regardless of ownership. This coordinated approach allows for more efficient treatment of woody plant encroachment and noxious weed infestations, reduces the potential for reinfestation from neighboring properties, and supports the long-term productivity, sustainability, and ecological integrity of trust and restricted lands throughout the Agency's jurisdiction. (See image below)

3 | P a g e

B. Resource Base The lands managed by the Agency consist primarily of agricultural rangelands utilized for livestock grazing and forage production. These rangelands support a mixture of native plant communities and improved introduced forage species. Some tracts also contain cultivated cropland used for the production of small grains and winter forage crops. In addition, a limited amount of commercial forestland occurs within the Agency's jurisdiction.

Revenue generated from these lands is derived primarily from agricultural activities, including grazing and crop production, as well as oil and gas development. Woody plant encroachment and noxious weed infestations pose a significant threat to the productivity and value of these resources by reducing forage availability, limiting agricultural use, and negatively impacting rangeland health.

As a result, vegetation management efforts under the Brush Control Program are focused primarily on agricultural rangelands used for grazing and forage production, where treatment activities can provide the greatest benefit to land productivity, resource conservation, and long-term economic return.

3. PLANT SPECIES

Inventory of Weed Species Agency personnel conduct weed inventories twice annually during lease compliance inspections. Woody plants and noxious weed species are identified and documented during these inspections.

Targeted Woody Plant Species For the purposes of this contract, targeted woody plant species include vines, shrubs, saplings, eastern red cedar, and any tree species measuring less than four (4) inches in diameter at breast height (DBH). Unless otherwise specified by the Agency Coordinator, all targeted woody vegetation occurring within designated treatment areas shall be subject to treatment.

Targeted Noxious Weed Species Targeted noxious weed species include Musk Thistle, which is designated as a high-priority species, and Sericea Lespedeza, which is designated as a medium-priority species.

Common Broomweed has also been included as a targeted species under this contract.

4. MANAGEMENT GOALS AND WEED MANAGEMENT OBJECTIVES FOR

THE PROPERTY

A. Land Management Goals The Agency’s primary goal is to protect, preserve, and enhance the natural and economic value of the trust and restricted lands under its management. Effective control of invasive woody vegetation and noxious weeds is essential to maintaining healthy, productive rangelands and agricultural resources. Through proactive vegetation management, the Agency seeks to restore and sustain optimal land conditions that support long-term agricultural productivity, ecological health, and economic viability.

B. Weed Management Objectives The Agency’s vegetation management objective is to maintain woody plant and noxious weed populations below levels that negatively impact the productivity, ecological health, and economic value of trust and restricted lands. This objective requires addressing existing infestations while preventing the establishment and spread of new infestations through timely and effective management practices.

The economic threshold is the point at which the cost of controlling woody plants or noxious weeds equals the value of the benefits gained from treatment, or when losses in forage production and land productivity equal the cost of control. By maintaining infestations below this threshold, the Agency can protect rangeland resources, improve forage production, and sustain the long-term value of the lands under its management.

C. Description This project is being completed under the Chickasaw Agency's Brush Control Program, which is designed to improve rangeland health, maintain productive agricultural lands, and reduce the spread of invasive and undesirable vegetation on Bureau of Indian Affairs (BIA) restricted lands within the Chickasaw Nation.

The project area encompasses approximately 72 acres located in Johnston County within the boundaries of the Chickasaw Nation.

The purpose of this project is to reduce woody plant encroachment and control noxious weed infestations that negatively affect forage production, wildlife habitat, and the overall health of native plant communities. Woody vegetation and invasive weeds compete with desirable plant species for water, nutrients, sunlight, and space, reducing land productivity and ecological function.

5 | P a g e

Project activities will focus on the mechanical treatment of targeted woody vegetation and noxious weeds within designated treatment areas. Treatment efforts will support the restoration and maintenance of healthy plant communities by reducing the presence of invasive and undesirable vegetation and promoting the growth of desirable forage species.

The project goal is to achieve a minimum treatment effectiveness rate of 95 percent within the designated treatment areas, as verified through Agency inspections and project monitoring.

The overall objective of the project is to improve forage production, enhance wildlife habitat, promote healthy native plant communities, and preserve the long-term productivity and value of trust and restricted lands managed by the Agency.

This keeps the 95% figure at the project level while leaving the detailed performance requirements for the Performance Standards or Contractor Responsibilities section.
