About this file

This is a Request for Quote (RFQ) for a five-year Indefinite Delivery/Indefinite Quantity (IDIQ) contract with the National Oceanic and Atmospheric Administration (NOAA) for scientific and technical support focused on chemical hazard assessment. The contract, with a maximum value of $4.99 million, will support the Emergency Response Division (ERD) in assessing risks from oil and hazardous materials pollution events. The contractor will provide 24/7 on-call support for analyzing chemical and petroleum samples, assessing environmental and human health impacts, and supporting emergency response efforts.

Key procurement details include a solicitation issued on 11/20/2025, with quotes due by 12/03/2025 at 10:00 AM ET. The contract period runs from 01/01/2026 to 12/31/2030. The procurement is set aside for Women-Owned Small Businesses (WOSB) and uses a two-volume quote submission process: a technical approach and pricing. Evaluation will prioritize the technical approach, with the Government selecting the quote most advantageous to their needs. The contractor must demonstrate capabilities in oil sample analysis, scientific communication, emergency response support, and maintaining specialized libraries of petroleum and chemical samples.

Five-Year Ordering Period of Chemical Hazard Assessment in accordance with the Performance Work Statement

B.001 Overview of the Price Schedule

The five-year IDIQ contract will be priced in separate one-year ordering periods. The first one-year ordering period is anticipated to start January 1, 2026, and continue through December 31, 2026. Each consecutive ordering period thereafter will follow suit until December 31, 2030, upon which time the contract expires. The Government, however, in accordance with FAR clause 52.217-8, Option to Extend Services (NOV 1999), may exercise the unilateral right to extend the contract ordering period, at the prices established therein, up to six months beyond the five-year ordering period. In accordance with FAR 52.216-18, Ordering (AUG 2020), task orders may be issued orally or by electronic commerce methods.

Attachment B Pricing Schedule details pricing for each one-year ordering period for all labor categories.

Rates shall not contain more than two numbers past the decimal point. The labor category descriptions are included in the Performance Work Statement.

Proposed rates for the labor categories shall be per hour and "loaded", that is inclusive of all wage, fringe benefits, overhead, general and administrative expenses, and profit.

Contractor direct rates for equipment items shall be negotiated at the task order level and shall also be "loaded," that is, inclusive of all cost (excluding labor), overhead, general and administrative expenses, and profit.

Furthermore, contractor direct rates for equipment items shall be an hourly rate unless indicated as a day rate, which is inclusive of a 24 hour period. Sufficient documentation must be submitted to substantiate that the ODC has a direct relationship to the work and is in accordance with generally accepted accounting principles, established company accounting practice and FAR Part 31, Contract Cost Principles and Procedures.

CAR 1352.216-75 Minimum and maximum contract amounts. (APR 2010)

During the term of the contract, the Government shall place orders totaling a minimum of $1,000.00.

The amount of all orders shall not exceed $4,990,000.00.

(End of clause)

CAR 1352.216-77 Ceiling price. (APR 2010)

The ceiling price of this contract is $4,990,000.00. The contractor shall not make expenditures nor incur obligations in the performance of this contract which exceed the ceiling price specified herein, except at the contractor's own risk.

Section C - Description/Specifications

C.001 Description of the Services

The full scope of work is included in the Performance Work Statement, which is Attachment A. The Contractor shall furnish the necessary personnel, materials, equipment, services and facilities (except as otherwise specified) to perform the Performance Work Statement referenced as an attachment. Each task order will have its own specific Performance Work Statement that the Contractor shall adhere to.

OR&R has a requirement for scientific and technical support focused on assessment of chemical hazards related to oil and hazardous materials pollution, which is a critical function for OR&R to fully meet its mission goals and statutory mandates. Work done under this requirement will primarily be in support of the Emergency Response Division (ERD) of OR&R, which serves as the designated science advisory team to the US Coast Guard Federal On-Scene Coordinator during Coast Guard-led emergency responses to oil and hazardous materials pollution events.

This scientific and technical support focuses on:

- Assessing risks to the general public from volatile chemicals, including prediction of volatilization rates, air dispersion, and transport;

- Assessing environmental impacts from chemicals released into surface water, both marine and fresh waters;

- Identifying potential hazards from fires or explosions;

- Discussing environmental and human toxicity from pollutants;

- Providing information about physical properties and reactivity of chemicals;

- Translating scientific understanding into guidance documents, information products, training, tools or other products for use by lay responders and field personnel during an incident response or for planning and preparedness to pollution events or damage assessment activities;

- Analytical lab support during ongoing pollution emergencies, particularly focused on physical and chemical property measurements of petroleum products and petroleum-containing field samples;

- Advising on methods of chemical analysis and field sampling;

- Interpreting analytical assay results from analyses performed by the Contractor’s lab or third-party labs;

- Assessing the likelihood that a field petroleum sample matches a known source sample using oil fingerprinting methods;

- Occasionally responding to an on-scene Incident Command Post to provide scientific support

The Contractor will be required to respond to tasks on both an emergency and non-emergency time frame. It is anticipated that a higher percentage of effort will be for non-time-critical support, but the ability of the Contractor to respond quickly during an emergency event is critical to OR&R's mission and paramount to the fulfillment of the Contractor's obligations.

Section E - Inspection and Acceptance

E.001 NOAA/EAD Inspection and Acceptance

(a) Inspection, acceptance, and rejection decisions will be based upon compliance with Section C of this contract and the task order requirements.

(b) Inspection of delivered items shall be performed at destination by the Contracting Officer's Representative (COR) as designated in the task order. Task orders requesting multiple types of products or services may be inspected at multiple locations to be specified in the task order.

(c) Notification of Government acceptance of deliverables will be provided by the COR via email.

Notification of rework of deliverables will also be furnished by the COR via email. Notification of rejection of deliverables will be furnished via email by the COR.

(d) Inspection Technique The Government will perform one or more of the following inspection techniques:

(1) a full inspection of all deliverables;

(2) a partial inspection of all deliverables or a full inspection of a few deliverables;

(3) an inspection based on a statistical sampling technique;

(4) a review of the contractor's inspection documents, if requested as a deliverable in a task order;

(e) Inspection Procedure Unless stated otherwise by the Government in a task order, the inspection procedure will involve visual comparisons of the deliverable with source digital data, imagery, or hard copy provided as Government Furnished Property (GFP), along with source and ancillary data acquired by the contractor. If the deliverable is a digital product, the data will be subjected to automated checks and will also be plotted for visual examination and comparison. The inspection is intended to ensure that items such as metadata, format, content, positional accuracy, attribution, scale, material, topology, edge alignment, content and completeness, resolution, feature portrayal, feature classification, feature relationships, and other items are in compliance with specifications stated in the task order.

(f) The Government will identify detected errors and provide that information to the contractor. Written and graphic documentation, when applicable, indicating items requiring correction will be supplied for all detected errors. The Government is not required to detect all errors, only that an error has been detected and that all individual deliverables within the delivery must be reinspected for any errors by the contractor and all errors corrected at the contractor's expense. In the case of significant or numerous errors, the Government may require complete reprocessing of the entire delivery lot, at the contractor's expense.

(g) An individual deliverable that is split between two or more delivery lots will be inspected by the Government but will not be accepted until the entire deliverable is received by the Government.

(h) If a sample of the delivery lot or a review of the contractor's inspection documents identifies that any part of the delivery lot does not comply with task order specifications, the entire delivery lot may be returned for rework. Since only a sample may have been used to determine the need for rework, some of the unsampled deliverables in the delivery lot may actually be acceptable. However, the contractor shall reinspect all individual deliverables within the delivery lot regardless of whether or not the Government has identified an error in those individual deliverables, and correct all errors at the contractor's expense.

(i) The results of the government’s inspection will be communicated to the contractor via email from the COR. This inspection does not replace the Contractor Performance and Assessment Report (CPAR) executed at the end of each task order’s period of performance (or at least annually) in accordance with

Federal Acquisition Regulations.

(End of term and condition)

E.002 NOAA/EAD Rework/Rejection Procedures

(a) In accordance with paragraph (j) of FAR 52.246-2, Inspection of Supplies – Fixed Price (AUG 1996), upon request for rework of any nonconforming deliverable the following general procedures shall apply.

The contractor will be notified via email from the COR if the deliverable requires rework and the cause for rework. Paragraph (g) of FAR 52.246-2 requires the contractor to remove rejected supplies (deliverables); however, all components of the nonconforming deliverable will be returned to the contractor with the rework notice. Upon receipt of the notice of rework, the following procedures shall apply:

(1) For the purposes of paragraph (h) of FAR 52.246-2, the contractor shall correct and return the nonconforming deliverable or delivery lot (if other than aerial photography) within 30 calendar days from receipt of the rework notice at no additional cost to the Government.

(2) Rework not returned within 30 calendar days shall be considered late.

(3) Any deliverable requiring rework that is not corrected after two requests for rework may be rejected by written notification from the Contracting Officer (CO) and no payment will be made for that deliverable.

(4) The corrected deliverable and new verification materials shall be furnished to the task order COR for retesting as detailed in FAR 52.246-2 and this clause. The contractor will be notified, in writing via email, by the CO or the authorized COR, of acceptance or rework of the corrected deliverable or delivery lot within the same inspection period stated in Section E of the task order.

Section H - Special Contract Requirements

H.001 NOAA/EAD Terms and Conditions

1. NOAA/EAD: TRAVEL

This IDIQ may require the Contractor to travel. If travel is required, the travel shall be requested and approved in advance by the Federal Program Manager and Contracting Officer’s Representative (COR).

The travel estimate shall include the name of the individual that is proposed to travel, the reason for the travel as it relates to the scope of work (reference the project number), the dates and location of travel, the estimated cost and confirmation that the cost is in compliance with the Federal Travel Regulations (FTR), DOC Travel Regulations, and NOAA Travel Regulations. The contractor shall purchase airfare at the most economical cost to obtain the lowest airfare price possible. This includes reserving flights at a minimum two weeks prior to the date of travel. If a hotel room cannot be located within published federal per diem rates, the contractor must provide proof that they have thoroughly researched not only the immediate area but also the surrounding areas for hotels within the federal per diem rates. The contractor must submit a request to exceed per diem, with justification, to the COR a minimum of two weeks before the date of travel.

The Government will allow the contractor the use of General Service Administration-leased and OR&R-owned motor vehicles in support of conducting official business for this contract, once they have satisfactorily completed the required driver’s training course (GSA National Safety Council Defensive Driving Course) online.

If accidental injury to contractor personnel should occur in connection with use of a government vehicle or rental car, the government will not be held liable for injuries or damages to the car. If any damage to lodging facilities or government equipment occurs during travel, the government will not be held liable for injuries or repair. Notification of accidental injury or vehicle damage shall be reported to the COR immediately upon occurrence.

The contractor shall submit a digital quarterly report to the COR that shows the amount of travel taken for the prior quarter and the actual amount billed to the government by person and by project and shall include cumulative totals. The contractor shall also submit a quarterly report, at the same time, to the COR that provides future (next) quarters travel estimates.

Travel will be reimbursed in accordance with FAR Part 31 and the FTR, including allowable applicable travel/G&A material handling rate, but exclusive of fee. Travel will be reimbursed that is supported by receipts and following Government regulations, within what was authorized to occur by the COR, and shall be invoiced for in the same month as travel occurred or the following month. Travel reimbursement requests will not be granted after this period without specific requests and justification provided to the COR for which COR approval is given. Individual contract staff are not allowed to pay for these travel expenses themselves and request reimbursement directly from the government. Personal travel arrangements in conjunction with government requested business travel shall not be handled by contract personnel during work hours, and no personal travel will be handled under this contract.

The maximum allowable G&A expenses on travel is 2% for the life of the task order. If the contractor objects to this value, it must identify its proposed G&A rate for travel in the quote along with documents approving the proposed G&A rate from the Defense Contract Audit Agency (DCAA). The contractor shall submit back-up documentation for all travel costs incurred upon return with respective invoice for reimbursement. These references can be found at the following urls: www.acquisition.gov/browsefar and www.gsa.gov/travel.

2. NOAA/EAD PROHIBITION ON USE OF LOCKING OR SCRAMBLING DEVICES

(a) The contractor certifies that software delivered under this contract does not and will not contain any "software locks" or hidden devices that may be used to disable software or system operations, such as data scrambling mechanisms or "drop dead" devices, whether triggered by signal, by timer, or otherwise.

(b) Nothing in this contract shall be deemed to confer a right of "electronic repossession" to the vendor in the event of a contract dispute or payment delinquency.

3. NOAA/EAD RELEASE OF INFORMATION

(a) Disclosure of information gained as a result of work performed under this contract shall be accomplished according to NOAA procedures or through NOAA channels. As used in this clause, the term "information" includes raw data, data derived there from, and analysis or interpretations thereof, regardless of form. The term includes data developed or acquired by the contractor during performance of this contract, including analysis of samples provided by the Government and samples or recordings made by the contractor during contract performance.

(b) The contractor hereby agrees not to disclose such information to the public or to unauthorized parties without the prior written approval of the Contracting Officer. This restriction does not apply to releases of information to subcontractors (including consultants) as necessary for successful performance of the contract, provided (1) such information is of no commercial value to the subcontractor, and (2) the subcontractor agrees to be bound by the restrictions in this clause.

(c) News releases pertaining to work under this contract shall not be made at any time without the written authorization of the Contracting Officer. All requests for approval shall be submitted in writing.

4. NOAA/EAD DUPLICATION AND DISCLOSURE OF CONFIDENTIAL DATA

Duplication or disclosure of the data and other information provided by NOAA or to which the contractor will have access as a result of this contract is prohibited. It is understood that throughout performance of the contract the contractor may have access to confidential data which is the sole property of the NOAA, as well as access to proprietary data which is the sole property of other than the contracting parties. The contractor hereby agrees to maintain the confidentiality of all such data to which access may be gained throughout contract performance whether title thereto vests in the NOAA or otherwise. The contractor hereby agrees not to disclose said data, any interpretations thereof, or data derivative there from, to unauthorized parties in contravention of these provisions without the prior written approval of the Contracting Officer or the party in which title thereto is wholly vested. (a) Definitions. As used in this clause-

Long-term contract means a contract of more than five years in duration, including options.

However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern-

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts-

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) If the Contractor represented its status as any of the small business concerns identified at 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, for the NAICS code assigned to an order (except that paragraphs (c)(1) through (3) of this clause do not apply to an order issued under a Federal Supply Schedule contract at subpart 8.4)-

(1) Set aside exclusively for a small business concern identified at 19.000(a)(3) that is issued under an unrestricted multiple-award contract, unless the order is issued under the reserved portion of an unrestricted multiple-award contract (e.g., an order set aside for a woman-owned small business under a multiple-award contract that is not set-aside, unless the order is issued under the reserved portion of the multiple-award contract);

(2) Issued under a multiple-award contract set aside for small businesses that is further set aside for a specific socioeconomic category that differs from the underlying multiple-award contract (e.g., an order set aside for a HUBZone small business concern under a multiple-award contract that is set aside for small businesses);

(3) Issued under the part of the multiple-award contract that is set aside for small businesses that is further set aside for a specific socioeconomic category that differs from the underlying set-aside part of the multiple-award contract (e.g., an order set aside for a WOSB concern under the part of the multiple-award contract that is partially set aside for small businesses); and

(4) When the Contracting Officer explicitly requires it for an order issued under a multiple-award contract, including for an order issued under a Federal Supply Schedule contract (see 8.405-5(b) and 19.301-2(b)(2)).

(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.

(e) The small business size standard for a Contractor providing an end item that it does not manufacture, process, or produce itself, for a contract other than a construction or service contract, is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition-

(1) Was set aside for small business and has a value above the simplified acquisition threshold;

(2) Used the HUBZone price evaluation preference regardless of dollar value, unless the Contractor waived the price evaluation preference; or

(3) Was an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.

(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraphs (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting officer in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.

(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.
