This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart

12.6 of the Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation is issued as a Request for Quotation (RFQ). The Government plans award of a firm, fixed-price contract.

The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-05 and supplemented by Department of Agriculture's (USDA) Acquisition Regulation

(AGAR 3/11/2021).

This procurement is set aside for Total Small Business. The NAICS code is 115310 Support Activities for Forestry (Fuels Management Services) and the Small Business Size Standard is $34 million.

a) One award will be made from this solicitation, contractors must submit pricing for all items.

b) Unit acreages are estimated. Payment will be based on Actual Treatment Acres determined by GPS at the discretion of the Forest Service after contractor completes the unit.

c) QUOTE AFFORDABILITY The Government estimates that the total contract value is between $525,000 and $625,000. Quoters should not interpret these ranges as representing a ceiling or a floor; rather, this information is provided as a courtesy to prospective quoters. The Government may select a quote for award with a price below, within, or exceeding this range if it finds that quote provides the best value, and funds are available.

d) Multiple quotes. You may submit multiple quotes presenting alternative approaches to getting the work done while meeting the identified specifications. Each quote submitted must be complete with full pricing and technical submissions; representations and certifications may be submitted once and referenced across all quotes from one offeror. Each quote submitted will be evaluated separately.

Description and Location of Requirement Site prep/fuels reduction project to pile existing down fuels including logs, brush, and slash, and to cut and pile dead and dying standing conifer trees by utilizing both mechanical feller buncher or excavator and hand chainsaw felling of larger diameter trees. All existing down materials and activity-generated slash Treatment conditions include forest area burned by Creek Fire in 2020, brush, standing dead conifer trees, down broken tops and boles, hung up or broken boles which have all contributed to accumulated and scattered down woody debris.

The project is located between the elevations of 4,800 and 5,800 feet on the Bass Lake Ranger District, Sierra National Forest, Madera County, California. The legal for the project is: T8S R23E Sec 10-15; T8S R24E Sec 7, 8, 17, 18. The work area is approximately 350 acres.

(d) Comptroller General Examination of Record. 452.204-70 Modification for Contract Closeout (DEVIATION JUN 2024) Upon contract closeout for contracts utilizing anything other than cost reimbursement:

(a) If unliquidated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) Upon contract closeout for contracts utilizing SAP: if unliquidated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a “Contractor Release of Claims” be completed by the contractor, although not required for contracts and orders using SAP.) If the bilateral modification and/or Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(c) Upon contract closeout for contracts utilizing anything other than cost reimbursement, if unliquidated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and a ‘‘Contractor Release of Claims’’ and will be required to provide a signature on both forms. If the bilateral modification and Release of Claims are not returned to the CO within 120 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

AGAR 452.211-74 Period of Performance (FEB 1988) The period of performance of this contract is from September 30, 2024, through September 30, 2025.

Period of performance may start earlier or later depending on date of contract award. Award will be considered “notice to proceed” and work shall begin no later than 14 days after award of contract.

It is important to note that the contract will be effectively shut down from March 1 – June 30 due to the LOP for the Pacific fisher that covers the entire project area.

There is an additional LOP from March 1 – August 31 for the California Spotted Owl that covers approximately 25% of the project area.

AGAR 452.215-73 Post Award Conference (NOV 1996) A post award conference with the successful offeror is required. It will be scheduled within 10 days after the date of contract award. The conference will be held virtually over Microsoft Teams and should be attended by an officer of the firm, or someone designated in writing to act on behalf of the firm.

AGAR 452.228-71 Insurance Coverage (NOV 1996) (Alternate I) Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract.
