About this file

This document is a Justification for Single Source Awards from the Department of Veterans Affairs for an out-of-scope modification to an existing janitorial services contract. The modification concerns the relocation of the Sebring Community Based Outpatient Clinic (CBOC) to a new facility, requiring adjusted janitorial services with different scope, square footage, and logistical requirements. The incumbent contractor will provide comprehensive janitorial services including daily cleaning and sanitization, waste removal, floor care, restroom sanitation, window cleaning, and periodic deep cleaning.

The sole source modification is being processed under FAR 6.302-1, with the justification that the current contractor is uniquely positioned to provide uninterrupted services during the transition. The VA argues that engaging a new contractor would result in service disruption, increased administrative burden, and potential non-compliance with VA cleanliness and safety standards. While market research was not conducted due to urgent service needs, the VA plans to conduct a full and open competition for janitorial services at all CBOC locations upon contract expiration, with future solicitations incorporating flexibility for location changes.

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW RFO 12.102 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($350K)

Acquisition Plan Action ID: 36C248-26-AP-1471

1. Contracting Activity: Department of Veterans Affairs, Veterans Health

Administration,Regional Procurement Office East, Network Contracting Office 08 (NCO 08) on behalf of Bay Pines VA Healthcare System located at 10,000 Bay Pines Blvd. Bay Pines, FL 33744.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This justification supports a sole source out-of-scope modification to Contract 36C24823P1803 for janitorial services at the Bay Pines VAMC Community Based Outpatient Clinics. The modification is necessary due to the relocation of the Sebring Outpatient Clinic to a new facility. The new location requires janitorial services that differ in scope, square footage, and logistical requirements from the original contract specifications.

The contractor will provide janitorial services at the new Sebring Outpatient Clinic location, including but not limited to:

• Daily cleaning and sanitization of clinical and administrative areas

• Waste removal and biohazard disposal

• Floor care (carpet and hard surface maintenance)

• Restroom sanitation

• Window and glass cleaning

• Periodic deep cleaning services

The new location has a different layout and square footage, requiring adjustments in staffing levels, equipment, and service frequency. Estimated Amount:

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This sole source modification is being processed under FAR 6.302-1 – Only one responsible source and no other supplies or services will satisfy agency requirements. The incumbent contractor is uniquely positioned to provide uninterrupted services during the transition to the new location.

Revision: 01 Effective Date: 11/15/2024 Page 2 of 2 Acquisition ID# 36C248-26-AP-1471

The relocation of the Sebring Community Based Outpatient Clinic (CBOC) was not anticipated at the time of the original contract award. The incumbent contractor, already providing janitorial services at other CBOC locations under this contract, is familiar with VA requirements, security protocols, and infection control standards.

Engaging a new contractor would likely result in service disruption, increased administrative burden, and potential non-compliance with VA cleanliness and safety standards. Additionally, the time required to solicit, evaluate, and award a new contract would delay the commencement of services at the new location, negatively impacting patient care and facility operations.

The relocation of the Sebring Community Based Outpatient Clinic (CBOC) was not anticipated at the time of contract award. To ensure uninterrupted operations, the new facility must be fully functional upon opening, with no lapse in janitorial services.

The incumbent contractor has the necessary infrastructure, staffing, and familiarity with VA protocols to support the new location immediately, ensuring continuity of service and compliance with VA standards.

4. Description of market research conducted and results or statement why it was not conducted: Market research was not conducted for this modification due to the urgent need to ensure continuity of janitorial services at the new Sebring location. A competitive procurement for future services will be considered once the current contract period ends. The VA will conduct a full and open competition for janitorial services at all CBOC locations, including the new Sebring site, upon expiration of the current contract. Future solicitations will incorporate flexibility for location changes.

5. Contracting Officer's Certification: Purchase is approved in accordance with

FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
