About this file
This document is a Department of Navy (DON) Single Source justification memorandum for a sole-source internet services acquisition from Charter Communications Operating LLC. The contract will provide 1 GB high-speed business internet services with WiFi and VPN access for multiple military locations in North Carolina, including Camp Lejeune, Cherry Point, and New River, covering nine specific addresses. The base period is 12 months with an option to extend for an additional 12 months, with a total potential performance period from 30 September 2025 to 29 September 2027.
The justification for single-source procurement is based on Charter Communications' existing internet infrastructure at these locations. Continuing services with the current provider will prevent costly and disruptive measures such as property surveying, digging, and installing new wired connections. The memorandum notes that similar services with comparable bandwidth and connectivity are not available within the local areas of these military installations, further supporting the sole-source selection under FAR guidelines for simplified acquisition procedures.

DON SAP SINGLE SOURCE
AUG 2018
Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN
ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
Provide Charter Communications Operating LLC internet services for Camp Lejeune, Cherry Point, and New River in North Carolina for a base period of 12-months and provide the option to extend services for an additional 12-month option period, in accordance with FAR 52.217-9. The period of performance will be 30 September 2025 – 29 September 2027, if all options are exercised. The contractor will provide GB high-speed business internet services that will include wired connection and remote access tunnel (VPN) to the Navy enterprise network.
1 GB High Speed Internet with WiFi at the following locations:
1121a Hammond Rd, MCB Camp Lejeune, NC 1121b Hammond Rd, MCB Camp Lejeune, NC 1121c Hammond Rd, MCB Camp Lejeune, NC AS-218 Bancroft St, MCAS New River, NC 779 Roosevelt Blvd, MCAS Cherry Point, NC 765 Roosevelt Blvd, MCAS Cherry Point, NC 1250 BC Birch Street, Building 1107-A, Camp Lejeune, NC
1107 Michael Rd, MCB Camp Lejeune, NC
720 Roosevelt Rd, Bldg 87, MCAS Cherry Point, NC
III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING:
A. _X__ ONLY ONE RESPONSIBLE SOURCE (select all that apply):
DON SAP SINGLE SOURCE
AUG 2018
1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
[Explain what rights are restricted, why the restrictive rights make the required item or service available from only one source, and why another company could not satisfy the Government’s need.]
2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. _X__ OTHER REASONS. Charter Communications Operating LLC internet services are presently available at OICC Florence Camp Lejeune, Cherry Point, and New River locations in North Carolina. The continuation of services from the current provider will prevent cost prohibitive measures that would include surveying property as well as digging and installing new wired internet connections. This will duplicate the internet service already in place and disrupt mission critical functions at each location required to provide its services to its customers. Additionally, similar services with the bandwidth and connectivity are not available within the local areas of these locations.
B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.
C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
1. Date on which the requirement was first identified:
2. Required delivery date/period of performance:
3. Explanation of why delivery/commencement of services by the date mentioned above is required:
4. If appropriate, include any additional pertinent information.
