About this file

This is Executive Order 2019-12D issued by Ohio Governor Mike DeWine governing the expenditure of public funds for offshore services. The order prohibits all State Cabinet Agencies, Boards and Commissions from entering into contracts that use funds to purchase services provided outside the United States, including both direct purchases and services provided by subcontractors. The order requires agency procurement officers to include standard language in all contracts reflecting this prohibition and requiring service providers to affirm compliance, disclose service locations, data storage locations, and principal business locations. The order was signed March 4, 2019 and remains in effect until ten days after the end of DeWine's governorship unless rescinded earlier.

The order includes several exemptions, including services necessary to attract jobs and business to Ohio, academic and educational services supporting international missions of Ohio public colleges and universities, and situations deemed emergencies by the Director of Administrative Services. The Department of Administrative Services' Chief Procurement Officer must maintain procedures ensuring compliance, including confirmation that all proposals include required affirmations and disclosures. Any proposals lacking these requirements or proposing offshore services will not be considered. The order also requires procurement manuals to reflect these requirements and mandates adequate training for agency procurement officers.
