About this file

This is Amendment 0002 to Solicitation 19PE5026R0002, issued by the American Embassy Lima (Contracting Office PE500) for facility renovation work at the embassy in Peru. The amendment replaces Section K (Evaluation Factors for Award) in its entirety, changing the evaluation methodology from Lowest Price Technically Acceptable (LPTA) to Best Value Tradeoff in accordance with FAR 15.101-1. The proposal submission deadline has been extended from Tuesday, June 23, 2026 at 08:00 a.m. Lima time to Friday, June 26, 2026 at 12:00 p.m. (noon) Lima time, with all other submission requirements remaining unchanged.

The solicitation seeks renovation services for the American Embassy Lima facility, including bathroom renovations (demolition, plumbing, tile work, fixtures), roofing replacements and waterproofing, and metal structure maintenance and painting. The Government will award a single Firm-Fixed-Price (FFP) contract to the offeror providing best overall value, considering both non-price and price factors. Evaluation factors in descending order of importance are: (1) Technical Approach & Compliance, (2) Key Personnel Qualifications & Experience, (3) Past Performance, and (4) Price. The non-price factors combined are significantly more important than price, though price importance increases as proposals become more equal in non-price factors. Key personnel requirements include a Civil Engineer and Electrical Engineer holding valid Peruvian licensure (CIP), site supervisor with English-speaking capability, Safety Officer/QC Manager, and Project Manager. The contractor must be legally incorporated in Peru and in existence for at least one year. Price evaluation will assess reasonableness, completeness, balance across 13 Contract Line Items (CLINs 0001-0013), and realism, with specific consideration given to complex scope items including Men's Passenger Restrooms (CLIN 0002), Passenger Hall (CLIN 0007), VIP Lounge roofing at 6.50 meters height (CLIN 0008), and Professional Supervision costs reflecting two CIP-licensed engineers over a 120-calendar-day period of performance (CLIN 0011). The contractor must also provide accurate Value Added Tax (VAT/IGV) calculations per Peruvian tax law requirements.

PURPOSE

This amendment modifies Solicitation 19PE5026R0002 to replace Section K — Evaluation Factors for Award in its entirety. The evaluation methodology is changed from Lowest Price Technically Acceptable (LPTA) to Best Value Tradeoff in accordance with FAR 15.101-1. SECTION K-EVALUATION FACTORS FOR AWARD (Pages 113 through 115)

Is replaced in its entirety with the following:

SECTION K — EVALUATION FACTORS FOR AWARD

K.1 BASIS FOR AWARD – BEST VALUE TRADEOFF

Government intends to award single Firm-Fixed-Price (FFP) contract resulting from this solicitation using Best Value Tradeoff process in accordance with FAR 15.101-1. Award will be made to offeror whose proposal represents best overall value to Government, considering both non-price factors and price.

Government may award contract to other than lowest-priced offeror or other than highest technically rated offeror if Contracting Officer determines that tradeoff is in Government's best interest.

Government reserves right to award without discussions, but may conduct discussions if deemed necessary.

K.2 EVALUATION FACTORS – ORDER OF IMPORTANCE

Proposals will be evaluated based on following factors, listed in descending order of importance:

1. Factor 1 – Technical Approach & Compliance

2. Factor 2 – Key Personnel Qualifications & Experience

3. Factor 3 – Past Performance

4. Factor 4 – Price

Technical, Personnel, and Past Performance — when combined — are significantly more important than Price. However, as proposals become more equal in non-price factors, Price becomes more important.

K.3 FACTOR 1 – TECHNICAL APPROACH & COMPLIANCE

Government will evaluate extent to which proposal demonstrates clear, compliant, and technically sound approach to completing project requirements described in Section B. Areas of consideration include:

1. Understanding of Scope of Work, including:

o Bathroom renovations (demolition, plumbing, tile work, fixtures) o Roofing replacements and waterproofing o Metal structure maintenance and painting o Coordination requirements for occupied facility

2. Compliance with codes and standards, including:

o Peru's National Building Code and Electrical Code o NFPA 70 – NEC 2023 o Peruvian Occupational Safety regulations o TCNA Handbook or equivalent for tile work

3. Work plan and phasing approach, including:

o Feasibility of minimizing disruption to INL operations o Bathroom phasing to maintain adequate facilities o VIP lounge protection measures o Coordination with ongoing operations

4. QA/QC approach, including:

o Inspection milestones o Testing methodology (hydraulic testing, leak testing) o Tile work quality standards per Section B.16 o Waterproofing verification

5. Safety planning, including:

o Hazard analysis (Activity Hazard Analyses per DOSAR 652.236-70) o Fall protection for elevated work (VIP Lounge at 6.50 m; Passenger Hall roofing) o Chemical safety (paints, adhesives, solvents) o Personnel protection and PPE

6. Schedule realism and identification of major milestones by CLIN, consistent with the 120-calendar-day period of performance

7. Understanding of specific technical requirements outlined in Section B.4, including:

o Plumbing system specifications o Tile work standards o Coastal/saline environment considerations o Material specifications (brands, types, finishes)

8. Material sourcing and quality, including:

o Approach to meeting "similar to" specifications in Section B.4 o Quality assurance for materials

Note: Proposals that merely restate the SOW without demonstrating understanding will be rated lower.

Adjectival Ratings: Outstanding | Good | Acceptable | Marginal | Unacceptable

K.4 FACTOR 2 – KEY PERSONNEL QUALIFICATIONS & EXPERIENCE

Government will evaluate extent to which proposed personnel demonstrate:

1. Civil Engineer holding valid Peruvian licensure (colegiado y habilitado – CIP) and experience with:

o Building renovation projects o Tile and finish work o Structural assessments

2. Electrical Engineer holding valid Peruvian licensure (colegiado y habilitado – CIP) and experience with:

o Electrical system installations o Code compliance (NFPA 70 / NEC 2023; Peruvian Electrical Code)

3. Site Supervisor experience on comparable renovation/construction projects, including English-speaking capability per Section G.21.3

4. Safety Officer / QC Manager qualifications relevant to construction work, including high-risk activities per DOSAR 652.236-70

5. Project Manager experience managing projects of similar size and complexity

Resumes demonstrating experience with:

· Occupied facility renovations

· Coastal/saline-environment construction

· Multi-trade coordination

· Government/military facility work

Note: Key Personnel changes after award require CO approval per Section G.11.

Adjectival Ratings: Outstanding | Good | Acceptable | Marginal | Unacceptable

K.5 FACTOR 3 – PAST PERFORMANCE

Government will evaluate offeror's recent (within past 5 years) performance on projects of similar size and complexity. Evaluation will consider:

· Quality of work (particularly tile work, plumbing, painting)

· Compliance with safety standards

· Adherence to schedules

· Management of subcontractors

· Customer satisfaction

· Successful completion and documentation

· Performance in occupied facilities

· Experience with government contracts or military contracts

Information may be obtained from any source, including CPARS, agency records, or references.

Offerors with no relevant past performance will receive a "Neutral" rating — neither favorable nor unfavorable.

Ratings: Substantial Confidence | Satisfactory Confidence | Neutral | Limited Confidence | No Confidence

K.6 FACTOR 4 – PRICE

K.6.1 Price Evaluation Approach

Price will be evaluated for:

· Reasonableness – Overall price and individual CLIN prices will be assessed against Government estimates, market research, and industry standards

· Completeness – Proposal must include pricing for all CLINs 0001-0012

· Balanced pricing across CLINs

· Consistency with technical approach

· Realism – Prices that are significantly high or low may indicate performance risk

Government may use price analysis techniques in FAR 15.404 to determine reasonableness.

K.6.2 CLIN Structure Evaluation

The Government will evaluate individual CLIN pricing for:

1. Internal Consistency:

o Does CLIN 0002 (Men's Passenger Restrooms) pricing reflect the extensive scope including demolition, complete plumbing, tile work, granite countertops, fixtures, partitions, and electrical?

o Does CLIN 0008 (VIP Lounge) reflect the complexity of roofing work at height (6.50 m), waterproofing requirements, and floor protection?

o Does CLIN 0007 (Passenger Hall) include pedestrian walkway fabrication and installation?

o Are material-intensive CLINs (tile work, fixtures, roofing) priced appropriately?

2. Balance and Realism:

o Front-loaded pricing may indicate cash flow concerns o Back-loaded pricing may indicate underestimation of early work o Unbalanced pricing in any CLIN may be evaluated unfavorably

3. Material vs. Labor Allocation:

o Material-intensive CLINs (tile, fixtures, roofing) should reflect appropriate material costs o Labor-intensive CLINs (demolition, painting, installation) should reflect appropriate labor rates and hours

4. Risk Assessment:

o Unusually low pricing in critical CLINs may indicate misunderstanding of requirements, inadequate QC, use of non-compliant materials, or unacceptable performance risk

Specific CLIN Considerations:

• CLIN 0002 (Men's Passenger Restrooms): Most complex scope — should represent a significant portion of total price

• CLIN 0007 (Passenger Hall): Includes roofing replacement, pedestrian walkway fabrication, and metal structure work at height

• CLIN 0008 (VIP Lounge): Work at 6.50 m height, waterproofing challenges, floor protection, extensive painting

• CLIN 0011 (Professional Supervision): Must reflect cost of two CIP-licensed engineers throughout the 120-day period of performance

K.6.3 Value Added Tax (CLIN 0013)

· Accuracy: VAT calculation must be correct based on current Peruvian tax law (typically 18% IGV - Impuesto General a las Ventas)

· Compliance: Offeror must demonstrate understanding of Peruvian VAT requirements

· Documentation: Offerors must commit to the issuance of facturas (tax invoices) in compliance with SUNAT requirements.

Incorrect VAT calculations or failure to provide required tax documentation may result in invoice rejection and payment delays.

K.6.4 Price Evaluation Methodology

1. Completeness Check: Verify all CLINs 0001–0013 are priced

2. Arithmetic Verification: Verify calculations and totals

3. Reasonableness Analysis: Compare total base price (CLINs 0001–0012) against IGE, market research, and other offerors' prices (if available)

4. Balance Analysis: Evaluate individual CLIN pricing for balance and realism

5. Risk Assessment: Identify pricing that may indicate performance risk

6. VAT Verification: Verify CLIN 0013 calculation accuracy

K.6.5 Price Realism Concerns

• Total base price significantly above IGE may indicate inefficiency or misunderstanding of scope

• Total base price significantly below IGE may indicate failure to understand scope, inadequate QC, use of non-compliant materials, or unacceptable performance risk

• The Government reserves the right to request price justification or supporting cost data for any CLIN that appears unreasonable, unbalanced, or presents performance risk

K.6.6 Price vs. Non-Price Tradeoff

As stated in K.2, Technical, Personnel, and Past Performance factors — when combined — are significantly more important than Price. However:

• A lower-priced, technically acceptable proposal may be selected over a higher-priced, higher-rated proposal if the price premium is not justified by technical superiority

• A higher-priced proposal may be selected if its technical approach, personnel qualifications, or past performance demonstrate significantly lower risk or higher value

• Unbalanced or unrealistic pricing may reduce the Government's confidence in the offeror's technical approach, even if the technical proposal appears acceptable

K.6.7 Price Proposal Requirements

Offerors shall submit price proposals that include:

1. CLIN Pricing Table: Complete pricing for CLINs 0001–0013 using the format in Section A

2. Basis of Estimate: Brief narrative explaining the basis for each CLIN price, including:

o Material quantities and unit costs o Labor hours and rates by trade/skill level o Equipment costs o Overhead and profit percentages o Any assumptions made

3. VAT: Calculation methodology and documentation approach for CLIN 0013

4. Material Specifications: Confirmation that pricing is based on materials meeting Section B.4 specifications (e.g., Trebol/Vainsa fixtures, Philips lighting, specified tile types)

5. Subcontractor Pricing: If applicable, identify which CLINs include subcontractor work and percentage of subcontracted effort

Failure to provide adequate price justification may result in a determination that the price is unrealistic or unbalanced.

K.7 BEST VALUE TRADEOFF

The Government reserves the right to make tradeoffs between price and non-price factors. A higher-priced offer may be selected if its technical superiority or lower performance risk justifies the cost. Conversely, a lower-priced, lower-rated offer may be selected if the price premium of the higher-rated offer is not justified.

K.8 RESPONSIBILITY DETERMINATION

In addition to evaluation under this section, the prospective awardee must be found responsible under FAR Part 9.104, including but not limited to:

• Adequate financial resources

• Ability to meet schedule requirements

• Satisfactory performance record

• Proper licensing (including CIP licensure for professional supervision per Section B.6(d))

• Company must be legally incorporated in Peru and have been in existence for at least one year (to ensure warranty support per Section B.20.2)

• Absence of exclusions or debarment (SAM.gov verification)

Failure to meet these requirements may result in the offeror being eliminated from award consideration.

K.9 NOTICE OF AWARD WITHOUT DISCUSSIONS

The Government may award without discussions. Offerors are encouraged to submit their best terms in the initial proposal, including technical approach, price, and all required certifications.

Once the government identifies the contractor that is best-suited—also referred to as the apparent successful contractor—the government may communicate solely with that contractor to resolve any remaining issues. These issues may include technical matters and pricing. This final exchange supports completing all requirements necessary to finalize the contract award or task order award with that contractor.
