SECTION M

EVALUATION FACTORS FOR AWARD

A. INTRODUCTION

1. This acquisition will utilize a strategy of multiple awards to the technically qualified

“Approved Source” offeror(s). This acquisition shall use price, and compliance to the terms of the solicitation, as the only evaluated factors. Price will be evaluated at this time for fairness and reasonableness IAW FAR Case 2017-010 Final Rule, because there is a scenario in the ordering procedures that could result in one contractor receiving a task order award without competition.

2. The government intends to award the requirement(s) represented in this solicitation to multiple awardees. However, the Government reserves the right to award one contract or no contract at all.

B. EVALUATION FACTORS AND PROCEDURES:

1. The government shall evaluate proposals based on the evaluation factor below.

a. Factor 1 – Price

i. Evaluation Base: Standard Form 33

ii. The Offeror’s price will be evaluated based upon unit prices and Total Evaluated

Price (TEP). The Offeror’s Proposal will be evaluated for the criteria of Price Reasonableness and Balance.

a) Price Reasonableness: The proposed price will be evaluated for Price Reasonableness. For a price to be reasonable, it will represent a price to the Government that a prudent person would pay when consideration is given to prices in the market.

Normally, price reasonableness is established through adequate price competition, but may also be determined through cost and price analysis techniques as described in FAR 15.404. For additional information see FAR 31.201-3.

b) Balance: The Government may also determine a proposal unacceptable should the proposed prices be unbalanced.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more items/Contract Line Item Numbers (CLINS) is significantly overstated or understated as indicated by the application of price analysis techniques as those defined by FAR 15.404-1.

c) Total Evaluated Price (TEP): A TEP will be calculated to be used for evaluation of offers to determine the three lowest priced proposal. The TEP calculation will be a summation of all Contract Line Item Pricing.

a. In addition to meeting Factor 1, the government expects all offerors to meet all solicitation requirements, to include terms and conditions, representations and certifications, and required delivery schedules. Any exceptions taken or changes made to the solicitation may result in the offeror being deemed unqualified for award. Please submit all exceptions or requested changes to the PCO prior to RFP submission.

b. Furthermore, all Offeror’s shall be identified as an approved source in the Government’s Screen Analysis Worksheet Form 762.

c. Offerors not identified on the Form 762 are encouraged to contact the aforementioned government representative to obtain technical pre-qualification information. However, per FAR 9.202(e), the government reserves the right to not to delay contract award in order to provide a potential offeror with an opportunity to demonstrate its ability to meet the standards.

3. The process for the evaluation and contractor responsibility determination of proposals is as follows:

a. Contract award will be made to the offeror(s) that are listed as approved sources and submit a proposal with fair and balanced pricing. Up to three awards may be made against this solicitation. In the event that there are more than three proposals, the three offerors with the lowest Total Evaluated Price will receive the awards.

b. Past Performance record and history will be assessed as one of the multiple standards required for a successful offeror to be determined responsible as described in FAR 9.104.

Contractors shall meet the required delivery dates, as well as the terms and conditions in this solicitation, to be determined responsible.
