SECTION G

CONTRACT ADMINISTRATION DATA

G. 9 TASK ORDERS

This is an Indefinite Delivery, Indefinite Quantity (IDIQ) contact under which the Contractor shall provide services within the scope of the IDIQ Statement of Work (SOW) as ordered by the Contracting Officer through the issuance of individual Task Orders.

Task Orders are individual contract actions to perform work within the scope and structure of this IDIQ contract. Task Orders will vary in size and complexity. Task Orders will be issued with a specific scope of work.

1. Ordering Procedures Task Orders shall be issued in accordance with FAR Subpart 16.505, Ordering. The Contracting Officer shall award firm-fixed-price Task Orders to perform work within the scope of this contract.

2. Fair Opportunity The competition requirements in FAR Part 6 and the policies in FAR Subpart 15.3 do not apply to the ordering process; however, the Contracting Officer shall give every Contractor fair opportunity to be considered for award of any Task Order expected to exceed $2,500 unless one of the statutory exceptions detailed in FAR Subpart 16.505 (b)(2) applies.

Per FAR Subpart 16.505 (b)(2) (i) “The contracting officer shall give every awardee a fair opportunity to be considered for a delivery order or task order exceeding the micro-purchase threshold unless one of the following statutory exceptions applies:

(A) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

(B) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

(C) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

(D) It is necessary to place an order to satisfy a minimum guarantee.

(E) For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

(F) In accordance with section 1331 of Public Law 111-240 ( 15 U.S.C. 644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3). When setting aside orders for small business concerns, the specific small business program eligibility requirements identified in part 19 apply.

Per FAR Subpart 16.505 (b)(2)(ii)(A) “Orders exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold. The contracting officer shall document the basis for using an exception to the fair opportunity process. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value).

The determination of the best qualified firm on a Task Order basis can be based on factors such as the evaluation of individual components of the original proposal and/or prior work on a related task/project. The Contracting Officer shall document the rationale applicable for each case of such Task order award.

3. Request for Proposal A Request for Proposal (RFP) will be distributed to all Contractors and will contain, to the maximum extent practicable:

1. The delivery and/or performance requirements specific to that order in the form of either a Statement of Work (SOW), Performance Work Statement (PWS) or a Statement of Objectives (SOO).

2. Scheduled site visit information including the date, time, and location (if applicable).

3. A reasonable response period.

4. Disclosure of the significant factors and sub-factorsthat the agency expects to consider in evaluating proposals, and their relative importance.

5. If a safety checklist is needed it will be requested on individual Task orders.

4. Pricing Contractors will be required to include a price volume with their proposal that consist of itemized pricing as required by the Contracting Officer. Any amounts claimed for subcontracts shall be supported by a similar price breakdown. Price proposals for each task order will be evaluated to determine price fairness and reasonableness. No fee or profit will be paid on any reimbursements for travel and/or per diems. No separate fee and/or profit will be paid to Contractor for managing the subcontractors or lower tier subcontractors.

5. Task Order Evaluation and Source Selection Contractors competing for Task Orders will be evaluated based on the evaluation criteria established within each individual Task Order RFP along with the source selection procedures.

Cost will not be a factor in evaluating the Offerors in accord with the Brooks Act, but will be evaluated and may be discussed and negotiated for prior to award for reasonableness.

In accordance with FAR 36.606 (f) If a mutually satisfactory contract cannot be negotiated, the contracting officer shall obtain a written final proposal revision from the firm, and notify the firm that negotiations have been terminated. The contracting officer shall then initiate negotiations with the next firm on the final selection list. This procedure shall be continued until a mutually satisfactory contract has been negotiated.

If negotiations fail with all selected firms, the contracting officer shall refer the matter to the selection authority who, after consulting with the contracting officer as to why a contract cannot be negotiated, may direct the evaluation board to recommend additional firms in accordance with 36.602.

6. Urgent Orders For requirements the Government identifies as either “URGENT”, the Contractor may be required to submit a proposal within ten (10) days or less from receipt of the RFP.
