Follow up Questions Regarding SEC Litigation Support Services and Electronic Discovery
1. In the answer to question 14, the SEC stated that the NTE pricing [for CLINS 0003, 0004 and 0005] will be included in an amendment to Section B. However, the amended Section B did not include these amounts. Please clarify. $100,000, $100,000, and $5,000, respectively, each year.
2. In the answer to to Question 18, the RFP was revised. The revised Section C.2.1 states “Other separate contracts provide “Data Copy” and “Data Load” services”, Are these other contracts performing the same work in Tasks 2 and 4? If so, what are the rules for assigning work between contractors performing the same task? The division of work among contractors under this multiple award contract will be determined by task order statements of work.
3. In the answer to question 70, the SEC confirms the difference between the forensic positions listed in Attachment 17 (i.e., Computer Forensics Technician and Computer Forensics Specialist) and the position identified in Attachment 11 (i.e., Forensics Technician), which refers to the offsite forensic acquisition specialists. Can the SEC add this “offsite forensic acquisition specialist” position to Attachments 14 and 17 since its requirements differ from the Computer Forensics Specialist position currently listed and to accommodate a different rate for the in-field collections? No, the skills are sufficiently similar that a separate labor category is not required.
4. Please clarify the answers to questions 92 and 93. Is the requirement to identify one SME and one Key position across both tasks 3 and 4 (two total), or a separate SME and Key staff each for task 3 and task 4 (four total)? The requirement is to identify at least two key personnel. Note that L.6.a also states, “The Offeror shall specify any additional positions which are to be considered key personnel.”
5. The revised RFP, page 32 has a line added “The Contractor shall provide litigation support assistance at the SEC Headquarters and Regional Offices. This work includes support for the SEC Trial Units.” Will additional staff be required to support this requirement, and if so at what level? The number and location of contractor staff required for litigation support assistance will be specified in task order statements of work.
