About this file

This is a Bid Bond template document issued by the State of Colorado Office of the State Architect, State Buildings Program, for use in state construction projects. The bid bond serves as a proposal guaranty required as a condition of bid submission. Bidders must submit the bid bond with their proposal and maintain their proposal in full force and effect for thirty (30) days after proposal opening. If a bidder's proposal is accepted, the bidder must execute the required agreement, furnish performance bond, labor and material payment bond, insurance policy, and certificates of insurance within the prescribed timeframe. Failure to meet these obligations renders the bid bond subject to forfeiture as liquidated damages.

The bid bond amount is set at five percent (5%) of the principal's total bid price, payable to the State of Colorado. The bond must be executed by a surety corporation authorized to conduct business in Colorado and accompanied by a properly executed power of attorney, effectively dated. Corporate bidders must have the bond signed by an officer such as president or vice president, with the signature attested by the secretary and sealed with the corporate seal. Individual or partnership bidders must execute the bond according to their respective business structure. Failure to provide a properly executed bid bond with a properly executed power of attorney will result in the bidder's proposal being deemed non-responsive.
