Q: We'd like to know if it's possible to bid as 8(a), if the prime is small business and the subcontractor is 8(a) firm. Can the contractor bid both as a small business and 8(a) or just limited to small business? Or would the two companies need to create a joint venture for the team to be considered as both.
If a company is bidding as part of a JV, then the JV must meet the qualifications for under which classification they are bidding.
Offerors are allowed to bid as a member of a JV and as a sole-bidder. Offerors will not, however, be allowed to be a member of a JV and be a sole-bidder and bid in the same classification.
Q: The solicitation talks about different types of JV Agreements and their requirement as well as percentages on sheet 8 and 9. I have spoken with my SBA Advisor and he stated that the JV agreements take several months to execute and process. He has stated that we use a teaming agreement and if needed after award, this is something he can process. However he stated teaming agreements have the same use and function as a JV Agreement. Can we use a teaming agreement instead of a JV Agreement?
Yes, teaming is allowed.
Q: Your Notice of Solicitation describes the technical requirements for Phase I – Pre-Qualification of Offerors and paragraph 1B.4 lists the requirements for the Past Performance Questionnaire. In March 2011 we submitted a proposal (under the name AMSS/Chinn Ridge Joint Venture) to you in response to solicitation number SAQMMA11R0103. As part of that proposal process, we sent out questionnaires to several of our recent clients. Of course we have no idea if any of the completed questionnaires came back to you.
Can you find out if any of those did come back, and if so, which ones and will you accept them as applicable to this current proposal?
OK – Check and see we will accept Q: Your Notice of Solicitation of Submissions for Contractor Pre-Qualification lists the requirements for Phase I and Phase II proposals. Our understanding is that Phase 1 needs to be received by February 23. After that, the contractors that become pre-qualified will begin Phase II.
In the notice itself, after the section detailing Factor 2 of Phase I, the next paragraph covers Phase II. After that, there is a discussion on Mandatory Pre-Qualification Requirements, including the Omnibus Act and Security requirements. This seems to imply that the Omnibus Act and Security requirements should be included in Phase II. However, the Omnibus Act requirements are also included in Phase I, para 1A.3, but there is no mention of the Security requirements there.
Please confirm that the Omnibus Act Certifications should be included in Phase I, and please clarify where we are to include our Security information.
Mandatory Pre-Qualification Requirements is a number section of the announcement, not a subparagraph under phase II. Provide the completed pamphlet "Certifications Relevant to Public Law 99-399, Statement of Qualifications for Purpose of Section 402 of The Omnibus Diplomatic Security and Antiterrorism Act of 1986" with you submission on February 23, 2012.
Q: Security requirements noted in section 4 of the solicitation indicate DOS will allow 90 days to obtain an interim secret facility clearance. How does this timeline compare with past and recent similar actions? What might a company do to accelerate this process in order to ensure success within the desired window?
Some get the clearance in considerably less than 90 day and others do not. It all depends on what is uncovered during the investigations and if the firm Complies with the submission and documentation requirements and cooperates with the Defense Security Service.
Q: The solicitation lists a wide variety of services and expertise, and also divides activities into design tasks and construction tasks. Few small businesses are capable or experienced in every one of these services as well as in both design tasks and construction tasks. While the solicitation envisions significant small business awards, it seems to set a very high bar for qualification with:
1. "Offerors...must meet the requirements of each of the criteria fully."
1. "This section is intended to evaluate the technical project experience of the Offeror and is not intended to evaluate subcontractor technical project experience. Do not submit technical project experience for any proposed subcontractors."
1. "Submit five examples of projects, either on-going or completed within the past five years, demonstrating the Offeror’s technical capabilities to perform the types of projects described."
Taken together, these statements indicate that small businesses will qualify only if their employees - without any subcontractors or partners - have performed all of the design and all of construction tasks on past projects. This is a high bar indeed, perhaps not just for small businesses.
Will the government, instead, consider offerors with experience in only a subset of the needed services?
The qualified FIRMs will be determined based on the FIRM’s ability to show that the FIRM has performed construction and design build projects as stated – not a person – not a subcontractor. The FIRM does not have to have all of the required design and construction disciplines and capabilities in house, but the FIRM submitting the qualification package must be the prime contractor for the cited projects.
Q: Can the Design Firm submit an IDIQ as one of their projects on their SF 330?
No, an IDIQ is an Indefinite Delivery Indefinite Quantity CONTRACT not a project.
Q: What is the definition of Substantially complete?
Do you represent a construction firm!? Substantial Completion” means the stage in the progress of the work as determined and certified by the Contracting Officer or Contracting Officer’s Representative in writing to the Contractor, on which the work or a portion thereof designated by the Government is sufficiently complete and satisfactory, in accordance with the requirements of the Contract Documents, that it may be occupied or utilized for the purpose for which it is intended, and only minor items such as touch-up, adjustments, and minor replacements or installations remain to be completed or corrected which (1) do not interfere with the intended occupancy or utilization of the work, and (2) can be completed or corrected within the time period required for final completion.
Q: What is the evaluation criteria for size of the projects for large businesses?
The projects size that the announcement indicates large businesses may participate in!
Q: Are OCONUS projects required to show relevancy?
Projects - I do not see anything in the announcement about location.
Q: We are a medium sized architectural firm with an interest in pursuing work with OBO. However, the solicitation implies that a general contractor should be the prime for the IDIQ contracts. Can you provide a list of general contractors who are currently under contract for similar work? Alternatively, would a submission that includes only design disciplines be considered ?
See attached Q: We are SBA Certified 8(a) Firm and would like to submit response to the subject solicitation. We are Team up with a US Firm with a formal teaming agreement, who performs mostly Mechanical and Electrical work. They self perform all Mechanical and Electrical work in house, which will allow us to meet US Code Section 4852 requirement of 50% subcontracting limit for the project. Also, we would like to use their project experience in our proposal. Will this be acceptable to State Department?
The qualified FIRMs will be determined based on the FIRM’s ability to show that the FIRM has performed construction and design build projects as stated – not a person – not a subcontractor. The FIRM does not have to have all of the required design and construction disciplines and capabilities in house, but the FIRM submitting the qualification package must be the prime contractor for the cited projects.
