1. Section C, Paragraph C.5.7.2 Relief Guards: Ratio – Will post specify the ratio of relievers for comfort and meal breaks to posts in the interest of ensuring that all bidders cost the required minimum ratio into their staffing equations?

Answer: See Q&A #2 answer #6.a.

2. Who does the State Department recommend for the Defense Base Act Insurance?

Answer: Continental Insurance Company. Guidance for planning purposes is found in DOSAR 652.228-71 Worker’s Compensation Insurance (Defense Base Act) – Services (JUN 2006).

Volume 2 – Technical

1. Section H, Paragraph H.5 Personnel Requirements – Please clarify whether or not continuous employment for 36 months is a requirement.

Answer: See Q&A #2 answer #14.

2. Section L, Paragraph L.11.2.1.6 Property Management System - What is the name of the federal property manager? What is his/her address, telephone number and e-mail address?

Answer: This is for Offerors to identify. This question from the solicitation is intended for the Offeror to provide the name of the cognizant federal property manager of the federal agency that provides the most US property to Offeror’s federal contracts.

3. Joint Venture:

a. To qualify as a joint venture company, is it a requirement that the joint venture be established as a separate legal entity or is a written agreement between the parties sufficient?

Answer: A written agreement between the parties is sufficient.

b. If the successful bidder is a JV and the award to the JV was based on the relative merits of each JV partner, will the subsequent dissolution of the JV during the term of the contract have any implications in regard to the continuation of the contract awarded to the JV.

Answer: Yes, the USG must ensure continuity of operations. Offeror must stipulate how to handle the dissolution of Offeror’s joint venture as a part of Offeror’s Contingency Plan in the proposal as required under L.11.2.1.4. The Contingency Plan becomes incorporated into the awarded contract and thus binding.

4. If a curfew is imposed, will the U.S. Embassy negotiate exemption for Contractor vehicles? If an exemption cannot be obtained, will the U.S. Embassy consider this as a force majeure situation?
