About this file

This is a Concession Agreement template between the State of Wisconsin Department of Natural Resources (DNR) and a concessionaire for operating food services and retail operations at Yellowstone Lake State Park, governed by Wisconsin Statute 27.01(2)(f). The DNR seeks proposals from for-profit or non-profit organizations to operate a concession facility providing food services, a restaurant, camp store items, ice cream, coffee, and baked goods. The facility, owned by the Department, has been vacant for over one year following the departure of the previous operator, Lafayette Dairy Sales, Inc. Services explicitly excluded from this solicitation include boat rentals, bait sales, and firewood, which are currently provided by Friends of Yellowstone Lake. An on-site vendor conference will be held on May 18, 2026 at 11:00 AM, with written questions due by May 21, 2026, and proposals due May 29, 2026 at 2:00 PM. The agreement term runs from the date of execution through December 31 of the specified year, with renewal options available at the Department's discretion if the concessionaire provides written notice of renewal intent at least 60 days before termination.

The concessionaire shall pay a percentage of gross annual revenues to the Department, with the specific percentage to be determined in the final agreement. The concessionaire is responsible for all interior maintenance, utilities (except water and sanitary sewer provided by the Department), employee uniforms, inventory management, and competitive pricing aligned with local markets. The concessionaire must maintain public liability insurance of $1,000,000 per occurrence and comply with all state and local health, safety, and sales regulations. Capital improvements and furniture, fixtures, and equipment purchased from capital account funds become Department property and cannot be removed. The Department retains the right to use the facility for special events and may terminate the agreement with 30 days' written notice if terms are not met, or immediately if the Department deems management unsatisfactory. The concessionaire must submit annual financial reports within 90 days after January 1st and conduct customer satisfaction surveys annually.
