About this file
This Invitation for Bid (IFB) document is issued by the California Department of Parks and Recreation (DPR), San Diego Coast District for the procurement of a floating trash boom system to replace the existing Upper Trash Boom located in the Goat Canyon Sediment Basins at Border Field State Park. The project requires bidders to provide all labor and materials to produce and deliver a floating trash barrier designed to capture floating trash and debris in high-velocity, flash flood, and ephemeral water riverine environments. The trash boom must be modular, with individual units replaceable without dismantling the entire system, and capable of extending up to 300 linear feet within the active channel with additional cable or chain extending to existing anchors on the banks. Technical specifications mandate that the boom float and resist submergence, rotation, and embedding in mud; include lateral gaps between modular units no greater than one foot; extend a minimum of four feet above the water surface; and meet durability, sustainability, and corrosion protection requirements. No specific response deadline or award date is provided in this document.
Bidders must submit completed responses including the Agreement Cover Letter, Technical Specifications acknowledgment, Cost Worksheet, and all required administrative documentation and certifications. The State has available funding of $329,581 for this procurement and intends to purchase the greatest length of trash boom possible within this budget constraint. All products must comply with Build America, Buy American (BABA) requirements under the Infrastructure Investment and Jobs Act, with all iron, steel, manufactured products, and construction materials produced in the United States. Plastic components must be composed of a minimum of 50% post-consumer use and/or recycled materials. The contractor must provide six hours of training for up to six DPR employees and contractors within one month of delivery, covering system deployment, maintenance, and care. Responses should be submitted to Caitlin Meng, DPR Procurement Official, at Caitlin.Meng@parks.ca.gov.

1.0 SCOPE
Provide all labor and materials to produce and deliver a floating trash boom according to all details included in these documents.
2.0 APPLICABLE LAWS AND INDUSTRY STANDARDS
2.1 Laws and Regulations
2.1.1 Required Use of American Iron, Steel, Manufactured Products, and
Construction Materials (BABA). Product and manufacturing shall comply with Infrastructure Investment and Jobs Act(“IIJA”), Pub.L.
No. 117-58, which includes the Build American, Buy American (BABA) Act, Pub. L. No. 117-58, §§ 70901-52 and OMB M-22-11, including all details described here.
2.1.1.1 all iron and steel used in the project are produced in the
United States–this means all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States;
2.1.1.2 all manufactured products used in the project are produced in the United States—this means the manufactured product was manufactured in the United States; and the cost of the components of the manufactured product that are mined, produced, or manufactured in the United States is greater than 55 percent of the total cost of all components of the manufactured product, unless another standard for determining the minimum amount of domestic content of the manufactured product has been established under applicable law or regulation; and
2.1.1.3 all construction materials are manufactured in the United States—this means that all manufacturing processes for the construction material occurred in the United States.
The Buy America preference only applies to articles, materials, and supplies that are consumed in, incorporated into, or affixed to an infrastructure project. As such, it does not apply to tools, equipment, and supplies, such as temporary scaffolding, brought to the construction site and removed at or before the completion of the infrastructure project. Nor does a Buy America preference apply to equipment and furnishings, such as movable chairs, desks, and portable computer equipment, that are used at or within the finished infrastructure project but are not an integral part of the structure or permanently affixed to the infrastructure project.
2.1.2 To help federal agencies and recipients meet BABA requirements, the U.S. Department of Commerce, National Institute for Standards and Technology (NIST), Hollings Manufacturing Extension Partnership (MEP) National Network™ provides a service to connect stakeholders, including recipients, to U.S. manufacturers that have relevant production capabilities and capacities to help fulfill current market and supply chain needs. Recipients considering a BABA non-availability waiver are strongly encouraged to contact the NIST/MEP for assistance with supplier scouting services prior to seeking a BABA non-availability waiver. Further information on the NIST/MEP supplier scouting services is available at: https://www.nist.gov/mep/supplier-scouting.
2.1.3 WAIVERS. When necessary, Recipients may apply for, and DOC may grant, a waiver from these requirements. DOC will notify the Recipient for information on the process for requesting a waiver from these requirements.
2.1.3.1 When DOC has made a determination that one of the
following exceptions applies, the awarding official may waive the application of the domestic content procurement preference in any case in which DOC determines that:
2.1.3.1.1 a. applying the domestic content procurement preference would be inconsistent with the public interest;
2.1.3.1.2 b. the types of iron, steel, manufactured products, or construction materials are not produced in the United States in sufficient and reasonably available quantities or of a satisfactory quality; or
2.1.3.1.3 c. the inclusion of iron, steel, manufactured products, or construction materials produced in the United States will increase the cost of the overall project by more than 25 percent.
2.1.3.1.4 A request to waive the application of the domestic
content procurement preference must be in writing.
DOC will provide instructions on the format, contents, and supporting materials required for any waiver request. Waiver requests are subject to public comment periods of no less than 15 days and must be reviewed by the Made in America Office.
2.1.3.1.5 There may be instances where an award qualifies, in whole or in part, for an existing waiver described at https://gcc02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.nist.gov%2Fmep%2Fsupplier-scouting&data=05%7C02%7Cchris.peregrin%40parks.ca.gov%7C72dd807c37e94d830f9808ddf9df5574%7C06fd3d24656448018226b407c4d26b68%7C0%7C0%7C638941459795180976%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&sdata=ZrAjdlWvGBmfSEDMzI%2BHtd3XOYRw3Aighspsqtt9L2s%3D&reserved=0 https://gcc02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.nist.gov%2Fmep%2Fsupplier-scouting&data=05%7C02%7Cchris.peregrin%40parks.ca.gov%7C72dd807c37e94d830f9808ddf9df5574%7C06fd3d24656448018226b407c4d26b68%7C0%7C0%7C638941459795180976%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&sdata=ZrAjdlWvGBmfSEDMzI%2BHtd3XOYRw3Aighspsqtt9L2s%3D&reserved=0 whitehouse.gov/omb/management/made-in-america.
