Please clarify the Phase-in and Phase-out Periods. The schedule in section B.2 does not reference them and Section F.3 leaves it blank with wording of “insert dates.”

Will the Government specify dates for Phase in and Phase out periods of performance?

Response: February 1-28, 2021 for phase in and February 1-28, 2026 for phase out.

2 18 F3 Please also verify the OA/CTS commencement date on Section F.3. No dates were provided.

Response: March 1, 2021. This is the same date as the POP (Period of Performance)

Response: The new PRH is at: https://prh.jobcorps.gov/Pages/Home.aspx

4 10 C.1.B Section C.1.B. indicates that Chapter 5.7, R.1, R.2, and R.3 are not applicable for FFP contracts. Can we assume that this section omissions apply to the new PRH that was recently issued as well?

Response: Yes. Those section numbers are unchanged.

5 12 C.2-H Please confirm that the HBI-operated Painting trade will not be offered under this contract and that only the IUPAT program will be offered for the Painting CTT.

Response: The IUPAT will provide career technical training in Painting. HBI will not provide this training.

6 12 C.2-H The RFP lists 16 slots for the OTP in Finance and Business, but the current CTT-10 lists 23 slots for this OTP. Please confirm which is correct.

Response: The RFP is correct.

7 12 C.2-H In view of the current corona virus pandemic and how this limits offerors ability to contact or meet with potential partners, please provide the “other training provider (OTP) currently supplying the ACT and OTP in Health Care and Finance and Business.

Response: Your partnerships that you propose are developed by you and will be evaluated as part of the acquisition process.

8 12 C.2-H Are there any CTT change requests currently in process or planned that would affect the CTT offerings under the new contract?

If so, will these changes be completed prior to the new contract period?

Response: No, there are no CTT change requests currently in process.

13 Pg. 17 section 2.3.6 Facility Survey Part 1.

Attachment J-

J-9 Facility Survey Part 1

The survey provides summary of communication systems. However, utility costs provided at J-12 & 23 do not provide any costs for phone and internet services.

Can the government provide a summary of annual costs of communications services?

Response: During the last contract year (CY) ending 2/29/2020 communications expense was $45,226: For CY ending 2/28/2019 $43,964 and for CY ending 2/28 /2018 $50,458

14 23 J-9 Page 40-47 includes $2,480,000 in unfunded or uncorrected facility deficiencies, many of which have possible safety (fire protection) and HVAC issues. This property survey is 2 years old.

Number Page # Section Description

Can the government provide an update on whether any of the deficiencies have been funded under CRA and corrected as of the date of the RFP?

Since many facility issues identified in the facility survey are not all funded under CRA, offerors will need to account for a maintenance budget to sufficiently address all the O&M items, so an updated facility survey, with updated information on what has been classified as O&M, is needed to sufficiently address facility upkeep. Will the government provide updated information for offerors?

Response: The Facility Survey provided is the most recent version of that report. The attached document “Roswell FNC” illustrates funded deficiencies per the most recent survey.

15 J-9 Would the government provide an exception to contract fixed costs if the facilities’ conditions and cleanliness are not consistent with information provided and relied upon in preparing the BP?

Response: No, but we would consider proposals for equitable adjustment if required.

16 Facility Survey Part 1 & 2

Can the government provide close up video or pictures of the inside of kitchen & dining areas to provide evidence of the condition of critical food prep areas? Also provide internal video or pictures of dorms and conditions of facilities in use? If that is not possible, will the government provide individual ratings of the above listed items such as poor, fair, or good?

Response: We have provided a virtual tour in the amendment. The Virtual Tour does show the dining area and food service area however, it does not show the kitchen/food preparation area. Photos of the food service areas are provided as a ZIP file posted with this amendment.

17 PG. 64

of RFP

J (J-16) On page 64, the J-16 references WD 2015-4075 (Dated Dec. 22, 2019). In reviewing this WD, it appears it is for Massachusetts not New Mexico.

The actual attachments provided as the J-16 refer to two different WDs: 2015-5455 and 2015-5456. These attachments are for Chavez County, NM.

Can the government please provide the exact WD that is applicable to this contract?

Response: The wage determinations for both J-15 and J-16 are attached to this amendment.

18 J-22 Are vehicles leased through GSA or owned by facility?

Can the government provide vehicle repair and maintenance costs for vehicles?

Response: All vehicles are leased GSA vehicle. The government will not provide vehicle repair and maintenance costs.

19 NA NA Please provide loss runs for the last three years for worker compensation, general liability, and auto liability to include dates, paid and reserve amounts, and a brief description of the accident.

Response: No, the government will not provide this information.

20 J9

The 2018 Facility Survey outlines significant facility safety issues and concerns in the dormitories. Please clarify if all floors and rooms in the male and female dormitories are in use based on these issues.

Response: None of the dorms or dorm rooms are closed

21 J9 Please clarify status of the recommended National Project to replace/renovate existing and demolish vacant dormitories?

Will renovations begin during contract period and alternative housing and additional staffing be required during renovation period?

Response: It is yet to be determined whether the renovations will begin during the contract period, nor has it been determined if alternative housing or additional housing will be required. However, it should be noted that projects of this nature are typically handled via direct contract through the National Office of Job Corps and the construction provider and not done at the local center operator level. The determination as to whether students would need to be provided alternative housing and whether that housing would occur in the Roswell, NM area would be weighed against the project schedule and student training needs. No projection of additional staff is required..

22 J-9 Are the washers and dryers at the Roswell JCC government property or are they leased? If they are government owned, are they all operable?

Seq.

Number Page # Section Description

Response: All washers and dryers are leased 23 18 J-9 Do the dormitories currently have operable fire alarm systems on every dorm? Please provide the current status of the National Project addressing the fire alarms that was identified in the 2018 Facility Survey.

Response: Yes, dormitories have an operable fire alarm system. Regarding the National Project for Fire Alarms, this project was completed in 2019.

24 65 J-25 Various Question and answers provided relate to the 4% vacancy calculation. It is still unclear as to whether the 2110s will be used for this purpose. Please clarify.

The 2110s would not be an effective means for this calculation as staff vacancies identified are only captured as a snapshot in time at month end. If several staff separate on the 29th of the month and therefore appear as vacancies on month end on the 2110s, this would not accurately capture the average vacancy rate for the month.

Conversely, if several vacancies existed for the majority of the month until there were hires made on the last day of the month, this would again not accurately depict the average vacancy level throughout the month. Please consider an equitable calculation for both the government and operator, for the purpose of monitoring adherence to clause C.2.H of the RFP.

Response: DOL is preparing a tool for oversight of the staff vacancy rate and will not rely on the 2110s. As soon as the tool is developed it will be distributed to the contractors.

25 General General Are any employees, at either location, represented by a union(s)? If so, please provide the name of the union(s) and the positions in the respective bargaining unit(s). Also, please provide any valid collective bargaining agreement(s).

Response: No, none of the current employees are represented by a union.

26 N/A N/A Is the center currently participating in any National Office or Regional Office pilot programs or other test bed projects, which would extend into the new contract period?

Response: No, the center is not participating in any such pilots or programs.

27 Is the center on a local public bus line?

Response: Yes it is.

28 J9 How long has the vacant building been shut down and what was the condition when it was shut down? Does the center still have to maintain anything in the vacant building to consider in facility maintenance?

Response: The building was abandoned in 2012. The plan was to demolish the building but was stopped. The building is gutted from the inside and all windows removed and the building boarded up. All the maintenance done is to provide fire extinguishers in the abandoned building.

RESIDENTIAL CONSTRUCTION PROJECTS (consisting of single family homes and apartments up to and including 4 stories)

Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.80 for calendar year 2020 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015.

If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.80 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2020. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate, if it is higher than the conformed wage rate). The EO minimum wage rate will be adjusted annually. Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the Davis-Bacon Related Acts, including those set forth at 29 CFR 5.1(a)(2)-(60). Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate,if it is higher than the conformed wage rate).

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses cited type(s) of construction in the area covered by the wage determination.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current
