INTRODUCTION TO OFFERORS

This is a Service-Disabled Veterans Owned Small Business (SDVOSB) set-aside in accordance with Public Law 109-461.

Solicitation 36C78624R0036 is being published by the Department of Veterans Affairs, National Cemetery Administration (NCA) to establish a pool of Multiple Award Indefinite Delivery/Indefinite Quantity (MA-IDIQ) contracts for the Continental District; hereafter referred to as the Continental (CND) Multiple Award Task Order Contract (MATOC) Pool.

The purpose of the CND MATOC Pool is to provide construction services to the district for maintenance & repair (M&R) projects, non-recurring maintenance (NRM) projects, and mini-minor (MM) projects.

The nature of construction services the NCA will procure through task orders under this MATOC Pool will vary, requiring multiple NAICS codes to be assigned. In accordance with 13 CFR 121.402(c)(1)(ii), the NCA has divided these services into discrete categories, assigned each category a contract line-item number (CLIN), and assigned the most appropriate NAICS code with applicable size standard. A concern must meet the applicable small business size standard for each CLIN for which it seeks an award.

All work performed under the CND MATOC Pool will be within CND geographic boundaries. See below map depicting NCA district boundaries:

The NCA anticipates awarding approximately 10 MA-IDIQ contracts in the CND MATOC Pool.

The IDIQ contracts will be awarded using a Standard Form (SF) 33. Task orders will be awarded using a SF 1442 or VA form 2138.

SECTION C - DESCRIPTION/SPECIFICATIONS/STATEMENT OF

WORK

STATEMENT OF WORK (SOW)

1. Scope

Work includes construction services to support interior and exterior cemetery improvements and expansions for NCA Maintenance and Repair (M&R), Non-recurring Maintenance (NRM), and Mini-Minor (MM) construction projects within the CND geographic boundaries. These types of projects are defined as follows:

1.1. Maintenance and Repair – The normal annual maintenance to keep a building or structure operational including the recurring maintenance and repair of roads, drives, parking lots and walks; annual building equipment maintenance, such as HVAC filter replacement, system tune-ups, etc.; painting of buildings, fences and gates; repair of roofs, walls, flagpoles and irrigation; and electrical systems.

1.2. Non-recurring Maintenance Facility Condition Assessment (FCA) – Maintenance that is not routinely accomplished. Non-recurring replacement, repair, alteration, or improvement of physical infrastructure (real property). NRM FCA projects are estimated at or below $400k. NRM FCA may include but are not limited to:

One-for-one replacement of the major components of a building, such as roofing, tuck-pointing, flashings and copings, exterior finish materials (e.g., brick, masonry, stucco, vinyl), waterproofing, or windows and doors;

One-for-one replacement of complete, or segments of, building components such as an entire roof, floor coverings, wall coverings, and ceilings, or heating, ventilating, and air conditioning system or water heater;

Repaving large sections of cemetery roads;

Replacing a flagpole;

Minimal improvements associated with a one-for-one replacement project.

1.3. Non-Recurring Maintenance National Shrine (NS) – Repair and renovation projects needed to improve the overall appearance of national cemeteries to maintain their status as national shrines honoring Veterans with a final resting place that provides an enduring memorial to their service. NRM NS projects may include but are not limited to:

Establishing a healthy stand of turf appropriate for the geographic area;

Renovating gravesites to ensure a level grade (i.e., there are no sunken graves);

Realigning and cleaning headstones and markers

1.4. Mini-Minor – Infrastructure improvement, and in limited cases, small expansion projects that are estimated to be at or below $1M.

3. Requirements

3.1. Period of Performance

3.1.1. Base – Five-year ordering period

3.2. Contract Type. IDIQ contract. All task orders awarded will be as Fixed-Price Task

Orders in accordance with FAR Subpart 16.2.

3.3. Types of Construction Services Ordering Contracting Officers (OCOs) may solicit:

3.3.1. Construction to cemetery buildings and structures that includes new work, additions, alterations, maintenance, and repairs defined under North American Industry Classification System (NAICS) code 236220.

3.3.2. Construction to cemetery grounds that includes civil construction type work for new work, reconstruction, rehabilitation, and repairs defined under NAICS code 237990.

3.3.3. Construction to cemetery buildings, structures, and grounds that includes new work, additions, alterations, maintenance, repairs, reconstruction, and rehabilitation for foundation repairs; masonry services; roofing services; exterior siding, gutter, and downspout services; steel and iron work services; electrical services; plumbing, heating, air-conditioning, and lawn sprinkler system services; interior wall, ceiling, and insulation services; interior and exterior painting services; flooring services; site preparation services; and asphalt and concrete paving and fencing services defined under NAICS codes 238110, 238140, 238160, 238170, 238190, 238210, 238220, 238310, 238320, 238330, 238910, and 238990.

3.4. General Requirements

3.4.1. Contractors must respond to each Task Order solicitation with a quote, proposal, or a statement declining to participate.

3.4.2. Contractors shall adhere to the terms and conditions of each task order awarded.

3.4.3. Contractors shall have a Quality Control Organization capability that meets the requirements of the task order terms and conditions.

3.4.4. Contractors shall provide key personnel required at the task order level. This may include a construction project manager, site superintendent, quality control manager, and safety officer.

3.5. Key Personnel Requirements and Qualifications

3.5.1. Project Manager

Graduate of a four-year accredited college program in one of the following disciplines: Engineering, Architecture, Construction Management, or a related field; or five years of project management experience in the construction industry.

The ability to interpret construction drawings and specifications.

3.5.2. Quality Control Manager

Graduate of a four-year accredited college program in one of the following disciplines: Engineering, Architecture, or Construction Management; and three years related construction field experience.

Completion of a Construction Quality Management for Construction course.

30-hour OSHA Certification Knowledge of safety programs and procedures

3.5.3. Site Superintendent

Graduate of a four-year accredited college program in one of the following disciplines: Engineering, Architecture, Construction Management, or a related field; or graduate from a technical trade school in a construction related field, and at least three years of experience working as a site superintendent in the construction industry.

The ability to interpret construction drawings and specifications.

Knowledge of safety programs and procedures

3.5.4. Safety Officer

Holds a current professional safety certification with at least 3 years of dedicated construction safety related experience.

Must meet the requirements of all applicable OSHA standards and be capable

(through training, experience, and qualifications) of ensuring that the requirements of 29 CFR 1926.16 and other appropriate Federal, State, and local requirements are met for projects.

SECTION E - INSPECTION AND ACCEPTANCE

E.1 FAR 52.246-12 INSPECTION OF CONSTRUCTION (AUG 1996)

(a) Definition. "Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.

(c) Government inspections and tests are for the sole benefit of the Government and do not—

(1) Relieve the Contractor of responsibility for providing adequate quality control measures;

(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) below.

(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.

(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

(g) If the Contractor does not promptly replace or correct rejected work, the Government may (1) by contract or otherwise, replace or correct the work and charge the cost to the Contractor or (2) terminate for default the Contractor's right to proceed.

(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, 36C78624R0036 Section E labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

OF WORK (APR 1984) ALTERNATE I (APR 1984)

The Contractor shall be required to (a) commence work under this contract within TBD calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than TBD days after receipt of award. The time stated for completion shall include final cleanup of the premises.

The completion date is based on the assumption that the successful offeror will receive the notice to proceed by TBD . The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

F.3 FAR 52.211-12 LIQUIDATED DAMAGES—CONSTRUCTION (SEPT 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of TBD for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

F.4 FAR 52.211-18 VARIATION IN ESTIMATED QUANTITY (APR 1984)

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be

36C78624R0036 Section F received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract.

Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.

F.5 FAR 52.242-14 SUSPENSION OF WORK (APR 1984)

(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.

(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1) by an act of the Contracting Officer in the administration of this contract, or (2) by the Contracting Officer's failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly. However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.

(c) A claim under this clause shall not be allowed (1) for any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order), and (2) unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

SECTION G - CONTRACT ADMINISTRATION DATA

G.2 ROLES AND RESPONSIBILITIES

G.2.1 Contracting Officer (CO)

The MATOC Pool CO is the sole and exclusive NCA Government official with actual authority to administer and/or modify the terms of the IDIQ contracts, monitor the Contractor’s performance in the areas of contract compliance and contract administration, and assist the Program Manager, Ordering Contracting Officer, and Contractor on matters related to the IDIQ contract terms and conditions. These authorities may be delegated to an Administrative Contracting Officer (ACO).

G.2.2 Program Manager (PM)

The PM is an NCA Contract Specialist who assists the CO and any delegated ACO perform various programmatic functions for the overall success of the MATOC Pool.

G.2.3 Administrative Contracting Officer (ACO)

IDIQ contracts within the MATOC Pool may be assigned an ACO to administer the contract throughout its life-cycle. The ACO will be the Contractor’s point of contact for contract modifications, executing options, and general inquiries.

G.2.4 Ordering Contracting Officer (OCO)

OCOs will be delegated by the MATOC Pool CO, PM, or ACO. Only delegated OCOs may solicit, award, and administer a task order under these contracts.

G.2.5 Contracting Officer’s Representative (COR)

Each IDIQ within the MATOC Pool will be assigned a COR to perform specific administrative or technical functions. Specific rights and responsibilities of the COR shall be in writing, which upon request, shall be provided to the Contractor. A COR has no actual, apparent, or implied authority to bind the Government. CORs can also be assigned at the task order level.

G.2.6 Contractor Key Personnel (CKP)

The Contractor shall assign a CKP to represent the Contractor as primary points-of-contact to resolve issues, perform administrative duties, accept notifications of requests for proposals, and other functions that may arise relating to task orders solicited and awarded. The Contractor shall ensure that the CO, PM, and ACO has current point-of-contact information for the CKP. Failure of the CKP to effectively and efficiently perform their duties will be construed as conduct detrimental to contract performance and may result in activation of Dormant Status and/or Off-Ramping.

G.3 INVOICES

Invoices will be submitted and paid at the task order level. All invoices from the Contractor shall be submitted electronically in accordance with VAAR Clause 852.232-72 “Electronic Submission of Payment Requests.” For directions on the e-Invoice program visit: http://www.fsc.va.gov/einvoice.asp.

G.4 CONTRACTOR PERFORMANCE ASSESMENT REPORTING SYSTEM

(CPARS)

Past performance information is relevant information, for future source selection purposes, regarding a Contractor’s actions under previously awarded contracts. It includes, for example, the Contractor’s record of conforming to contract requirements and to standards of good workmanship; record of forecasting and controlling costs; adherence to contract schedules, including the administrative aspects of performance;

history of reasonable and cooperative behavior and commitment to customer satisfaction; reporting into required databases; record of integrity and business ethics; and, business-like concern for the interest of the customer.

The NCA requires use of the Contractor Performance Assessment Reporting System (CPARS) modules as the secure, confidential, information management tool to facilitate the performance evaluation process for both the IDIQ contracts and task orders awarded under the IDIQ contracts.

The CKP will serve as a primary contact and who will be authorized access to the evaluation for review and comment for IDIQ contracts and task orders. The CKP shall respond promptly to past performance evaluations as documented by the OCO at the task order level and the CO, PM, or ACO at the IDIQ level.

In addition, the CKP will be required to identify an alternate contact that will be responsible for notifying the CO, PM, ACO, or OCO in the event they are unavailable to process evaluations within the required time frame.

G.4.1 IDIQ CPARS

The MATOC Pool CO will evaluate interim Contractor performance on an annual basis and final Contractor performance upon contract completion using the process and criteria in CPARS.

Evaluations of Contractor performance will be provided to the Contractor as soon as practicable after completion of the evaluation. Contractors will be given a minimum of 30 days opportunity to submit comments, rebutting statements, or additional information.

Copies of the evaluations, Contractor responses, and review comments, if any, will be retained as part of the contract file, and may be used by Federal agencies to support future award decisions.

G.4.2 TASK ORDER CPARS

The MATOC Pool CO does not administer or evaluate task order performance. It is the sole responsibility of the OCO to evaluate each task order using the process and criteria in CPARS.

Evaluations of Contractor performance will be provided to the Contractor as soon as practicable after completion of the evaluation. Contractors will be given a minimum of 30 days to submit comments, rebutting statements, or additional information.

Copies of the evaluations, Contractor responses, and review comments, if any, will be retained as part of the task order file, and may be used by Federal agencies to support future award decisions.

G.5 VETS 4212 REPORTS

Subject to FAR 22.1303 applicability, FAR 52.222-37 Employment Reports on Veterans, and the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA) Contractors and Subcontractors are to report annually to the Department of Labor the number of employees in their workforces, by job category and hiring location, who are qualified covered veterans. VEVRAA also requires Contractors and Subcontractors to report the number of new hires during the reporting period who are qualified covered veterans.

Contractors shall submit a VETS-4212 report annually to the DOL VETS-4212 website and provide confirmation to the IDIQ CO, even if the Contractor has no covered veterans or new employees to report during the reporting period.

G.6 OPTION DETERMINATION

After the initial base contract term of five years, the NCA has included one option to extend the term of the contract in order to demonstrate the value it places on quality performance by providing a mechanism for continuing a contractual relationship with a successful Contractor that performs at a level which meets or exceeds NCA’s performance expectations.

In recognition of exceptional contract and task order performance of a particular Contractor during their initial five-year term of performance, the Government will consider exercising Option 1.

The option determination for each Contractor will be based on FAR Subpart 17.207 for exercising the option term, and the overall quality of the Contractor’s past performance under the IDIQ and task orders awarded.

SECTION H - SPECIAL CONTRACT REQUIREMENTS

H.1 NCA Dignity Clause

Every action by contractor personnel at a national cemetery must be performed with the special care, reverence, dignity, and respect that acknowledges the cemetery as the final resting place that commemorates the service and sacrifice that service members, Veterans and their families made for our Nation. Critically important is the awareness required of the Contractor employees of the remains buried in the grounds where the work is performed. The utmost care must be given to these remains and the headstones and flat grave markers that mark those gravesites and memorialize the service of individuals.

H.2 OBSERVATION OF FEDERAL HOLIDAYS

The Contractor shall observe Federal holidays and other days identified in this section unless otherwise indicated in individual task orders. The Government observes the following days as holidays:

1. New Year’s Day

2. Birthday of Martin Luther King Jr. Day

3. Washington’s Birthday

4. Memorial Day

5. Juneteenth

6. Independence Day

7. Labor Day

8. Columbus Day

9. Veterans Day

10. Thanksgiving Day, and

11. Christmas Day

In addition to the days designated as holidays, the Government may also observe the following days:

1. Any day designated by Federal Statute; Executive Order; or President’s Proclamation

Notwithstanding holidays and Government closures, the Contractor shall perform in accordance with the terms established in the IDIQ contract and associated task orders.

H.3 ORDERING PROCEDURES

H.3.1 Notice of Task Order Solicitation Procedures

Task order solicitations will be issued as either Requests for Quotations (RFQ) or Proposals (RFP). Task orders shall be awarded based on competitive proposals requested in accordance with the fair opportunity process requirements in FAR 16.505(b). However, competitive quotations/proposals may not be requested if an exception to the fair opportunity process applies, (See FAR 16.505(b)(2). Task order RFQ/RFP notifications can be published by email or through the Department of Veterans Affairs eCMS Vendor Portal by OCOs. Oral orders are authorized in emergency situations provided that the OCO has an assurance of funds, established procedures for obligating funds, and that oral orders are confirmed in writing.

Email Notifications: MATOC Pool Contractors shall always keep an up-to-date email address on file with the ACO. Backup addresses are encouraged. Upon receipt of a Task Order RFQ/RFP, the Contractor shall acknowledge receipt of the offering by return email. An OCO shall make only one attempt to email an RFP to a MATOC Contractor. The Government will not be responsible for lack of notification(s) for Contractors who fail to maintain current email addresses.

Vendor Portal Notifications: MATOC Contractors must register with the Department of Veterans Affairs eCMS Vendor Portal at https://www.vendorportal.ecms.va.gov. In the event an Offeror is unable to submit a proposal through the vendor portal domain, prior to the proposal closing date, contact the helpdesk at 1-877-634-3739, or via email at VA.Acquisition.Systems@va.gov. If an Offeror is still having difficulties in submitting a proposal via the Vendor Portal the ACO may accept proposals via email under the following circumstances:

Offeror must provide evidence that email discussions or verbal discussion with the helpdesk could not resolve registration issues.

Proposal submitted must meet the time constraints as set forth in the task order solicitation.

H.3.2 Task Order Solicitation and Award Documents

Task order solicitations will contain a notification letter and applicable project information such as a statement of work, construction drawings, construction specifications, key personnel price schedule sheet, wage determination(s), and any other supporting documents and information needed to facilitate accurate quotes/proposals from Contractors. Hourly fees associated with key personnel must be equal to or less than the pre-negotiated fully burdened rates agreed to at the time of IDIQ contract award. Task orders will be awarded using a Standard Form 1442 or VA form 2138.

H.3.3 Task Order Source Selection Processes and Techniques

The task order solicitation will specify the source selection technique and evaluation factors used to evaluate quotes/proposals. OCOs have the discretion to use one or more of the evaluation procedures in FAR Part 15. Whenever possible, award will be made without discussions. If determined necessary, OCOs may conduct discussions and/or communications with Offerors and will be done in accordance with FAR Part 15 procedures.

H.3.4 Task Order Terms and Conditions

The terms and conditions of the Contractor's IDIQ contract (including any contract modifications) apply to all task orders issued under the contract. Any unique terms and conditions of an order issued under the contract that are not a part of the applicable IDIQ will govern. In the event of an inconsistency between the terms and conditions of a task order and the Contractor's IDIQ, the terms of the IDIQ will take precedence.

The Government reserves the right to incorporate additional clauses, as appropriate, into individual task order solicitations and awards.

All costs associated with the preparation, presentation, and discussion of the Contractor’s proposal in response to a task order solicitation will be at the Contractor’s sole and exclusive expense.

H.4 PREDOMINANT TASK ORDER NAICS DETERMINATION

The OCO has the responsibility to determine which predominant NAICS code applies to a task order solicitation. The OCO must identify the NAICS Code Number, Title, Small Business Size Standard, and corresponding CLIN or SLIN from the IDIQ contracts (CLIN 0001, 0002, or 0003). Contractors that have been awarded the selected CLIN on their IDIQ can compete for the task order award.

H.5 PRODUCT SERVICE CODES (PSC)

The PSC represents what services were purchased by the federal government for each task order award reported in the Federal Procurement Data System (FPDS). The scope of the IDIQ contracts span across many construction related PSCs, however, the primary PSC selected must be based on the predominant service that is being purchased. The OCO has the responsibility for determining the most appropriate

PSC.

H.6 SECURITY CONSIDERATIONS

This is an acquisition where contractor and sub-contractor employees will require routine access to a federally controlled facility. Each cemetery has different requirements for routine access; therefore, if determined necessary, contractor employees may be required to go through background checks and be eligible to receive a Government Identification Card prior to entering a facility to conduct work. If required, all background checks and credentialling will be completed in accordance with NCA policies and standard operating procedures.

H.7 COOPERATION WITH OTHER CONTRACTORS ON NCA SITES

The NCA may undertake or award other contracts or task orders for work at or near the sites of work that may be awarded under these IDIQ contracts. The Contractor shall fully cooperate with the other Contractors and with Government employees and shall carefully adapt scheduling and performing the work under contract to accommodate the working environment, heeding any direction that may be provided by the OCO. The Contractor shall not commit or permit any act that will interfere with the performance of work by any other Contractor or by Government employees.

H.8 ON/OFF-RAMPING

H.8.1 On-Ramping Procedures

The total number of Contractors within the CND MATOC pool may fluctuate due to any number of reasons including but not limited to, competition levels on task orders, mergers & acquisitions; and the Government's exercise of the on/off-ramp processes. It is in the Government’s best interest that there remain an adequate number of Contractors eligible to compete for task orders to meet the Government’s construction service mission requirements. At any time, the NCA determines it to be necessary, they may initiate on-ramping procedures to add Contractors to the CND MATOC Pool. Procedures to on-ramp are as follows:

1. A notice is published in Federal Contract Opportunities in accordance with FAR Part 5, Publicizing Contract Action notifying the public than the NCA is initiating on-ramping procedures for the CND MATOC Pool.

2. A solicitation is issued under current Federal procurement law.

3. The solicitation identifies the total anticipated number of new contracts that NCA intends to award

4. Any Offeror that meets the eligibility requirements set forth in the on-ramping solicitation may submit a proposal in response to the solicitation.

5. The award decision under the on-ramping solicitation is based upon substantially the same evaluation factors/sub-factors as the original solicitation.

6. An Offeror’s proposal must receive a proposal score equal to or higher than the lowest scoring Contractor within the CND MATOC Pool.

7. The terms and conditions of any resulting awards are materially identical to the existing version of the CND MATOC Pool and,

8. The period of performance term for any new awards is coterminous with the existing term for all other Contractors.

Immediately upon on-ramping, the Contractor is eligible to submit a proposal in response to any task order solicitation and receive task order awards with the same rights and obligations as any other Contractor.
