About this file
This is an informational notice regarding employee rights under the Davis-Bacon Act for laborers and mechanics employed on federal or federally assisted construction projects. The document outlines prevailing wage requirements, overtime compensation, enforcement mechanisms, and employee protections applicable to this contract.
Under the Davis-Bacon Act, employees must be paid prevailing wage rates as listed in the Davis-Bacon Wage Decision posted with the notice for all work performed. Overtime compensation must be paid at not less than one and one-half times the basic rate of pay for all hours worked over 40 in a work week, with few exceptions. Apprentice rates apply only to apprentices properly registered under approved Federal or State apprenticeship programs. The federal government enforces these requirements through contract payment withholding, liquidated damages, contract termination, and potential debarment of contractors from future federal contracts for up to three years. Contractors who falsify certified payroll records or induce wage kickbacks are subject to civil or criminal prosecution, fines, and/or imprisonment. Employees who do not receive proper pay or require further wage information should contact Daniel P. Kinney, Contract Specialist with the Department of Veterans Affairs National Cemetery Administration (daniel.kinney@va.gov, 402-830-4683), or the U.S. Department of Labor's Wage and Hour Division (1-866-487-9243 or www.dol.gov/whd).
