About this file
This is an employee rights notice issued by the U.S. Department of Labor's Wage and Hour Division regarding Davis-Bacon Act requirements for federal and federally assisted construction projects. The document informs laborers and mechanics of their wage and hour protections applicable to contracts issued by the Department of Veterans Affairs, National Cemetery Administration.
The notice establishes that workers must receive prevailing wage rates as specified in the Davis-Bacon Wage Decision posted with the contract, with overtime compensation at not less than one and one-half times the basic rate for all hours exceeding 40 in a work week. The document outlines enforcement mechanisms, including contract payment withholding, liquidated damages for non-compliance, contract termination authority, and potential debarment of contractors for up to three years. Criminal and civil penalties, including fines and imprisonment, may apply to contractors who falsify payroll records or engage in wage kickbacks. Apprentice rates apply exclusively to workers properly registered under approved Federal or State apprenticeship programs. Workers with wage concerns or requiring additional wage information should contact Daniel P. Kinney, Contract Specialist at the Department of Veterans Affairs National Cemetery Administration (daniel.kinney@va.gov, 402-830-4683), or the U.S. Department of Labor's Wage and Hour Division at 1-866-487-9243 or www.dol.gov/whd.
