About this file
This document is an employee rights notice issued by the U.S. Department of Labor's Wage and Hour Division regarding the Davis-Bacon Act. The notice informs laborers and mechanics employed on federal or federally assisted construction projects of their wage and overtime protections.
Under the Davis-Bacon Act, workers must receive no less than the wage rate specified in the Davis-Bacon Wage Decision posted with the solicitation for the work performed. Employees are entitled to overtime compensation at not less than one and one-half times their basic hourly rate for all hours worked exceeding 40 in a work week, with limited exceptions. Apprentice rates apply only to apprentices properly registered under approved Federal or State apprenticeship programs. The federal government enforces these requirements through contract payment withholding, liquidated damages assessments, contract termination, and contractor debarment for up to three years. Contractors who falsify certified payroll records or induce wage kickbacks may face civil or criminal prosecution, fines, and imprisonment. For wage and hour inquiries, employees may contact the Contracting Officer Daniel P. Kinney at the Department of Veterans Affairs National Cemetery Administration (daniel.kinney@va.gov, 402-830-4683) or the U.S. Department of Labor's Wage and Hour Division at 1-866-487-9243 or www.dol.gov/whd.
