About this file
This document is a pre-award contractor safety and environmental record evaluation requirement and form for federal contract solicitations.
All bidders and offerors must submit information regarding their past safety and environmental record, specifically disclosing any serious, repeat, or willful OSHA or EPA violations within the past three years. Bidders must also provide their current Experience Modification Rate (EMR) obtained from their insurance carrier on insurance letterhead. If the EMR exceeds 1.0, contractors must submit a written explanation from their insurance carrier describing reasons for the elevated rate and the anticipated date for reduction to 1.0 or below. Self-insured contractors unable to obtain EMR ratings from insurance letterhead must obtain ratings from the National Council on Compensation Insurance, Inc. (NCCI) using form ERM-6, or from state-run workers' compensation insurance rating bureaus for contractors in California, Delaware, Michigan, New Jersey, North Dakota, Ohio, Pennsylvania, Washington, Wyoming, and Puerto Rico. If NCCI cannot issue an EMR due to insufficient insurance history, contractors must submit letters from both their insurance carrier and NCCI confirming a Unity Rating of 1.0. The government will use submitted information along with OSHA and EPA online inspection history databases to make an initial determination of responsibility. This requirement applies to all subcontracting tiers, with prime contractors responsible for determining subcontractor responsibility.
The Pre-Award Contractor Safety and Environmental Record Evaluation Form requires contractors to provide company information, complete a three-year table of man hours, injury cases, DART rates, and OSHA violations, attach OSHA 300 and 300a forms, identify their safety and health program administrator, supply their six-digit NAICS code (238220 for this acquisition), and provide their EMR.
