About this file

This document contains two key sections related to a VA solicitation for a service-disabled veteran-owned small business set-aside contract. The first section addresses Safety and Environmental Record requirements, mandating that bidders/offerors submit documentation proving they have: 1) No more than three serious, or one repeat/willful OSHA or EPA violations in the past three years, and 2) An Experience Modification Rate (EMR) equal to or less than 1.0, verified through insurance carrier documentation. Failure to meet these requirements will result in a "Non-Responsibility" determination and contract ineligibility.

The second section outlines subcontracting monitoring and compliance procedures, specifically noting that VA may utilize support contractors to assess the prime contractor's compliance with subcontracting limitations. These support contractors must sign non-disclosure agreements and may require access to the contractor's business records. The solicitation includes VA Acquisition Regulation (VAAR) 852.219-10, which covers the Service-Disabled Veteran-Owned Small Business Set-Aside, and requires full contractor cooperation in demonstrating compliance with subcontracting requirements and work performance percentages.
