Factor 2 – Capability to Perform

Submission Criteria: Submit resumes for key personnel identified below. In resumes, offeror shall include the following: Name of individual, position title, years with company, educational background, and narrative describing management/supervision of one (1) completed project of similar size and scope to this project (at least 50% complete and included installation of at least 10K linear underground water or sewer lines). Include any and all applicable valid certificates including name and granting institution.

Each position must show minimum of five (5) years of construction experience within the role they are filling. All personnel proposed are subject to substitution requirements contained in this solicitation. Dual hatting will not be allowed. There is no preprinted form for this submittal.

• Project Executive

• Project Manager

• Project Engineer (Must be a Mechanical Engineer with a Professional Engineering (PE) License)

• On-site Superintendent

• On-site Quality Control

• On-site Safety Representative

• Engineer of Record (Professional Engineering (PE) License)

In addition to all resumes, a professional capability statement for the A/E Firm working with the Offeror must be submitted that includes the following:

• Company name, DUNS number and Unique Entity Identifier (UEI), company address, Point-of-Contact name, phone number, and email.

• Company business size based on NAICS code 237110

• Three (3) projects that the company has performed within the last six (6) years that are of comparable size, complexity, and scope to this project. Include the project name, project owner and contact information, project scope, project size, building use (Example: Medical Facility, Office Building, etc.), project dollar value, start and completion dates.

Evaluation Methodology: Offerors will be evaluated on whether they meet or exceed the minimum submission criteria above. Additionally, resumes will be evaluated to determine recency and relevancy of experience and whether experience submitted on resumes are similar in size, scope, and complexity. An evaluation will also be done on role fit to determine if the role assigned to the individual aligns with the individual’s background and certifications/licenses.

The A/E’s capability statement will be evaluated based on recency and relevancy of the three projects submitted and risk assessment will be carried out based on the A/E’s demonstrated ability to perform projects of similar size and scope.

Factor 3 – Specialized Experience

Submission Criteria: Offerors shall complete and return Att 7 – Project Information Sheet for Contractors, addressing specific experience aspects below with a minimum of three (3) recent and relevant projects. Please include whether this work was completed as a prime constructor or as a subcontractor. Submit separate forms for each project. If the Offeror is a Joint Venture (JV), project experience shall be submitted for projects performed by each individual entity, and by the Joint Venture itself, if available.

A “recently” completed project is defined as a construction project within 1) has been completed within the last six (6) years of the RFP issuance date, or 2) is currently under construction and is at least fifty percent (50%) complete as of the RFP issuance date.

A “relevant” project is defined as a project that included installation of at least 10K linear feet of underground water or sewer lines.

• Construction Experience: Describe experience in projects that are recent and relevant to this solicitation. Projects should include, if possible, VA Medical Centers, Civil, and/or Mechanical/Plumbing.

• The Divisions to be included but are not limited to are Mechanical, Plumbing, Civil, and show effective management, problem solving, communication, coordination, and organization with multi-discipline (divisions) of work.

• Teaming Experience: Include at least one (1) project which required coordination with an A/E firm that was hired and managed by the offeror.

Evaluation Methodology: Offeror shall submit the above mentioned Project Information Sheet (Att 7) for three (3) projects that meet each of the requirements in factor 2. Those offerors not demonstrating these attributes present higher levels of risk and will be less favorably rated. Greater weight may be given for offerors demonstrating self-performance above 30% and/or be given for projects located on VA Medical Centers.

Note: The same projects evaluated for experience under this factor shall also be evaluated for Past Performance (Factor #4).

Factor 4 – Past Performance

Submission Criteria: The offeror shall provide recent and relevant information regarding Offeror’s past performance under previously awarded contracts by submitting a Past Performance Questionnaire (PPQ) using the solicitation attachment or a Contractor Performance Assessment Reporting System (CPARS) rating report. For the purposes of this evaluation the offeror shall submit a completed PPQ or CPARS report for each of the three

(3) projects submitted in Factor 3 – Specialized Experience. For projects where the offer was a subcontractor or the client was nongovernmental, a PPQ shall be completed. For projects where the offer was the prime or JV and a CPARS report exists, the CPARS report(s) shall be submitted. For this factor, the Government will not consider or evaluate offeror submitted PPQ's or CPARS for projects not submitted under Factor 3 – Specialized Experience.

The same definitions of recent and relevant in Factor 3 – Specialized Experience apply in Factor 4 - Past Performance as well.

If the Offeror is a Joint Venture (JV) past performance shall be submitted for projects performed by each individual entity, and by the Joint Venture itself, if available.

If the offeror is unable to obtain a completed PPQ from a client before the proposal closing date, the offeror shall complete and submit the PPQ with blocks 1-3 completed. The Government reserves the right, should they choose, to contact the client to conduct an independent assessment. However, the Government is under no obligation to employ any particular measure to obtain past performance information directly from clients.

All PPQ’s must be received prior to the proposal closing date. Offerors may submit PPQ’s for submitted projects which were previously filled out by clients and used in previous proposal submissions.

Evaluation Methodology: The Government will assess an offeror’s Past Performance rating based on the following:

1) Evaluating the past performance of the Factor 3 – Specialized Experience projects submitted. The offeror shall demonstrate a record of past performance for each project, submitted in Factor 3 – Specialized Experience.

2) Any recent or relevant evaluations the Government identifies. The Government reserves the right to review and consider any databases or other sources. This may include, but is not limited to; past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in an offeror’s proposal, Contractor Performance Assessment Report System (CPARS), inquiries of owner representative(s), Federal Awardees Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), Government field representatives, and other known sources.

There are two aspects to the past performance evaluation 1) relevancy of the contractual work performed, and 2) how well the contractual work was performed. This evaluation will result in a single performance confidence assessment of an offeror’s probability of meeting the solicitation requirements.

A “recently” completed project is defined as a construction project which 1) has been completed within the last six (6) years of the RFP issuance date, or 2) is currently under construction and is at least fifty percent (50%) complete as of the RFP issuance date. More recent past performance will typically be a stronger predictor of future success and have more influence on the performance confidence assessment. Further, whether a project is “recent” will be considered in determining the project’s relevance.

A “relevant” project is defined as a recently completed project, with a similar scope and containing at least 10K linear feet of underground water or sewer lines as the project that is the subject of this solicitation, as the term “relevant” is defined above. Projects that are more “relevant” will typically be considered a stronger predictor of future success and have more influence on performance confidence assessment, compared to past performance submitted for projects of lesser relevance.

The Government places a higher value on past performance for which documented successful outcomes are both available and supported by outside source confirmation (for example, telephone interviews with references and clients, CPARS or other agency performance databases, or personal knowledge of Government employees that have worked closely with the offeror).

Past performance of greater relevancy will typically be a stronger predictor of future success and have more influence on the confidence assessment for Factor 4, than past performance on projects of lesser relevance.

In accordance with RFO FAR 15.202(c), in the case of an offeror for which there is no information on relevant past performance or where past performance is not available, the offeror may not be evaluated favorably or unfavorably on the factor of past contract performance. In this case, the offerors past performance is unknown and assigned a performance confidence rating of “neutral”. However, the Source Selection Authority (SSA) may determine, that a “Substantial Confidence” or “Satisfactory Confidence” past performance rating is worth more than a “Neutral Confidence” past performance rating in a best value tradeoff as long as the determination is consistent with stated solicitation criteria.

The Government may seek and obtain past performance information pertaining to the offeror from Governmental and non-Government sources and databases. In arriving at a single performance confidence rating, an offeror’s past performance is evaluated to determine how relevant each submitted project is to the efforts required in the solicitation.

The Government’s review of each project is a significant contributor to the final Past Performance confidence rating; however, it is not a formal rating in and of itself.

Factor 5 – Bonding Capacity

Submission Criteria: The offeror shall provide a letter from their surety demonstrating the offeror’s single project bonding capacity and total aggregate bonding capacity. The offeror’s single project capacity and total aggregate bonding capacity must be provided on surety bonding company letterhead and signed by an officer of the surety. The surety company must be on the U.S. Treasury Circular 570 approved listing. This letter must be dated no earlier than the solicitation release date.

Evaluation Methodology: Will be evaluated based on whether or not the Offeror has adequate single project bonding capacity and total aggregate bonding capacity to accommodate the design and construction of the project. For the purposes of this factor, the minimum capacity is $5M for both single and aggregate capacity. This factor will be rated on a pass/fail basis.

C. Phase II Proposal Format and Evaluation:

1. Format: Phase II proposals shall be based on solicitation documents and the instructions provided by the Contracting Officer in the Phase II Notice of Offerors notifying Offerors that they were selected as one of the most qualified Offerors in Phase I. Technical (Non- Price), Price, and Administrative sections of the proposals will be evaluated independently; therefore, the Offeror shall submit the proposal in three (3) Volumes (Volume I: Technical, Volume II: Price, and Volume III: Administrative). The contractor shall include NO price information in Volume I, Technical. All three volumes must be labeled with the Offeror’s company name, point of contact, and VA Solicitation Number.

The Offeror shall submit all Volumes in electronic format as searchable PDF documents.

The proposal, in its entirety, shall not exceed three emails (one for each volume) of 5 MB. Include page numbers and the solicitation number in the header and footer of each page.

a. Volume I, including, all non-price factors (Technical Solution, Schedule, and Safety) is not restricted to a page limitation for the volume overall. However, Technical Solution should not exceed fifteen (15) pages.

b. Volume II including price only shall not exceed a total of TEN (10) pages following the formatting requirements stated in general proposal requirements.

c. Volume III: Administrative: Offerors shall include the following in Volume III. All of the below information must be provided. An Offeror may be considered unacceptable if these items are not provided in the proposal.

i. Offeror shall acknowledge all amendments by annotating each amendment in block 19 of the SF1442, or by signing and returning each SF30.

ii. Bid Bond (see FAR Provision 52.228-1, Bid Guarantee, contained in the solicitation).

iii. Representations and Certifications: By submitting its offer, the Offeror verifies that, as of the date of its offer, its representations and certifications posted electronically in SAM for the applicable provisions are current, accurate, and complete. The Offeror’s representations and certifications in SAM are hereby incorporated by reference into its offer.

iv. Information Regarding Responsibility Matters: Offeror shall provide their response to FAR 52.209-7(b) Information Regarding Responsibility Matters.

v. Violation of Arms Controls Treaties or Agreements: Offeror must provide their response to FAR 52.209-13(b)(1) or (2) Violation of Arms Controls Treaties or Agreements.

The completed and signed certification will become part of the official award documentation. A copy of the clause to be completed and included with the proposal is attached as a separate document (see Attachment Limitations on Subcontracting - Construction). Failure to return the entire clause, with the appropriate box marked, the offeror’s name entered, and the certification completed and signed, with the offeror’s proposal will result in the offer being ineligible for award.

viii. Notice to SDVOSB Joint Venture/Mentor-Protégé: Any offeror submitting a proposal as a joint venture must provide a copy of the joint venture agreement, as well as a certification from the certified SDVOSB joint partner, signed by an authorized official of each partner to the joint venture, stating that the parties to the joint venture (1) have entered into a joint venture agreement that fully complies with paragraph (c) of 13 CFR § 128.402, and

(2) will perform the contract in compliance with the joint venture agreement.

Provide the UEI for each partner in the agreement. Failure to submit the agreement and certification with the offeror’s proposal may result in the rejection of the proposal.

ix. Evaluation factors 1 – 3 are of descending order of importance. All technical evaluation, when combined, are approximately equal to price.

Factor 1 – Technical Solution

Submission Criteria: Technical solution is your means and methods to complete a technical aspect of required work in this solicitation. Submit a written narrative limited to 15 pages describing your technical solutions to the specific aspects below. Additional pages will not be evaluated. Pictures or drawings may be included and will count towards the page limitation. There is no pre-printed form this submittal.

• General technical Solution for Design: include validation of existing bridging document, analysis of feasibility, benefits and drawbacks, potential for successful design completion within the timeline defined in the SOW, and review and approval processes. The Design shall also take into account impacts to the hospital (shutdowns, impacts to movements of vehicles and pedestrians, parking, etc.).

Submission shall include on-site investigation and survey procedures, the specified design phases and submittal packages, and the processes for appropriately documenting and compiling data for the final project record drawings.

• General Technical Solution for Construction: include the constructability of the design plan, the demonstrated understanding of the project constraints, risks, and long-lead items, and the ability to successfully accomplish the work in accordance with the specified schedule. Address the proposed coordination with the design team during construction, cost and quality control, and risk mitigation strategies.

Evaluation Methodology: A technical solution that complies with applicable contract requirements; are realistic, appropriate, and efficient; and demonstrate clear logic and scope understanding. Technical solutions such as these present lower levels of risk and will be more favorably rated. Solutions not demonstrating these attributes present higher levels of risk and will be less favorably rated.

Factor 2 – Schedule

Submission Criteria: Submit your proposed draft construction schedule for this specific project showing completion within the required period of performance contained in this solicitation with accompanying schedule narrative. Submit your schedule in Gantt Chart format and include specific activities required for this project and a clear critical path with major milestones and applicable predecessor activities.

Evaluation Methodology: Construction schedules and narrative descriptions documenting:

(1) a construction schedule that is realistic, appropriate, and efficient; (2) clear and efficient critical path and logical sequencing; (3) accounts for procurement lead-time, subcontractor/trade coordination, on-site storage and staging, resource and time constraints; and (4) demonstrates risk mitigation and successful completion within the required performance period, present lower levels of risk and will be more favorably rated.

Schedules which do not demonstrate these attributes present higher levels of risk and will be less favorably rated.

Factor 3 – Safety

Submission Criteria: Submit safety documentation, including the Design-Build Team’s current Experience Modification Rate (EMR), OSHA 300/300A logs, and a Corporate Safety Plan outlining the team’s overall safety policies, procedures, and management practices.

Evaluation Methodology: Offerors’ safety statistics and documentation, including their current Experience Modification Rate (EMR), demonstrating (1) a strong commitment to workplace safety; (2) a history of maintaining low incident rates; and (3) proactive risk management and compliance with safety regulations, present lower levels of risk and will be more favorably rated. Offerors not demonstrating these attributes present higher levels of risk and will be less favorably rated.

Factor 4 – Price

Submission Criteria: Carefully follow “Instructions, Conditions, and Notices to Offerors”, Standard Form (SF) 1442 Solicitation, Offer, and Award (Construction, Alteration, or Repair) and the price schedule when submitting price offers. Submit the signed Solicitation, Offer, and Award (SF 1442) with blocks 14-20c completed, including acknowledgement of all amendments. The prices shall be Firm Fixed Price. The Offeror shall take care not to include remarks that take exception to the Government’s solicitation and supporting attachments, pricing requirements, or otherwise preclude the Government from evaluating the offer or render the offer as non-responsive or unacceptable. If the Offeror communicates in its proposal any exceptions, exclusions, qualifications, or conditions to the proposed prices not provided for in the Offerors proposal documents, the Contracting Officer may reject the proposal and exclude the Offeror from further consideration. The total evaluated price will be determined by the Offeror’s price for CLIN 0001 and CLIN 0002.

Evaluation Methodology: The Government will evaluate the offeror’s price proposal in order to identify risks to the Government based upon demonstration that:

a. The price proposal is complete. To be complete, the offeror shall provide all data that is requested to evaluate the price. The Government will assess the extent to which the proposed prices comply with the content and format requirements set forth in this solicitation.

b. The price proposal is reasonable. A price will be determined "reasonable" by using the techniques at FAR 15.404-1, as deemed appropriate by the Contracting Officer and when determined to be the best value to the Government. Such techniques may include comparison with the Independent Government Estimate (IGE) and to prices in the market (market conditions may be evidenced by other competitive proposals).

Price evaluations will not result in an assigned adjectival rating. Contract line items will be analyzed to determine whether unit prices proposed for the work to be performed reflect the offeror’s understanding of the solicitation requirements and are consistent with the offeror’s technical proposal. Price proposals that are incomplete or unreasonable may be considered unacceptable.

Note: If none of the offerors are within the available funding limitation or is otherwise determined to be other than fair and reasonable, the VA reserves the right to enter into negotiations with those offerors who are determined to be within the competitive range. If the Offeror communicates in its proposal any qualifications, exceptions, exclusions, or conditions to the proposed prices in the Offerors proposal documents, the Contracting Officer may reject the proposal and exclude the Offeror from further negotiations.

D. Final Proposal Revisions (section only applies if negotiations are conducted):

1. If determined to be necessary, proposal revisions will be requested from the Offerors determined by the CO to be in the competitive range based on the selection criteria.

Negotiations may be conducted with those Offerors falling within the competitive range, after which proposal revisions will be requested. Proposal revisions will be submitted as per section 2.7(A) above, except as noted below and will be due at a time and place to be determined.

2. Offerors submitting proposal revisions will not be requested to re-submit any documents which are unchanged from their initial proposals. Offerors will provide necessary changes to individual paragraphs, as briefly as possible, and include a table of contents, which indicates where within the initial proposal the additional information or changed documents would be placed. Proposal revisions shall include a completed SF 1442 that acknowledges receiving all amendments, by number. A new bid bond shall be submitted only if the final proposal revisions Offeror’s price proposal is greater than its initial price proposal.

2.9 DETERMINATION OF RESPONSIBILITY

In accordance with FAR subpart 9.1, Responsible Prospective Contractors, a responsibility determination will be made for the apparent successful offeror prior to award of the project. The Contracting Officer reserves the right to request information to assist the Government in determining the apparent successful offeror responsible, including information regarding the offeror’s previous experience (including points of contact), organization (including company officers), technical qualifications, financial resources, and other information deemed necessary.

These requests for information do not constitute negotiations. NOTE: Any information received by the Government that would be cause for a negative responsibility determination may deem the offeror ineligible for award

2.10 VETS 4212

Title 38, USC Section 4212(d), codified at 41 CFR Section 61-300, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS-4212 reporting information can be done electronically at:

http://www.dol.gov/vets/vets4212.htm. Award cannot be made unless the awardee has filed their VETS-4212 report. Therefore, all offerors are encouraged to file every year. The Contracting Officer may request a copy of the email confirmation of receipt notification prior to awarding the project.

2.11 SYSTEM FOR AWARD MANAGEMENT (SAM)

The FAR requires that federal contractors register in the SAM database at https://sam.gov/ and enter all mandatory information into the system. In compliance with FAR 52.204-7, an offeror must have an active registration in SAM at the time an offer is submitted and at the time of award. The initial screening of proposals includes reviewing SAM.gov for compliance with this section.
