STATEMENT OF WORK

Washington, DC 20226
MISSION
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is a principal law enforcement agency within the United States Department of Justice dedicated to preventing terrorism, reducing violent crime, and protecting our Nation. The men and women of ATF perform the dual responsibilities of enforcing Federal criminal laws and regulating the firearms and explosives industries. They are committed to working directly, and through partnerships, to investigate and reduce crime involving firearms and explosives, acts of arson, and illegal trafficking of alcohol and tobacco product.
INTRODUCTION
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Department of Justice is seeking a contractor to provide all equipment, materials, specialty services, management, supervision, quality control, labor to renovate Suite 5.N620 as per ATF Design concept. The ATF building manager will be the on-site primary POC for the project to include site visits, inquiries, the communication of change orders through the CO, progress reports, daily inspections, and security and access issues. ATF can provide access via completed PCI form, 72 hours after request is submitted to the building manager. Design concept drawings are included as attachment.
The contractor is responsible for all field measurements, quantifying material, and parts, including all incidental materials required to complete the project in a manner that meets or exceeds industry accepted standards as identified by the Government.
OVERVIEW
This project is to renovate the space within Suite 5N-620 as per ATF design concepts to facilitate the on boarding of executive staff.
The space is located on the 5th floor of the ATF Headquarters building on 99 New York Avenue, NE. Washington DC. The contractor will shall verify all existing conditions and measurements and ensure any solutions are compatible with design intent set forth by ATF and any deviations are mutually agreed upon. The contractor will coordinate work, peruse, and acquire required ATF security clearances, and gain any approvals required in this Statement of Work (SOW) from the Contracting Officer (CO) through the Contracting Officer’s Representative/Project Manager (COR/PM) as required.

SPECIAL REQUIREMENTS
To be considered successful, the project must achieve the following objectives:
Deliver the project on time and within budget. Complete the project with no security violations or safety incidence. Establish and maintain positive relations with the tenant(s), public authorities, jurisdictions, and neighborhood. Ensure a safe work environment during construction for workers and authorized visitors on the construction site. Manage the completion of the project with the spirit of partnering and without litigation. Provide timely progress reports and communications. Ensure that all sensitive documents are handled, distributed, archived, and destroyed according to established project procedures. Follow all security requirements in the delivery of this project.
DESCRIPTION OF WORK
Provide, materials, and construction labor to construct an office environment utilizing the agency provided sketch as a starting point within the 5th floor of the ATF HQ. Completed project must meet all applicable federal, state and local codes, regulations and standards dictated by the industry and throughout this SOW. If required, design and construction work items will extend beyond this suite to meet all the requirements documented in codes and standards. Design shall have appropriate engineering analysis and design to support the sprinkler, fire alarm, electrical and mechanical needs of the space. All designs and construction must meet current industry specifications for accreditation. All designs must be fully approved prior to the start of any abatement, demolition, or construction activities.
SCOPE OF WORK
• Remove existing system furniture per detailed drawings.
• Building new office in 5.N 620 in accordance with detailed drawings provided by ATF.
• Relocate floor vents as necessary per detailed drawings.
• Include new and/or relocate electrical ports and outlets as necessary.
• Relocate lighting and install wall switch as necessary to control lighting in the new office.
• Install Rockwool insulation in walls and cover with 5/8” drywall per detailed drawings.
• Furnish and install Solid Core door per detailed drawings.
• Install Door Hardware per detailed drawings.
• Paint all finishes per specified color. Base and two coats
• Adjust or add sprinkler heads as needed to meet code.
PROJECT SITE REQUIRMENTS
The Contractor shall survey the entire worksite and review existing documentation to be familiar with the existing conditions.
This includes all areas of the building, structure, and site affected by the removal and demolition work, and alterations and new construction work, prior to initiation of design work. During the construction period, the Contractor shall have full use of the designated premises for construction operations, including full use of the indicated work site, limited only by the Government's right to perform work, or retain other contractors to perform work, on portions of the project. The Contractor shall limit the use of the premises to the work areas indicated, and to allow for Government occupancy and public use. The building is to remain fully operational throughout the entirety of the project, with no disruption to tenant operations other than the safety area around the worksite. All work areas must be cleaned at the end of every workday. The work shall be sequenced to minimize disruption to building occupants, visitors, and maintenance activities. To the greatest extent feasible, demolition work should not take place until supplies are on hand to perform new work.
WORK HOURS
Government personnel are scheduled to occupy the building during the following hours on weekdays, Monday through Friday, except for established Government Holidays. All work is required to be performed outside of Government Occupied Hours, after hours and on the weekend(s). Work accomplished outside of Government Occupied Hours shall be performed at no additional cost to the Government. The Contractor shall submit a proposed schedule and gain the COR/PM approval at least 72 hours before proceeding with any work during Government Unoccupied Hours.
Loading Dock - Use of the existing loading dock facilities will be shared with Government activities on a first-come- first-served, wait-your-turn basis. The loading dock is available for the delivery of materials, tools, and supplies between the hours of [7:00] AM to 7:00 PM. Loading dock activities shall be coordinated with the GSA Building Manager a minimum of 72 hours in advance.
Parking - No parking is available on-site. The Contractor shall make their own arrangements for parking off site.
Dumpster - No space is available on-site for a dumpster. Material is expected to be hauled off at the end of each work shift. Use of existing building dumpsters and trash bins is strictly prohibited.

Freight Elevator - A freight elevator is available for use at the project site.
Electrical Circuits Updates - The Contractor shall update the circuit-panel index for every electrical circuit modified as a part of this SOW. The Contractor shall update the panel schedule for all new circuits added and identify all new outlets by indicating the electrical room, panel and breaker identification. All junction boxes shall be labeled with panel and breaker numbers.
QUALITY CONTROL (QC)
The Contractor is responsible for QC, delivery/installation of quality goods and services to the Government, to ensure compliance with this requirement.
QUALITY ASSURANCE (QA)
The contractor shall furnish all necessary equipment and labor and materials to satisfactorily complete the system replacement.
Equipment must be available within 1 week of award. Any deviation must be presented to ATF for consideration. ATF will review the types of material and equipment proposed for the project.
PLACE OF PERFORMANCE
The place of performance is the Bureau of Alcohol, Tobacco, Firearms & Explosives Headquarters Building - 99 New York Avenue, NE Washington, DC 20226
PERIOD OF PERFORMANCE
The period of performance shall be 45 calendar days from the date of issuance of the Notice to Proceed.
CERTIFICATIONS AND INVOICES
The Payment Office listed on the first page of the Award Document will make payment.
Invoices/vouchers will be completed and submitted in accordance with ATF-14 – Electronic Invoicing. The final invoice will be paid upon Government acceptance of the final Deliverable. Please also provide a copy of the invoice to the Contracting Officer.
Upon certification, the COR/CO will forward the invoice/voucher to the Payment Office, as appropriate.
The Invoice/Voucher shall be on the Company’s letterhead and include:
Contract or other authorization number Product or service description.
Quantities received, if applicable.
Date(s) property or services rendered.
Signature, printed name, title, phone number, and mailing address of the receiving official.
POC to discuss invoice issues.
Electronic Invoicing - ATF strongly encourages contractors to invoice electronically. Invoicing electronically saves time, money, and physical storage space for both the Government and the contractor.
Each invoice must be a proper invoice in accordance with FAR 32.905. Contractors able to submit invoices electronically should submit each invoice to FinanceBranch@ATF.gov with a copy to the COTR. Electronic invoices will serve as the official original copy. Any questions may be directed to the ATF Finance Office at (202) 648-7860.
Mandatory Use of Government Electronic Mail. Unless exempted by the CO, in writing, communication after contract award with Government agencies shall ordinarily be transmitted via electronic mail (e-mail).
Final payments will be based on final Government acceptance of all deliverables.
The contractor must submit a copy of the weight tickets along with the monthly invoices to the Building Manager//COR before the invoices can be certified for payment. If the copy of the weight tick is not submitted the invoice will not be paid.

INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE AND BOND
Hard copies of proposal documents will not be provided. The solicitation, all proposal documents, subsequent solicitation amendments, award notification, and all other solicitation related information will be posted to the website https://sam.gov/ under the Contracting Opportunities section.
A bid guarantee is required in an amount not less than 20 percent of the proposal price but shall not exceed $3,000,000. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for receipt of proposals, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then.
The offeror to whom award is made will be required to furnish one bond, a Payment Bond, SF25A, in the penal sum as noted in the General Conditions of the Commodity or Services Schedule Section. Copies of SF25 and 25A may be obtained upon application to the issuing office.
An original, hard copy executed Bid Guarantee (on form SF24) must be mailed to the address below and received by the Contracting Officer within 5 business days of the proposal due date and time shown in Box 13a of solicitation form SF1442 (or as subsequently amended).

OFFEROR SUBMISSION INSTRUCTIONS
This solicitation is set-aside for Service-Disabled Veteran Owned Small Businesses (SDVOSBs). To help determine the eligibility of Prime contractors to participate in this solicitation, the Government will use the Small Business Administration (SBA) small business size standard associated with the NAICS code applicable to this solicitation – see below:

Proposals will be submitted in two separate Volumes/files:
Volume I – Technical Proposal: This volume/file shall be the Technical Proposal and shall include the offeror’s responses for Factors 1 and 2
Volume II – Price Proposal: This volume/file shall be the Price Proposal and shall include the offeror’s responses For Factor 2.
Method of Submission:
Proposal must be submitted via email only. Adobe PDF is the only file format that will be accepted.
Emailed proposal shall be sent to the Marcel Parfenti, Contracting Officer at catalin.parfenti@atf.gov and must be received by the due date and time established in the solicitation.
Emailed files must be no larger than 40MB each. If the file size is greater than 40MB, separate document into multiple files and label files logically and sequentially (for example Volume I - Part 1, Volume I - Part 2, etc.).
NOTE: While 40MB is the maximum message size, things like encryption can add overhead to a message and increase its size, so there are times when a message may need to be under 40MB to be sent successfully to account for this overhead. Also, ensure no special characters (#@$!&^*+) or slashes (/, \) in the document title.
Offerors shall email the following documents to the Contracting Officer by the due date and time shown in Box 13a of solicitation form SF1442 (or if applicable, as subsequently amended).
One (1) copy of their Volume I – Technical Proposal (for example Volume I - Part 1, Volume I - Part 2, etc.) One (1) copy of their Volume II – Price Proposal Late or incomplete proposals will be considered to be nonresponsive.
Proposals shall be identified with a title page that contains the following information:

The first page of the proposal shall include the information identified in provision 52.215-1 paragraph (c)(2). Paragraph (c)(2)
(iii) is modified to read “A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation.” This statement should be placed on the first page of Volume I and II with the contact information.
The proposal shall not exceed the number of pages identified in each factor. A page is considered to be the pdf file equivalent of one side of an 8 - 1/2 inch sheet of paper. Proposals shall contain all applicable information as required by the evaluation factors.

PROJECT DEFINITIONS
For the purposes of this solicitation, Recent, Relevant and Similar are defined as follows:
Recency: “Recent” is defined as construction project/contract work performed in the last five (5) years (between 2019 to 2024).
Projects may be completed or at least 50% complete at time of proposal submission.
Relevancy: “Relevant” is defined as construction project/contract work of a similar size and comparable level of complexity to this project. Relevant size & complexity aspects may include (in descending order of relevance):
Very Relevant: Federal and/or State/local/private construction project at or over $250K in construction costs and contract work of a similar size and comparable level of complexity to this project.
Relevant: Federal and/or State/local/private construction project at or over $100K and below $250K in construction costs and contract work of a similar size and comparable level of complexity to this project.
Somewhat Relevant: Federal and/or State/local/private construction project below $100K in construction costs and contract work of a similar size and comparable level of complexity to this project Not Relevant: Project(s) construction effort involved little or none of the scope and magnitude of effort and complexities described in the solicitation.
Similar: “Similar” is defined as a construction project comparable to value project between $100K and $250K.
Instructions, conditions, and notices to offerors or respondents Volume I – Technical Proposal Factor 1 – Project Experience (limited to 5 pages maximum)
The offeror shall provide a detailed summary for three (3) projects performed within the past five (5) years, similar in scope and complexity of construction project detailed in the solicitation Statement of Work (SOW).
The summary of each project must include the following information:
Provide the project name & title, project location/address, contract number, contract total amount and contract period of performance, point of contact (POC), email address, current phone number.
Provide the original project pricing, period of performance schedule, and detailed description of the project. Identify any changes/ modifications experienced during the project period of performance and include a description of any potential impacts that price and/ or schedule may have on each other related to completion of the project.
Provide a detailed description of the project team (include major partners and/or subcontractors) involved in the performance of the project and explain each firm’s role on the project.
Describe how sustainable design principles were incorporated into the project; indicate to what extent environmental program goals (e.g., Energy Star, Leadership in Energy and Environmental Design) were achieved and how those achievements were recorded into the final documentation.
Describe the project’s safety record (i.e., number of lost time accidents/days).
Describe the understanding of the project, work requirements, prioritize and address activities, any anticipated construction challenges, and approach to respond to emergency situations/requirements.
Describe approach to obtain critical construction materials and techniques to ensure timely delivery and installation.
Describe the understanding of local market conditions such as availability of materials, labor and project labor agreement(s), and potential impacts due to weather (if applicable).
Describe approach for coordination of temporary and permanent utility services. Describe approach for punch list, final acceptance, and project close-out.

Factor 2 – Past Performance (limited to 6 pages maximum, excludes CPARS reports):
The offeror shall provide part performance references for three (3) projects submitted under Factor 1 – Project Experience including project name & title, project location/address, contract number, contract total amount and contract period of performance, project point of contact (POC), email address, current phone number. Additionally, the offeror shall provide information regarding completed Contractor Performance Assessment Reporting System (CPARS) evaluations for each of the three
(3) projects submitted under Factor 1 – Project Experience. The offeror shall clearly identify, by contract number, which projects have interim and final CPARS past performance evaluations. There is no requirement to submit the CPARS reports.
In case were CPARS reports are not available, the offeror shall provide a Past Performance Questionnaire (PPQ, see solicitation attachments) for each of the three (3) projects submitted under Factor 1 – Project Experience AND instruct the references to complete the PPQ and submit it to the Contracting Officer (Marcel Parfenti at catalin.parfenti@atf.gov) by the closing date and time of the solicitation. PPQs received after closing date and time of the solicitation WILL NOT be accepted. In the case of an offeror without a record relevant and recent past performance, it shall affirmatively state in the proposal that it possesses no relevant and recent past performance.
Volume II – Price Proposal Factor 3 – Price (limited to 40 pages maximum)
The offeror shall provide the price for CLIN 0001, which are listed on Block 17, on page 2 of SF1442 form and detailed on Commodity or Services Schedule section.

Evaluation factors for award
The Government will award a Firm Fixed Price contract resulting from this solicitation. Award will be made to the responsible offeror whose proposal conforms to the solicitation requirements and which represents the best value to the Government, price and other factors considered. Competitive best value tradeoff source selection procedures will be used to evaluate proposals IAW FAR 15.101-1
– Tradeoff process.

The Government intends to evaluate proposal(s) and award contract without discussions with offeror(s) (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from technical standpoint and price. This does not preclude the Contracting Officer from holding discussions if it is determined discussions are necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. If so, the competitive range may be limited for efficiency. If competitive range is established, the technical factors will be combined with the total evaluated contract price (Base CLINs/Bids and Option CLINs/Bids) to determine the competitive range.
The evaluation criteria below will be used to evaluate an offeror's proposal with respect to each of the factors and subfactors.
Volume I – Technical Proposal Factor 1 – Project Experience:
Evaluation of Factor 1 – Project Experience:
The proposal must demonstrate the offeror project recent and relevant experience similar to the scope and complexity of construction project as detailed in the solicitation. The offeror should submit a detailed description of three (3) projects considering recency and relevancy defined in Project Definitions section of the solicitation. Additionally, the proposal must demonstrate the offeror’s understanding of the project requirements, complexities, and constraints under which the work will be performed, and established technical approach demonstrating the ability for managing and performance of SOW.
Factor 2 – Past Performance Evaluation of Factor 2 – Past Performance:
The proposal must demonstrate must the offeror's ability to successfully perform project(s) similar in scope and complexity to solicitation. Past performance evaluation will be based on the review of the provided references for three (3) projects, CPARS reports and/or PPQs submitted by references. A follow-up discussion may be conducted with the references provided to the Contracting Officer.
Using CPARS.gov, the Contracting Officer (CO) will access Past Performance reports for the Offeror's core team members (Prime General Contractor, Joint Venture teaming partner and/or mentor-protégé partner. The offeror shall provide DUNS/UEI (Unique Entity Identifier) numbers for itself and each of the Offeror's core team members (Prime General Contractor, Joint Venture, teaming partner and/or mentor-protégé partner) to facilitate the retrieval of recent and relevant CPAR reports for Past Performance evaluation.
If the offeror without a record of relevant and recent past performance, it shall affirmatively state that it possesses no relevant and recent past performance. If offeror lacks relevant and recent past performance AND fails to make an affirmative declaration of the same, the VA will evaluate past performance factor based on information submitted. Beware, this may result in an adverse past performance rating, something other than neutral rating. Reference FAR 15.305(a)(2)(iv) – Proposal evaluation, an offeror without a record of relevant and recent past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.
At the Government's discretion, additional past performance information may be obtained from the Contractor Performance Assessment Reporting System (CPARS) or any other sources available to the Government to be used in this evaluation. Additional reports will be limited to performance examples that demonstrate the offeror’s recent and relevant record of performance that meet the solicitation requirements.
Volume II – Price Proposal Factor 3 – Price Evaluation of Factor 3 – Price:
The price proposal will be evaluated to determine the reasonableness of the offeror's CLIN 0001. Additionally, the Government may evaluate whether the offeror has submitted unbalanced pricing. An unbalanced price is one where the price of one or more contract line items is significantly overstated or understated and which will result in the Government paying an unreasonably high price for contract performance or otherwise present an unacceptable level of risk to the Government. If the Contracting Officer determines that the risk is unacceptable, then the offer can be rejected. A price analysis will be performed in accordance with FAR 15.404-1 – Proposal analysis techniques.

The Contracting Officer is the only individual who can legally commit or obligate the Government to the expenditure of public funds. No cost chargeable to the proposed contract can be incurred before receipt of a fully executed contract or specific authorization from the Contracting Officer.

DOJ-05 Security of Department Information and Systems DOJ-05 (OCT 2023)
I. Applicability to Contractors and Subcontractors Section 2839.102 of the Justice Acquisition Regulation (JAR), (48 C.F.R. § 2839.102), applies to this contract. Accordingly, all contractors are obligated to comply with all applicable DOJ security policies, directives, or guidance documents, including the security requirements in the provisions in this contract clause. This contract clause applies to all contractors and subcontractors, including cloud service providers (“CSPs”), and personnel of the contractors and subcontractors (hereinafter collectively, “Contractor”) that may access, collect, store, process, maintain, use, share, retrieve, disseminate, transmit, or dispose of DOJ Information. The security requirements set forth herein are in addition to those required by the Federal Acquisition Regulation (“FAR”), and any other applicable laws, mandates, contract clauses, DOJ policies, directives or guidance documents and Executive Orders pertaining to the development and operation of Information Systems and/or the protection of Government Information. This clause does not alter or diminish any existing rights, obligations, or liability under any other civil and/or criminal law, rule, regulation, or mandate.
II. General Definitions The following general definitions apply to this clause. Specific definitions also apply as set forth in other paragraphs.
A. Authorization to Operate (“ATO”), as defined in National Institute of Standards and Technology (“NIST”) Special Publication (“SP”) 800-37 Revision 2, is the official management decision given by a senior Federal official or officials to authorize operation of an information system and to explicitly accept the risk to agency
15A00024R00000031 Page 15 of 44 operations (including mission, functions, image, or reputation), agency assets, individuals, other organizations, and the Nation based on the implementation of an agreed-upon set of security and privacy controls.
B. Cloud Computing, as defined in DOJ Order 0904 Cybersecurity Program, is a model for enabling ubiquitous, convenient, on-demand network access to a shared pool of configurable computing resources (e.g., networks, servers, storage, applications, and services) that can be rapidly provisioned and released with minimal management effort or service provider interaction. This cloud model is composed of five essential characteristics, three service models, and four deployment models in accordance with NIST SP 800-145.
C. Covered Contract is any contract, order or other agreement under which the contractor, or a subcontractor at any tier, including a cloud service provider, may access, collect, store, process, maintain, use, share, retrieve, disseminate, transmit, or dispose of DOJ Information (as defined below) in the course of providing a product or service to the Department, with the exception of acquisitions under the micro-purchase threshold.
D. Covered Information System means any information system used for, involved with, or allowing, the processing, storing, or transmitting of DOJ Information under a Covered Contract.
E. Data means recorded information, regardless of form or the media on which it may be recorded. The term includes technical data, computer software, and personally identifiable information (PII) (defined below). The term does not include information incidental to contract administration, such as financial, administrative, cost or pricing, or management information.
F. DOJ Information, as defined in DOJ Order 0904, means any Information that is owned, produced, controlled, protected by, or otherwise within the custody or responsibility of the DOJ, including, without limitation, information related to DOJ programs or personnel. It includes, without limitation, Information (1) provided by or generated for the DOJ, (2) managed or acquired by the Contractor for the DOJ in connection with the performance of the contract, and/or (3) acquired to perform the contract.
G. Information, as defined in DOJ Order 0904, is any communication or representation of knowledge such as facts, data, or opinions, in any form or medium, including textual, numerical, graphic, cartographic, narrative, or audiovisual. This includes any communication or representation of knowledge in an electronic format that allows it to be stored, retrieved, or transmitted.
H. Information System, means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502(8)).
I. Personally Identifiable Information (“PII”), as defined in the FAR 24.101, means information that can be used to distinguish or trace an individual's identity, either alone or when combined with other information that is linked or linkable to a specific individual. It includes but is not limited to common data elements such as names, addresses, dates of birth, and places of employment, to identity documents, Social Security numbers or other government-issued identifiers, precise location information, medical history, and biometric records.
This definition covers all PII that is created by or becomes available to the contractor, including its employees, subcontractors, or affiliates, as a result of performing under this contract. PII, as supplementally defined in DOJ Order 0904, also includes information about an individual maintained by an agency, including, but not limited to, information related to education, financial transactions, medical history, and criminal or employment history and information, which can be used to distinguish or trace an individual’s identity.
J. Private Cloud, as defined in NIST SP 800-145, is the deployment model for cloud infrastructure provisioned for exclusive use by a single organization comprising multiple consumers…
