About this file

This Special Provisions document outlines the procedural requirements for temporary use of railroad property, specifically addressing right-of-way access protocols established by Union Pacific Railroad (UPRR). The document details mandatory prerequisites that must be completed before any entry onto railroad company property, including execution of agreements between the applicant and railroad company, submission of license fees and insurance certificates, clearance from UPRR's Fiber Optic Cable Hotline (800-336-9193), and arrangements with the railroad company's local track maintenance manager for flagging protection if required. A minimum of 48 hours' advance notice is generally required following agreement execution prior to property entry, and all authorizations must be documented in writing with no verbal authorizations permitted. If a contractor is engaged by the licensee to perform agreed-upon activities, the contractor must submit a Contractor's Endorsement Form along with a $500 administrative fee and a General Liability Insurance certificate meeting specified coverage requirements.

All parties entering railroad property must procure Railroad Protective Liability Insurance, which may be obtained through an independent insurance agent or through UPRR's Railroad Protective Liability Insurance program. The railroad company's standard agreement terms are explicitly non-negotiable, and applicants are prohibited from requesting modifications or alterations to any agreement provisions or terms. This requirement applies regardless of whether the licensee or its contractor carries the Railroad Protective Liability Insurance policy, ensuring consistent risk management standards across all temporary use arrangements on railroad property.
