Minnesota’s Commitment to Diversity and Inclusion The State of Minnesota is committed to diversity and inclusion in its public procurement process. The goal is to ensure that those providing goods and services to the State are representative of our Minnesota communities and include businesses owned by minorities, women, veterans, and those with substantial physical disabilities. Creating broader opportunities for historically under-represented groups provides for additional options and greater competition in the marketplace, creates stronger relationships and engagement within our communities, and fosters economic development and equality.

To further this commitment, the Department of Administration operates a program for Minnesota-based small businesses owned by minorities, women, veterans, and those with substantial physical disabilities. For additional information on this program, or to determine eligibility, please call 651-296-2600 or go to the Office of Equity in Procurement home page, at https://mn.gov/admin/business/vendor-info/oep/.

SPECIAL NOTICE: This is a request for proposal. It does not obligate the State of Minnesota to award a contract or complete the proposed program, and the State reserves the right to cancel this solicitation if it is considered in its best interest.

This Solicitation requires proposals to be submitted through the SWIFT Supplier Portal. Please note the security changes below that may impact responders from submitting a timely response.

SWIFT SUPPLIER PORTAL SECURITY CHANGES

There are new security measures that the Minnesota Management and Budget implemented on October 16, 2022. It is a new multi-factor authentication (MFA) to enhance the security of the State of Minnesota Supplier Portal. MFA is an authentication method that requires bidders and suppliers provide two verification factors to log into the SWIFT Supplier Portal. The goal of MFA is to create a layered defense that makes it more difficult for unauthorized system access to occur.

For information about these changes, please refer to the SWIFT Supplier Portal Multi-Factor Authentication FAQ document.

If you have not done so already, please make sure to log into the SWIFT Supplier Portal as soon as possible to get this authentication set up early so there are no issues when submitting a response to an RFP.

You are strongly encouraged to set your MFA during business hours of 8:00 A.M. to 4:00 P.M., Central Time, Monday through Friday. You may experience delay setting your MFA after hours.

SECTION 2 – SUMMARY OF SCOPE

Procurement Overview and Goals.

The purpose of this RFP/Event (solicitation) is to receive responses and award a contract with a vendor to provide Satellite or Cable TV Programming Services for the Department of Corrections (DOC), MN Correctional Facility-Oak Park Heights (MCF-OPH), located at 5329 Osgood Avenue North, Stillwater, MN 55082. Currently MCF-OPH has a Satellite TV provider providing services. The equipment, cabling, and other infrastructure is in place to support the current Satellite TV Service. MCF-OPH currently owns all the equipment and other infrastructure that is necessary to support the current service.

The present system at the facility uses a distribution system based on DirecTV. The current Contract Vendor provides a headend and sets up the signal to the facility. The agency maintains the signal within the institution. The current Contract Vendor provides equipment to inject channels onto the network. Past that point the agency provides all equipment wiring, amplifiers, splitters, and connections.

Currently the facility has 350 drops, but the State reserves the right to add or delete drops as the population changes. Responders are to submit a price per drop per month based upon 350 drops. The award will be based on the total cost of 350 drops per month for the term of the contract.

The successful Responder shall provide, at a minimum, the TV channel selections shown on Attachment H: Desired Channels or approved equal. Responders may propose an alternative channel (“approved equal”) in the spaces provided, but the State reserves the right to make all final determinations as to what constitutes an approved equal. Attachment H must be completed by responders and submitted with their response. The State reserves the right to add or delete channels and adjust the monthly outlet cost accordingly. The successful responder will not be able to drop channels offered without notifying the State in advance. The successful Responder may add additional channels, at no extra cost, with prior approval from MCF-OPH at any time.

If offering an alternate solution to Satellite TV service, the responder must list all equipment (receivers, modulators, demodulators, filters, etc.) cabling, etc. being provided, at no cost to the State, to deliver these services. This equipment is to be detailed and submitted on Attachment G: Narrative Response.

Sample Tasks and Deliverables.

It will be the Contractor’s responsibility to access the current equipment previously installed and determine if it will be fully functional going forward. It will be the Contractor’s and MCF-OPH’s responsibility to maintain all equipment required for a fully operational system. It will be the Contractor’s responsibility to provide the television programming service and the Facility’s responsibility to maintain the equipment at State expense for the life of the Contract. All equipment parts, supplies, wiring, installation, labor costs, maintenance, freight, and incidental costs are to be detailed on Attachment I: Price Schedule.

Maintenance of the system components will be the responsibility of the Contract Vendor. System reliability is essential to the facility.

SECTION 3 – PROPOSAL INSTRUCTIONS AND ADDITIONAL INFORMATION

The term of this contract is anticipated to be from January 1, 2025, to December 31, 2026, with the option to extend up to an additional three (3) years in increments determined by the State.

Or The term of this contract is anticipated to be from January 1, 2025, to December 31, 2030, with no option to extend.

Estimated Amount.

The estimated total dollar value of the contract for one year is $55,000.00. However, this shall not be construed as either the minimum or maximum amount. It shall also be understood and accepted by the responder that any quantities shown in this solicitation are estimated quantities only and impose no obligation upon the State, either minimum or maximum.

Site Visit Responders are encouraged to attend the OPH site visit, but it is not required to be considered for an award. The site visit will take place on September 11, 2024, at 10:30 AM. Responders that are unable to attend the OPH site visit shall be held to the same standard of awareness as responders that attend the OPH site visit. A responder’s inability to attend the OPH site visit shall not relieve the responder of the requirement to comply with the mandatory solicitation and contract terms. Deadline to submit Attachment J will be September 4, 2024.

Registration and Background Checks.

To be admitted into MCF-OPH, interested parties will need to register and submit documentation provided in Attachment J, MCF-OPH Security Packet for Facility Access. Fill out and submit all documents, along with a legible copy of driver’s license, to: sarah.m.costello@state.mn.us. Responders that do not register for the Site Visit will not be admitted into the facility. There is a 3- to 4-day turnaround time for background checks to be completed.

All visitors must pass a security check (e.g., a metal detector, hand-held wand, or pat search) before entering the secure perimeter. This provision is not intended to prevent responders from seeking guidance from state procurement assistance programs regarding general procurement questions.

If a Responder discovers any significant ambiguity, error, conflict, discrepancy, omission, or other deficiency in the solicitation, please immediately notify in writing the contact person detailed above of such error and request modification or clarification of the document.

Additional Tasks or Activities.

Responders are encouraged to propose additional tasks, activities, or goods above and beyond the scope of what is requested in this solicitation if they will substantially improve the results of this procurement. Any costs associated with these additional tasks, activities, or goods should be clearly marked and separated from costs associated with the tasks, activities, or goods specifically requested under this solicitation. Because cost is a factor in the evaluation of responses to this solicitation, failure to separate costs for additional tasks, activities, or goods may result in those costs being included in a responder's cost proposal and result in a lower cost score for that proposal.

Dispute Resolution Procedures.

Any issue a responder has with the RFP document, which includes, but is not limited to, the terms, conditions, and specifications, must be submitted in writing to the contact person for this solicitation prior to the solicitation opening due date and time. Any issue a responder has with the Contract award must be submitted in writing to the contact person for this solicitation within five (5) business days from the time the intent to award or the Contract award date is made public. This public notice may be made by any of the following methods: notification by letter or email, posted on the OSP website, https://mn.gov/admin/osp/, or electronic notification by our electronic procurement system, SWIFT. In the event Responder fails to comply with this provision, Responder agrees that it will not seek to enforce terms and conditions of any such agreement against the State. Further, failure to provide any of the pertinent documents upon request may result in the State not agreeing to sign any additional documents, rejecting your response, or cancelling the award.
