About this file

This is a Sole-Source Determination Memo issued by the Oregon Department of Human Services (ODHS) Office of Contracts & Procurement for the Aging and People with Disabilities (APD) division. The document justifies a sole-source procurement for specialized Adult Foster Home (AFH) Specific Content and Access Pathway Training from NurseLearn (Schole Edu LLC). The contract will provide online training for registered nurses serving APD-licensed adult foster homes and training for AFH providers regarding the nursing role in AFH operations. The vendor will update 10 NurseLearn modules with case studies reflecting common AFH resident needs, create one new course, update assessments to focus on AFH-specific learning, and create a dedicated access pathway to all AFH-related modules. The estimated total contract value is $320,000. Protests of this sole-source determination must be submitted within seven calendar days after the first date notice is posted on OregonBuys, directed to the Office of Contracts and Procurement, ATTN: Sharon M. Landis, via mail, fax, email, or hand delivery.

The sole-source justification is made pursuant to ORS 279B.075(2)(a), establishing that efficient utilization of existing goods requires acquisition of compatible goods or services from only one source. Market research findings demonstrate that NurseLearn is the only vendor integrating Oregon- and setting-specific regulatory requirements, clinical nursing best practices, RN delegation requirements, care scenarios, cultural competence, and person-centered service delivery into training modules. NurseLearn's CEO, Cynthia McDaniel, developed Oregon's Contract Nursing Program, worked as an AFH trainer for 10 years, and assisted in developing AFH training for what is now APD, providing specialized expertise unavailable from competing vendors. A 2022 competitive procurement for similar nurse training for community-based care facilities received only one bid submission from NurseLearn. The contract specialist notes that NurseLearn offers the only certificate program in community-based care nursing in the United States and represents the sole source capable of meeting the specialized requirements for AFH nursing education tailored to Oregon-specific regulatory and operational standards.

Description of goods or services: Adult Foster Homes Specific Content and Access Pathway Training

1. Background: This sole source justification applies to the purchase of specialized RN training:

a) This contract will provide specialized online training for RNs who serve APD-licensed adult foster homes as well as training for AFH providers who require a clear understanding of the nursing role in the context of operating an AFH. Future contracts contemplated are focused on maintaining access to NurseLearn for AFH-contracted nurses and AFH providers as well as updating content if or when there are changes to Oregon Administrative Rules or best practices that impact nursing within and AFH. This training will promote resident safety, regulatory compliance, and delivery of high quality, person-centered services.

b) Under this contract, the vendor will 1) update 10 NurseLearn modules with case studies that reflect common AFH resident needs, service delivery in the AFH setting and AFH-specific rules; 2) create one new course; and 3) update the assessments to focus on AFH-specific learning; and 4) crate a dedicated access path to all AFH-related modules.

c) APD requires a vendor with direct nursing experience within APD-licensed AFHs, direct experience working with AFH providers, and experience interpreting and applying Oregon-specific RN delegation rules in serving consumers who reside in AFHs. The need for comprehensive training tailored the requirements of nursing care within AFHs is critical to ensure safe, high quality service delivery in APD-licensed AFHs. In 2022, APD went through a competitive procurement for similar work focused on nurse training for CBC facilities (assisted living and residential care facilities); the only bid that was submitted was from NurseLearn. The work in this contract is even more specialized. NurseLearn is the only vendor that integrates Oregon- and setting-specific regulatory requirements, clinical nursing best practices, RN delegation requirements, care scenarios, cultural competence, and person-centered service delivery into each module. Additionally, NurseLearn is the first and only program in the US that offers a certificate in community-based care nursing. Cynthia McDaniel, NurseLearn’s CEO, helped develop Oregon’s Contract Nursing Program (what is now the LTCCN program), worked as an AFH trainer for 10 years, and assisted in development of the AFH training for SPD (what is now APD) – bringing unparalleled expertise to this work.

Agency reserves the right to purchase additional goods, services to include on-call maintenance, preventative maintenance, repair (unless available on DAS price agreement), or training.

3. Written findings of fact (market research):

The findings below must include factual information supporting the determination that meet the sole source requirement in statute.

Pursuant to ORS 279B.075, Agency must conduct market research that supports the assertion that there is only one source that can provide the goods or services. Market research includes utilization of the internet, trade journals, agency vendor lists, professional organizations, studies, catalogs/industrial periodicals, vendor sources, yellow pages, etc.

For information technology contracts, any ownership or proprietary issues should be fully addressed with written documentation to support facts. [Attach supporting documentation, if applicable] Agency must select at least one of the findings and prepare the determination as it specifically relates to the good or service being procured. More than one finding can be addressed. The findings are as follows:

|X| Pursuant to ORS 279B.075 (2)(a): Provide findings supporting the determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source. Findings from an internet search using the term ‘Adult Foster Home RN training’ returns:

General information about AFHs trainings and general information about becoming an AFH provider:

Broadening the scope to community-based care nursing returns options that are focused on assisted living and residential care providers (which are licensed under different OARs) along with NurseLearn results.
