About this file

This document is a Request for Information (RFI) from the U.S. Army Space and Missile Defense Command (USASMDC) regarding the follow-on Kwajalein range support services contract. The RFI seeks industry feedback on acquisition options, contract requirements, and potential contract structure for supporting operations at the Regan Test Site (RTS) in the Marshall Islands. Key highlights include a potential contract release in the first quarter of Fiscal Year 2027, anticipated minimum SECRET security clearance requirements, and an emphasis on incorporating Marshallese workforce with specific background check procedures.

The document explicitly notes that Base Operations Support (BOS) is no longer part of this contract's scope, though limited base operations-type support functions necessary for range operations may be included. The government is seeking industry input on contract vehicles, evaluation factors, small business participation, and workforce sustainment strategies. Anticipated contract requirements involve supporting range operations in a challenging remote environment, with specific challenges including operating equipment in a corrosive setting, managing remote logistics, addressing aging infrastructure and technology, and attracting and retaining key talent. Interested parties are advised to monitor SAM.gov for future notices regarding the Kwajalein range requirements.

# QUESTION to GOVERNMENT from INDUSTRY GOVERNMENT RESPONSE to INDUSTRY

1 The RFI states that all employees must have a minimum of a Secret clearance. Under the RETS contract, the government expects that Marshallese employees are incorporated into the workforce. Does this guidance apply to the Marshallese workforce, does the guidance imply that the Marshallese workforce will be expected to receive Secret clearance under the follow-on contract, or is it the expectation of the government that only US citizens will be allowed to work on the RETS follow on?

Marshallese will be authorized to work on the follow-on USASMDC Kwajalein range contract, but are not required to have a Secret clearance. However, there are procedures Marshallese will have to go through to be able to work on the follow-on range contract. See below:

• Prior approval to use or employ non-U.S. citizens on a contract must be obtained from the responsible contracting officer, USASMDC Regan Test Site Security Manager, and USASMDC Foreign Disclosure Officer.

• For non-U.S. citizens on Kwajalein, the contractor will have to initiate a background check from the Host Country law enforcement office (or equivalent) that verifies that the individual is cleared from their country of residence (i.e., no outstanding warrants, not on a watch list, not on any sexual offender list, etc.). The background check will also include a fingerprint Special Agreement Check and confirmation that individual is not on the Kwajalein Garrison permanent bar list.

• Access to classified information is restricted to only U.S. Citizens who possess appropriate clearance, access, and need-to-know.

2 The RFI does not mention weather services at RTS, but does imply that nearly all other services across the Garrison and RTS may be combined as a part of the RETS follow-on contract. Should we expect that weather services may be a part of the follow-on contract or will they be kept separate?

Scope Update: Thank you for the question. Please note that Base Operations Support (BOS) requirements are not part of the follow-on USASMDC Kwajalein range requirement. Any BOS-related functions referenced in this question are not within the scope of the follow-on USASMDC Kwajalein range requirement and will not be addressed in the forthcoming USASMDC Kwajalein range requirements solicitation. It is anticipated that the Government will define the remaining scope and requirements for the USASMDC Kwajalein range requirement (which may include limited BOS requirements in support of the range) in the draft RFP and subsequent SAM.gov postings.

3 Would the Government consider hosting a virtual Industry Day to accommodate vendors unable to travel to Alabama, thereby promoting broader participation and engagement?

For this event, the Government will not and did not host a virtual option. While unlikely, the Government may consider livestreaming for future events, if appropriate.

4 Would the Government consider issuing support services as separate task orders, potentially set aside for small businesses or 8(a) firms, to encourage equitable contracting opportunities and maximize small business participation?

Yes. The Government will consider all approaches that promote equitable contracting opportunities and maximize small business participation. All decisions will be made in alignment with the overall acquisition strategy and mission requirements.

5 Performance Metrics: Will the Government be providing specific, measurable performance standards and KPIs for all support services (e.g., system availability, preventative maintenance compliance, housing/dining satisfaction levels)?

Yes. It is anticipated that performance metrics will be used where practicable and will be identified in the solicitation.

Industry Feedback & Scope Update

The Government thanks industry for the thoughtful feedback provided in response to the RFI and during the Industry Day exchange. Please note due to recent changes in the organizational structure and command relationships on Kwajalein, Base Operations Support (BOS) is no longer within the scope of this future U.S. Army Space and Missile Defense Command (USASMDC) requirement. Future Kwajalein BOS requirements are not expected to be pursued under the follow-on USASMDC Kwajalein range requirements acquisition.

However, certain limited base-operations-type support functions that are necessary to enable range operations are still anticipated. These requirements will be identified in a follow-on RFI with a more focused scope (excluding broader BOS requirements).

The follow-on USASMDC range-focused RFI is anticipated to be posted within 90 calendar days of the RFI’s inactive date of November 19, 2025 (no later than February 17, 2026) on SAM.gov. It is anticipated that future Kwajalein BOS requirements will be pursued under a separate, standalone acquisition. Interested parties should monitor SAM.gov for separate notices regarding future USASMDC Kwajalein range requirements and future

Kwajalein BOS requirements, respectively. In support of the refined USASMDC range requirements acquisition, the SAM.gov special notice that led to the September 2025 Kwajalein Industry Day and RFI may be amended or cancelled and replaced with a new notice.

Note: Industry feedback/comments/questions pertaining to future Kwajalein BOS requirements are not provided in order to prevent confusion with the refined scope.

The following questions and answers and industry feedback are provided for market-research and planning purposes only in accordance with FAR 15.201. It is anticipated that the Government will define the remaining scope and requirements for the USASMDC Kwajalein range requirement (which may include limited BOS requirements in support of the range) in the draft RFP and subsequent SAM.gov postings.

8 Other Direct Costs: Can the Government clearly provide what all logistical items will be reimbursable to support the logistical requirements for contractor personnel such as travel to and from Kwajalein Atoll (Transition In and Transition Off) the contract, lodging, cost of living allowance, medical, family accompanied tour authorized, etc.? Will this be a plug number provided by the Government for the proposal or will Offerors have to account for these items in their price submission?

As applicable to the follow-on USASMDC Kwajalein range requirement, it is anticipated that further information on reimbursable logistics (e.g., travel, lodging, COLA, medical, accompanied tours) and any plug numbers (if available) will be provided in the draft RFP. Offerors shall price in accordance with the solicitation.

9 Recommend clarification of minimum clearance requirements by functional area. As applicable to the follow-on USASMDC Kwajalein range requirement, it is anticipated that the minimum security clearance for all personnel is SECRET. It is also anticipated that TOP SECRET security clearances will be required for those personnel working with Sensitive Compartmented Information (SCI), Special Access Programs (SAP), working in SCI/SAP Facilities, or working on associated TOP SECRET and SAP networks/information systems (JWICS, ASEP, etc.)

• Novel approaches to managing aging infrastructure.

• Aging sensors, legacy technology, limited manufacturers.

• Attracting and retaining key talent.

• Better communication amongst all stakeholders on the island.

13 What has the Gov learned from the incumbent contract that will influence this procurement going forward?

The Government has considered best practices from previous contracts and has improved the requirement; in response to future SAM.gov special notice(s) in support of the follow-on USASMDC Kwajalein range requirement, the Government will consider contractor submitted recommendations as well.

14 What is the current anticipated release of a final RFP? It is anticipated (for planning purposes only) that the final RFP for the follow-on USASMDC Kwajalein range requirement will be issued in the first quarter of Fiscal Year 2027.

6 Local/OCONUS Regulatory Compliance: Are there unique host-nation labor or environmental compliance requirements that bidders should be aware of, especially regarding the employment of local nationals and management of hazardous materials?

PART 1: Yes, the USAKA Environmental Standards (UES) is an agreement between the Government of the Republic of the Marshall Islands (RMI) and the U.S. Government authorized by the 1986 Compact of Free Association and mandated under Section 161(a)(1) of the Compact as Amended (2003). The UES applies to all U.S. Government activities at USAKA and all USAKA activities within the RMI. Link for current document:

https://www.smdc.army.mil/Portals/38/Documents/DCSENG/General_Documents/UES_17_Edition.pdf

PART 2: Yes, there are unique host nation labor compliance requirements. The stated purpose of the Marshall Islands Employment Equal Opportunity Act (2017) is "to ensure that all employees of a person or other entity doing business in the Republic of the Marshall Islands are treated equally in regard to obtaining employee benefits." In accordance with Article IV, paragraph 4, of the Status of Forces Agreement (SOFA), this law does not apply to U.S. personnel or third country contractor personnel employed by the U.S. Armed forces or their contractors. The law requires that any person or other entity doing businesses in the RMI must offer all RMI employees the same type of employee benefits that any other employee in the RMI receives. The law itself does not require that any benefits be offered to any employee. Article IV, paragraph 1(a) of the SOFA requires employment preference be given to citizens of the RMI possessing requisite skills and qualifications. Article IV, paragraph 2, of the SOFA requires coordination with the RMI via the Government of the United States prior to employment of third country personnel. The Military Use and Operating Rights Agreement (MUORA), Article VIII, paragraph 2, states U.S. contractors shall comply with laws of general applicability in the Republic of the Marshall Islands regarding minimum wages, provided such minimum wages do not exceed the minimum wage prevailing in the United States. Paragraph 3 notes U.S. contractors shall provide equal pay for equal work.

Offerors are responsible for complying with applicable host-nation labor and environmental requirements consistent with the Compact, SOFA, MUORA, and the solicitation.

Also, MUORA Article VIII includes provisions dealing with (i) “grandfathering” of wages of local hire personnel employed by US contractors; and (ii) equal pay for equal work in the employment of local hire personnel. Local hire personnel is defined in Article I, Section 2(f), of the SOFA, as citizens and nationals of the Republic of the Marshall Islands, who are employed in the Marshall Islands by the Armed Forces of the United States or US contractors. In implementation of these provisions, the contractor shall ensure that local hire personnel employed on the effective date of the Compact of Free Association (COFA) shall continue to receive wages no less than wages paid as of the effective date of the COFA October 21,1986. Wages, for the purpose of insuring “grandfathering” of wages, is defined as (a) actual base pay; (b) employee fringe benefits e.g., vacation and sick leave, group insurance, hazardous pay, pension, and holidays; and (c) overtime pay as required by the Contract Work Hours and Safety Standards Act (CWHSSA). Further, grandfathered Marshallese employees must receive a wage, which is not less than the wage paid for equal work to US/third country employees. In contrast, local hire personnel newly employed after the effective date of the COFA may be paid a wage consistent with the minimum wage laws of the Marshall Islands, provided the minimum wage does not exceed the prevailing minimum wage in the US, and the wage provides equal pay for equal work among such local hire personnel.

Further, locally hired non-grandfathered Marshallese employees must receive a wage which is not less than the wage paid for equal work to any US/third country employees who are hired in the RMI; however, they may be paid a wage which is less than the wage(s) paid for equal work to grandfathered Marshallese employees and to US/third country employees hired outside the RMI. Note that if a grandfathered worker has a “break-in-service” and has not been continuously employed by the US or a US contractor at USAKA or any predecessor organization they are no longer eligible for grandfathered status.

The following questions and answers and industry feedback are provided for market-research and planning purposes only in accordance with FAR 15.201. They do not constitute a solicitation, a commitment by the Government, or direction to proceed. Final requirements, contract type(s), evaluation factors, Government-furnished property/equipment, security requirements, and schedule—if any—will be defined only in an issued solicitation and its amendments (the Government's responses to industry questions are based upon best know information at this time and are not binding on the Government). The Government may update or revise information at its discretion and will communicate changes via SAM.gov.

15 Is the Gov considering a specific contract vehicle for this Opportunity? The Government has not yet made a final decision regarding the contract vehicle for the follow-on USASMDC Kwajalein range requirement; all options remain under consideration. The final acquisition strategy will be determined based on mission requirements, industry input, and an approach that provides the best value to the Government.

16 What evaluation factors are expected to be most important to the Gov? For the follow-on USASMDC Kwajalein range requirement, at this time an acquisition strategy has not been approved and evaluation factors not developed; the Government will seek industry input at the appropriate time.

17 Does the Gov plan on establishing Small Business goals for Prime bidders at Kwaj? Will subcontracting plans be required?

Yes. For the follow-on USASMDC Kwajalein range requirement, it is anticipated that the Government will establish Small Business goals for prime contractors. Also, large business prime contractors will be required to submit and adhere to Small Business Subcontracting Plans as outlined in Federal Acquisition Regulation Subpart 19.7; these plans will be reviewed to ensure meaningful opportunities for small businesses.

Requirements regarding this subject will be provided in the RFP.

18 Does the Gov encourage teaming or Joint Ventures for this opportunity? Yes. However, as with all acquisitions, for the follow-on USASMDC Kwajalein range requirement, teaming arrangements and joint ventures will be a industry business consideration as it relates to the best solution for a potential offeror to meet the USG's solicitation requirements.

19 Will the Government discuss on site housing availability for the contract force? Are there trends or plans for increased capacity? Will there be allocations for ‘accompanied’ contract workers?

For the follow-on USASMDC Kwajalein range requirement, it is anticipated that information regarding housing availability, trends and allocations (if any), etc. will be provided for informational purposes as part of the next Industry Day announcement (that is undetermined at this time) and draft RFP.

20 Will the RFP include any specific Wage Determination Document(s) for the Marshallese work force?

For the follow-on USASMDC Kwajalein range requirement, the solicitation will not include U.S. Department of Labor wage determinations for Marshallese workers. Service Contract Labor Standards (FAR 22.10) and Davis- Bacon Act requirements generally apply within the United States and specified territories; applicability to Kwajalein will be addressed in the solicitation. However, note that there are unique host nation labor compliance requirements that will follow the Marshall Islands Employment Equal Opportunity Act.

21 Does the Gov plan on providing a Seniority list for the local national workforce? For the follow-on USASMDC Kwajalein range requirement, it is anticipated that there will be certain contract labor categories that will need to be filled with local nationals and it is the Government's intent to provide the labor categories that would need to be on island to ensure no breaks in service; it is anticipated that this list will be provided with the draft RFP.

22 Are there specific labor laws or nationality restrictions imposed by the Host country or the US Gov?

Yes, there are specific labor laws, nationality restrictions and/or unique host nation labor compliance requirements. The Marshall Islands Employment Equal Opportunity Act requires that any entity doing businesses in the RMI must offer all RMI employees the same type of employee benefits that any other employee of that entity in the RMI receives. The Status of Forces Agreement or SOFA requires employment preference be given to citizens of the RMI possessing requisite skills and qualifications. The SOFA requires coordination with the Government of the Republic of the Marshall Islands via the Government of the United States prior to employment of third country personnel. Finally, contractors must comply with RMI minimum wage requirements and shall provide equal pay for equal work.

23 Is the Gov anticipating a fixed price, cost reimbursement, or hybrid contract? For the follow-on USASMDC Kwajalein range requirement, at this time an acquisition strategy has not been approved; the Government will seek industry input at the appropriate time.

24 Can the Gov confirm the anticipated scope of the BOS portion of work? Based on our understanding, there are key functional areas such as “On Condition Cyclic Maintenance” [OCCM Maintenance]; Retail Stores; and Port/Stevedoring that are not mentioned in the initial information provided.

25 How will this contract be funded between IMCOM and SMDC? Funding sources and interagency allocations will be addressed through internal Government processes and are not germane to this market-research exchange.

26 Recommend that the Government acknowledge NAICS 561210, Facilities Support Services in their final PWS as an acceptable NAICS code for PP and experience as it is directly related to the BOS requirements.
