Section I - Introduction
Overview
A. Agency Information: The U.S. Railroad Retirement Board (RRB) is an independent Federal agency that administers a retirement and survivor benefit program for railroad employees and their families. The RRB was established by the Railroad Retirement Acts of 1937 and 1974. Its benefit program was the forerunner of the more familiar Social Security system. The Railroad Retirement system is unique inasmuch as it is the only federally administered benefit program covering a single private industry. The RRB also adminis-ters the Railroad Unemployment Insurance Act which provides unemployment and sickness benefits to railroad employees. The RRB headquarters is located in Chicago, IL. The RRB has approximately 860 employees nationwide.
B. Objective: The objective of this solicitation is to procure jewelry and non-jewelry career service recognition award items for RRB employees based on their years of service, from 15 through 50 years of either RRB service or overall Federal service. The jewelry and non-jewelry career service awards will be provided to the RRB Headquarters located at 844 North Rush Street, Chicago, IL 60611-1275. Services shall be for a base year with four (4) option years. The Statement of Work (SOW) in Section III below provides the requirements for providing the service awards to the RRB for the RRB career service recognition program.

Section III - Statement of Work
Statement of Work
A. Award items - The contractor shall provide both jewelry and non-jewelry service award recognition items in support of the RRB career service recognition program for 15 through 50 years of either RRB service or overall Federal service. The contractor shall provide a number of options and selections of quality jewelry and non-jewelry items, as listed in Attachment A with corresponding pictures in Attachment B, such that the career service recognition awards can be distinguished at five year intervals beginning at 15 years of service and continuing, in five-year increments, to 50 years of service. With each five year increment, the contractor shall provide a distinguishable option of both jewelry and non-jewelry items (e.g. 15 year jewelry and non-jewelry items must be distinct and separate from jewelry and non-jewelry item offered at 20 years of service).
B. Engraving - The contractor shall provide digital engraving services for non-jewelry items. Samples of letter, character and num-ber type style for engraving of the service awards shall be provided after award. For glass, crystal or pewter items, the contractor shall provide engraving on the items directly. For other non-jewelry items, the contractor shall provide a separate, unattached, solid brass engraved plate or have the ability to engrave the plate provided with the manufacturer’s product, so that the plate can be later af-fixed by the RRB employee receiving the service award, if desired. Engravings must include the correct spelling of the employee’s name, (e.g. Jane D. Smith) number of years of service (e.g. 20 years of service), the full date the years of service were accomplished (e.g. May 1, 2016), and a brief phrase characterizing the service (Federal or RRB years of service). Pictures and descriptions of the service awards are provided in Attachments A and B.
C. Inclusion of the RRB Seal - Some of the non-jewelry items, including the loving cup, prism award and vases, shall include an RRB seal imprinted onto the item. For the jewelry items, with the exception of the watches (to include the pocket watch), the con-tractor shall affix the die cast RRB seal onto the item. For the lucite block, the contractor shall embed the RRB seal. Additional de-tails on the embedding and imprint as well as a sample of the lucite block are included in Attachments A and B.
The die cast(s) of the RRB seal shall be given to the firm awarded the contract resulting from this RFQ. The die cast shall remain the
Document Number: RRB16Q0004 PROCESSED Page 8 of 34 sole property of the RRB and be surrendered upon request, or at the end of the contract term.
D. RRB vs. Federal Years of Service - In addition, the contractor must be able to account for an employee’s request to distinguish between RRB years of Federal service or total Federal service for jewelry items. The foundation and inlay of each service award jew-elry item shall be interchangeable white and yellow gold depending upon whether it is a Federal service award or a RRB service award. See below for specific information:
If the Award is based on: Then:
RRB Years of Service The background is white gold and the inlay is yellow gold.
Federal Years of Service The background is yellow gold and the inlay is white gold.
For non-jewelry items, the contractor shall distinguish between RRB years of service or total Federal service on the engraved brass plate, or directly on the item (e.g. vases, pewter items, lucite block etc.) where applicable based on the information provided by the RRB. It is only on the Federally recognized items that the wording Federal is used (i.e., 20 Years Federal Service). For RRB years of service, only the wording "years" is used (i.e., 20 Years).
E. The Contractor shall deliver items by the date/dates set forth in the contract and each subsequent contract modification. The RRB plans to award a contract for the base year in June which shall include the purchase of approximately 300 jewelry and non-jew-elry items. The RRB plans to modify the contract in the first quarter of calendar year 2017 to purchase a smaller quantity of approx-imately 20 jewelry and non-jewelry items. The RRB requires all service awards be delivered to the RRB within 60 calendar days from the date the contract or contract modification is issued to the contractor for the purchase of the service award items.
The Contractor shall ensure that all service award items delivered to the RRB are of quality material and working in accordance with manufacturer specifications, correctly engraved and when appropriate, contains a separate, unattached engraved brass plate (e.g.
names spelled correctly, correct number of years of service, correct level of recognition – e.g. RRB service as compared to Federal service), without defect (e.g. unscratched or damaged), correctly labeled (on the outside of each individual item – which would in-clude the employee’s name, the item name, and years of service), organized by like items (e.g. all 20 year vases are shipped together and labeled as such) and shipped to the RRB Headquarters facility in a convenient manner for ease of distribution to RRB employees.
F. Definitions - The words listed below were included in Paragraph C of this Statement of Work, and the RRB is providing the be-low definitions for further clarification.
Embed - to insert the RRB seal inside or within the service award Imprint - to place an image of the RRB seal on the surface of the service award Die cast - a mold of the RRB seal that is a solid, metal piece and is affixed onto the service award - mold varies in size depending on the type of service award
Section IV - General Terms and Conditions
52.216-4 Economic Price Adjustment - Labor and Material (Jan 1997)
(a) The Contractor shall notify the Contracting Officer if, at any time during contract performance, the rate of pay for labor (including fringe benefits) or the unit prices for material shown in the Schedule either increase or decrease. The Contractor shall furnish this no-tice within 60 days after the increase or decrease, or within any additional period that the Contracting Officer may approve in writing, but not later than the date of final payment under this contract. The notice shall include the Contractor's proposal for an adjustment in the contract unit prices to be negotiated under paragraph (b) of this clause, and shall include, in the form required by the Contracting Officer, supporting data explaining the cause, effective date, and amount of the increase or decrease and the amount of the Contract-or's adjustment proposal.
(b) Promptly after the Contracting Officer receives the notice and data under paragraph (a) of this clause, the Contracting Officer and the Contractor shall negotiate a price adjustment in the contract unit prices and its effective date. However, the Contracting Officer may postpone the negotiations until an accumulation of increases and decreases in the labor rates (including fringe benefits) and unit prices of material shown in the Schedule results in an adjustment allowable under paragraph (c)(3) of this clause. The Contracting Of-ficer shall modify this contract (1) to include the price adjustment and its effective date and (2) to revise the labor rates (including fringe benefits) or unit prices of material as shown in the Schedule to reflect the increases or decreases resulting from the adjustment.
The Contractor shall continue performance pending agreement on, or determination of, any adjustment and its effective date.
(c) Any price adjustment under this clause is subject to the following limitations:
(1) Any adjustment shall be limited to the effect on unit prices of the increases or decreases in the rates of pay for labor (including fringe benefits) or unit prices for material shown in the Schedule. There shall be no adjustment for-

(i) Supplies or services for which the production cost is not affected by such changes;
(ii) Changes in rates or unit prices other than those shown in the Schedule; or
(iii) Changes in the quantities of labor or material used from those shown in the Schedule for each item.
(2) No upward adjustment shall apply to supplies or services that are required to be delivered or performed before the effective date of the adjustment, unless the Contractor's failure to deliver or perform according to the delivery schedule results from causes beyond the Contractor's control and without its fault or negligence, within the meaning of the Default clause.
(3) There shall be no adjustment for any change in rates of pay for labor (including fringe benefits) or unit prices for material which would not result in a net change of at least 3 percent of the then-current total contract price. This limitation shall not apply, however, if, after final delivery of all contract line items, either party requests an adjustment under paragraph (b) of this clause.
(4) The aggregate of the increases in any contract unit price made under this clause shall not exceed 10 percent of the original unit price. There is no percentage limitation on the amount of decreases that may be made under this clause.

RRB.A.01 A. General RRB Provision-1.Technical Direction
Performance of the work under this contract shall be subject to the technical direction of the Contracting Officer Representative (COR). The term “technical direction” is defined to comprise the following:

(c) Review and, where required by the contract, approve technical reports, drawings, specifications and technical information to be de-livered by the Contractor to the Government under this contract.
(d) Technical directions must be within the general scope of work stated in the contract. If, in the opinion of the Contractor, any instruction or dir-ection issued by the COR is within one of the categories as defined in (1) through (4) above, the Contractor shall not proceed but shall notify the Contracting Officer within five (5) working days after receipt of any such instruction or direction and shall request the Con-tracting Officer to modify the contract accordingly. Upon receiving such notification from the Contractor, the Contracting Officer shall issue an appropriate contract modification or advise the Contractor in writing that, in his opinion, the technical direction is within the scope of this Section and does not constitute a change under the Changes article of the contract. 52.217-8 Option to Extend Services (Nov 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. 52.209-5 Certification Regarding Responsibility Matters (Oct 2015)
(a)(1) The Offeror certifies, to the best of its knowledge and belief, that--
(i) The Offeror and/or any of its Principals--
(A) Are __ are not __ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have __ have not __, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, viol-ating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);
(C) Are __ are not __ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision;
(D) Have __, have not __, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.
(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally de-termined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples.
Document Number: RRB16Q0004 PROCESSED Page 11 of 34
(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court re-view of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice un-der I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further ap-peal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exer-cised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has __ has not __, within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary manage-ment or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business seg-ment; and similar positions).
This Certification Concerns a Matter Within the Jurisdiction of an Agency of the United States and the Making of a False, Fictitious, or Fraudulent Certification May Render the Maker Subject to Prosecution Under Section 1001, Title 18, United States Code.
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility.
Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to ex-ceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when mak-ing award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies avail-able to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
(End of provision)
52.216-19 Order Limitations (Oct 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $50.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor--
(1) Any order for a single item in excess of $10,000.00;
(2) Any order for a combination of items in excess of $60,000.00; or
(3) A series of orders from the same ordering office within 15 days that together call for quantities exceeding the limitation in para-graph (b)(1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regula-tion (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
Document Number: RRB16Q0004 PROCESSED Page 12 of 34
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limita-tions in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
(End of clause)
52.216-18 Ordering (Oct 1995)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from June 1, 2016 through May 31, 2021.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.
(End of clause)
52.216-22 Indefinite Quantity (Oct 1995)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quant-ity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of or-ders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple loca-tions.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Con-tractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Con-tractor shall not be required to make any deliveries under this contract after May 31, 2021.
(End of clause)
52.232-19 Availability Of Funds For The Next Fiscal Year (Apr 1984)
Funds are not presently available for performance under this contract beyond September 30, 2016. The Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for con-tract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond September 30, 2016, until funds are made available to the Contracting Officer for performance and until the Contract-or receives notice of availability, to be confirmed in writing by the Contracting Officer.
(End of clause)
