About this file
This document is Addendum #2 for Request for Qualifications (RFQu) 25-057-RM issued by the Kissimmee Utility Authority (KUA) and the Board of County Commissioners of Osceola County, Florida, with funding from the U.S. Economic Development Administration. The project involves professional engineering consulting and project inspection services for constructing two 69kV underground transmission circuits. The due date for proposal submissions has been extended to Tuesday, August 5, 2025 at 2:00 p.m. local time, with a one-time week-long extension granted in response to a bidder's request.
The addendum addresses multiple clarifications and modifications to the original RFQ, including removing page count limitations for bidder responses, eliminating restrictions on the number of resumes that can be evaluated, and providing guidance on various technical and legal aspects of the project. KUA has indicated that design criteria documents will be provided only to the selected Engineer of Record and will not be distributed prior to contract award. Bidders are instructed to submit any exceptions or proposed modifications using the Statement of Compliance and Exceptions form, with specific attention to indemnity provisions, professional standards, and contractual language.

I. QUESTIONS
Q1. Can you give any additional information regarding a scope of work tailored to the consulting & inspection services?
A1. This is detailed in Section 4. Read page 145, 146, 147, and 149.
Q2. Hello, thanks you for the opportunity to provide underground qualifications for RFQu 25-057-RM Engineering Consulting Services. In order for our team to provide the best possible qualifications response, could we please request an extension of one week, August 5, 2025?
A2. A one-time extension of one week will be granted. No further extensions will be granted.
Q3. Hello, within the RFQ, on page four under Section E. Specific Submittal Format, 1. Introduction "TAB 1" (5 Points), the section states that "this section is not included in the overall page count." Will you please clarify if
P a g e 2 | 4 bidders` responses to this RFQ have a page limitation. If so, what is the limitation or page count for bidders` responses? Thank you.
A3. The page count limitation is hereby removed.
Q4. Hello, can you please clarify on the requirements listed under section 3.
Assigned Professional Experience "TAB 3", item d). It states, "No more than four (4) resumes will be evaluated." We will be proposing with an organizational chart with eight team members listed. This does not include our subcontractor resumes. Based on the wording in item d), will only four out of the eight resumes that we provide will be evaluated? Please clarify.
A4. The limitation on resumes to be evaluated is hereby removed.
Q5. Would the Authority please revise Section 13 of the General Conditions, Special Instructions and Insurance Requirements Section to clarify that the release upon final payment applies only to payment-related claims, since not all potential claims may be known at the time of final payment?
A5. Submit your exceptions with Statement of Compliance and Exceptions form.
Q6. As currently worded in Section 1d. General Conformity on page 87 and in Section 7. Warranty on page 89, the Authority is asking to assume the highest professional standards in performing its work. While vendor is committed to serving its clients, we are only required to do so in accordance with the professional standard of care, which is the degree of care and skill ordinarily exercised by consultants performing the same or similar services in the same locality at the time the services are provided. The relationship currently described in the proposal exceeds the Standard of Care to be provided by Design Professionals. Would the Authority consider modifying this language to comply with the foregoing language?
A6. Submit your exceptions with Statement of Compliance and Exceptions form.
Q7. We request the Authority to address problematic indemnity language in Section 26. Contractor/Bidder Railroad Notification/Coordination Obligation on page 98 of the RFQ as it does not comply with Florida Statute 725.08 by requiring a defense. Will the Authority please consider rewording this language to conform with the statute and deleting the requirement to “defend"?
A7. Submit your exceptions with Statement of Compliance and Exceptions form.
Q8. As currently worded, we believe that the indemnity provisions in Section 12 and Section 12.1 on page 113 of the RFQ are not in compliance with FL
P a g e 3 | 4
Statute 725.08 and is unenforceable. Would the Authority consider rewording same to conform with the statute? Suggested language per FL Statutes 725.08: “The design professional shall indemnify and hold harmless the Authority, and its officers and employees, from liabilities, damages, losses, and costs, including, but not limited to, reasonable attorneys` fees, to the extent caused by the negligence, recklessness, or intentionally wrongful conduct of the design professional and other persons employed or utilized by the design professional in the performance of the contract.”
A8. Submit your exceptions with Statement of Compliance and Exceptions form.
Q9. We would like to inquire whether the Kissimmee Utility Authority (KUA) has published utility design, construction, or service standards that are available for reference by consulting engineers. Specifically, we are interested in any guidelines, specifications, standard details, or procedural documents that govern the planning, design, and installation of electric utility infrastructure within KUA’s service area. Access to these standards will help ensure our designs are aligned with KUA’s requirements and facilitate coordination throughout the project development process A9. KUA has several design criteria documents that will be provided to the selected Engineer of Record (EOR) for incorporation into the design. The KUA criteria documents will not be provided prior to Contract award or broadcast as part of this public bid.
Q10. We are seeking clarification regarding the framing requirements for a proposed transition structure at both ends of the underground line.
Specifically, we would like to confirm whether the framing configuration is intended to differ at each end—given that one end interfaces with a riser pole and the other with a substation termination structure—or whether the same framing is to be applied at both ends, as suggested in Section I.1.i.2 of the referenced documentation RFQu 25-057-RM.
A10. The attached provided pictures are schematic representations of KUA’s expectations for either end at this time. Actual framing will be as dictated by design, as determined by EOR and agreed to and approved by KUA.”
II. DUE DATE EXTENSION
The due date has been extended to Tuesday, August 5, 2025 at 2:00 p.m. local time.
