FAR 52.212-2 -- Evaluation -- Commercial Products and Commercial Services (DEVIATION 2026-

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the

Government, price and other factors considered. The following factors will be used to evaluate offers:

Price, Technical, and Past Performance. Technical and past performance, will not be weighted. The

Lowest Price Technically Acceptable (LPTA) source selection process will be utilized.

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful

Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

Addenda to FAR 52.212-2 -- Evaluation -- Commercial Products and Commercial Services

(DEVIATION 2026-O0038) (FEB 2026)

EVALUATION FACTORS

FACTOR 1: TECHNICAL CAPABILITY

FACTOR 2: PAST PERFORMANCE

FACTOR 3: PRICE

FACTOR 1: TECHNICAL CAPABILITY

1) Technical Factor will be evaluated on an acceptable/unacceptable basis and shall not be rated.

The offeror’s quote will be evaluated to determine if the quoter has demonstrated it can comply with the requirements of Attachment 1 – Statement of Work.

2) A quote will be deemed “acceptable” if:

a. The quoter clearly demonstrates it can comply with all requirements of the Statement of

Work and provides signed Attachment 4 – Statement of Work Compliance Form; and

b. The quoter provides specifications for the proposed MFD model numbers submitted and they meet the requirements identified in the Statement of Work; and

c. The quoter provides completed Supply Chain Risk Management Documentation required in accordance with Attachment 1 – Statement of Work; and

d. The quoter provides the Section 508 accessibility requirements and submits completed

Voluntary Product Accessible Template (VPAT) with its quote; and

e. The quoter provides documentation confirming that proposed devices are TAA compliant; and

f. If not the OEM, the quoter provides a Letter or Authorization/Letter of Supply

3) A quote deemed “unacceptable” in this factor will not be further evaluated or considered for award.

FACTOR 2: PAST PERFORMANCE

The Government evaluates past performance information as a predictor of future contract performance.

Past Performance Factor will be evaluated on an acceptable/unacceptable basis and shall not be rated. The

Government will determine whether the quoter’s past performance is acceptable or unacceptable based on the demonstrated record of recent and relevant performance.

The Government will evaluate the quoter’s past performance by utilizing any or a combination of any of the following methods:

1) Reviewing recent and relevant past performance information provided by the quoter in its quote. The

Government will focus its review to the areas of technical (quality of product or service), schedule/timeliness, and management or business relations. Note: Any submission(s) more than the stated limit of three (3) references will be excluded by the Government. The Government will choose the excluded contract(s) at random, or in any manner that the Government, in their absolute discretion, deems appropriate, without any consideration for the best interests of the quoter.

2) Consider past performance information obtained from any other sources available to the Government, to include, but not limited to, Federal System for Award Management (SAM) database, Contractor

Performance Assessment Reporting System (CPARS) database, and other databases, interviews with

Managers, Officials, or Contracting Officers.

3) The Government may consider the source of past performance information, context of the past performance information it evaluates, general trends in performance, and demonstrated corrective actions.

The Government is not obligated to contact any/all points of contact identified by the quoter nor is the

Government limited to the points of contact provided.

In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance (see performance (see RFO FAR 15.202(c)(1)).). Therefore, the quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”. Should the Government discover adverse past performance information to which the quoter had not had a prior opportunity to respond, the Contracting Officer will conduct communications if deemed appropriate.

The Government will rate the quoter’s Past Performance as follows:

Acceptable: Based on the quoter’s performance record, the Government has a reasonable expectation that the quoter will successfully perform the required effort, or the quoter’s performance record is unknown.

Unacceptable: Based on the quoter’s performance record, the Government does not have a reasonable expectation that the quoter will be able to successfully perform the required effort.

FACTOR 3: PRICE

Technically acceptable quotes found to have an acceptable record of past performance will be evaluated for the Lowest Total Price (inclusive of all options).

The vendor’s quote will be evaluated for fairness and reasonableness utilizing price analysis techniques.

Award will be based on the Lowest Total Priced quote that meets or exceeds the acceptability standards for the non-cost factors.

Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

DFARS 252.239-7017 Notice of Supply Chain Risk (DEC 2022)

252.204-7024 - Notice On The Use Of The Supplier Performance Risk System (MAR 2023)

(a) Definitions. As used in this provision—

“Item risk” means the probability that a product, based on intended use, will introduce performance risk resulting in safety issues, mission degradation, or monetary loss.

“Price risk” means a measure of whether a proposed price for a product or service is consistent with historical prices paid for that item or service.

“Supplier risk” means the probability that an award may subject the procurement to the risk of unsuccessful performance or to supply chain risk (see Defense Federal Acquisition Regulation

Supplement 239.7301).

(b) The Supplier Performance Risk System (SPRS), available at https://piee.eb.mil/, will be used in the evaluation of the Quoter or Offeror’s performance. SPRS retrieves item, price, quality, delivery, and contractor information on contracts from Government reporting systems in order to develop risk assessments.

(c) The Contracting Officer will consider SPRS risk assessments during the evaluation of quotations or offers received in response to this solicitation as follows:

(1) Item risk will be considered to determine whether the procurement represents a high performance risk to the Government.

(2) Price risk will be considered in determining if a proposed price is consistent with historical prices paid for a product or a service or otherwise creates a risk to the Government.

(3) Supplier risk, including but not limited to quality and delivery, will be considered to assess the risk of unsuccessful performance and supply chain risk.

(d) SPRS risk assessments are generated daily. Quoters or Offerors are able to access their risk assessments by following the access instructions in the SPRS user's guide available at https://www.sprs.csd.disa.mil/reference.htm. Quoters and Offerors are granted access to SPRS for their own risk assessment classifications only. SPRS reporting procedures and risk assessment methodology are detailed in the SPRS user's guide. The method to challenge a rating generated by SPRS is also provided in the user's guide. SPRS evaluation criteria are available at https://www.sprs.csd.disa.mil/pdf/SPRS_DataEvaluationCriteria.pdf.

(e) The Contracting Officer may consider any other available and relevant information when evaluating a quotation or an offer.
