(vi) 52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (RFO) is hereby incorporated by reference, with the same force and effect as if it were given in full text. In addition to the following addendum, all terms and conditions of FAR 52.212-1 remain in effect. The following have been tailored to this procurement and are hereby added via addendum:

(a) To ensure timely and equitable evaluation of the quote, the Vendor must follow the instructions contained herein. The quote must be complete, self-sufficient, and respond directly to the requirements of this solicitation. Vendors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Vendors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.

(a)(4) Specific Instructions: The response shall consist of the following:

Part 1 – Technical Acceptability – Quote must provide the following:

A. Incident Response Submission Requirement (PWS 3.3.2.2)– The Vendor shall submit an Incident Response Plan detailing how they will achieve the one (1) hour on-site response time for High Priority outages by the start of performance. The Vendor must submit an Incident Response Plan detailing how they will arrive onsite and begin work within one (1) hour of outage notification. The plan must prove how the Vendor will meet this absolute one-hour limit—which begins the exact moment the CFP sends the alert—by detailing local staffing logistics and the proactive management of gate-clearance times.

Additionally, the plan must verify that all designated technicians maintain active, pre-cleared base access credentials to ensure installation security processing does not delay their physical arrival at the site.

B. Installation and Cutover Plan Submission Requirement (PWS 8.2.2) – The Vendor shall submit a proposed Installation and Cutover Plan detailing how they will ensure cutover occurs within 90 days of contract award, avoiding service disruption of currently provided telecommunication services. Part 2 – Price – Submit a quote also using Attachment 3 – LLTS Pricing Schedule.

Part 3 – Not to be evaluated – Per PWS 8.2.1, The Contractor shall submit all

Interconnection Agreements (IAs) to the Government with their quote. If providing a quote as a Competitive Local Exchange Carrier (CLEC) for any and/or all services, provide documented evidence of IAs and/or leasing agreements relevant to this effort.

(b) The Vendor agrees to hold the price in its quote firm for 60 calendar days from the date specified for receipt of quotes

(End of Provision)

(vii) 52.212-2 Evaluation—Commercial Products and Commercial Services (RFO) this provision has been tailored to this procurement and is provided in full-text below:

(a) Evaluation factors. The Government will award a contract resulting from this RFQ to the responsible Vendor whose quote, conforming to the RFQ, will be most advantageous to the Government, price and other factors considered. The Government will evaluate quotes using Lowest-Price Technically Acceptable (LPTA) procedures. The following factors shall be used to evaluate quotes:

i. Technical Acceptability: The Government will evaluate the quote on an

Acceptable or Unacceptable basis (as described in Table 1 below).

Table 1. Ratings

Acceptable The Vendor’s technical submission meets the requirements of the PWS.

Unacceptable The Vendor’s technical submission does not meet the requirements of the PWS.

1. Incident Response Plan

Evaluation Standard – The Government will evaluate the realism and reliability of the response plan to meet the requirements in PWS 3.3.2.2.

2. Installation and Cutover Plan

Evaluation Standard – The Government will evaluate the proposed Installation and Cutover Plan methodology detailing how the Vendor will ensure cutover occurs within 90 days of contract award, avoiding service disruption of currently provided telecommunication services IAW PWS 8.2.3 and appendix 1.

Submission of a generic diagram or not explaining the service routing will be determined technically unacceptable.

ii. Price: Must be determined to be fair and reasonable;

1. Total Evaluated Price (TEP): A TEP will be computed for each quote. The

Government will evaluate all options pricing IAW RFO 52.217-5, Evaluation of

Options. The price of a six-month extension authorized by RFO Clause 52.217-8, Option to Extend Services, will be added to the submitted price for each potential contract performance period.

(a) The TEP is a two (2) part computation. First, the Vendor's Total Price will be determined by multiplying the Quantities identified in the pricing schedule by the

Unit Price (limited to two decimal places) for each Contract Line Item Number

(CLIN) to confirm the total Extended Price for each CLIN; the sum of all total

Extended Prices will be the Vendor's Total Price. This will be done for all CLINs on the base an all option periods. Second, the Total Price (total amount for All

CLINs) plus the sum of RFO Clause 52.217- 8 Option to Extend Services formula (shown below) will constitute the TEP.

The formula for RFO Clause 52.217-8, Option to Extend Services amount is as follows:

Base Year = Price of Base Year x 6

Option Year 1 = Price of Option Year 1 x 6

Option Year 2 = Price of Option Year 2 x 6

Option Year 3 = Price of Option Year 3 x 6

Option Year 4 = Price of Option Year 4 x 6

2. Evaluating the Option CLINs does not create an obligation for the Government to exercise any Options.

iii. Responsibility. IAW R-DFARS 204.7603(b) and clause 252.204-7024, Notice on the Use of the Supplier Performance Risk System (SPRS), a Vendors risk will be considered.

Vendors are required to comply with National Institute of Standards and Technology

(NIST) Special Publication (SP) 800-171 by conducting a self-assessment in SPRS

(https://www.sprs.csd.disa.mil/nistsp.htm). Note, these assessments are to be completed every three (3) years.

(c) Notice of award. A written notice of award or acceptance of a quote furnished to the successful Vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Basis of award: Award will be made to the Vendor with the lowest total evaluated price that has been determined technically acceptable. Clarifications conducted to resolve minor errors will not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for quote revisions.

(End of Provision)

(viii) Any changes to this solicitation and any resultant contract must be completed in writing by the

Contracting Officer. Changes made that are not authorized by the Contracting Officer are made at the risk of the Vendor, to include costs. The Contracting Officer is the only Government representative authorized to change the terms and conditions of this requirement.

(ix) If a Vendor believes the requirements in these instructions contain an error, omission, or are otherwise unsound, the Vendor shall immediately notify the Contracting Officer and Contract Specialist in writing with supporting rationale prior to quote submission.

(x) The Vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the RFO and other Federal law applicable to commercial acquisitions, to the extent of such conflict the RFO and Federal law govern and conflicting Vendor terms, conditions, or agreements are unenforceable and are not considered incorporated into any resulting contract.
