52.212-2 EVALUATION -- COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1 – Technical Capability

Factor 2 – Price

All quotes received from eligible Quoters will be initially evaluated for completeness and conformance with the

RFQ instructions. Incomplete and nonconforming quotes may not be further evaluated.

Factor 1 - Technical Capability. Technical capability will be evaluated based on the offeror's ability to meet or exceed the requirements outlined in Attachment 1 – Performance Work Statement. The Government will assess the offeror's proposed approach, understanding of the requirement, and demonstrated ability to deliver the required goods or services in accordance with the stated specifications and timelines. Technical capability is significantly more important than price.

Factor 2 – Price. All prices will be evaluated for price reasonableness in accordance with FAR 13.106-3. The

Government will evaluate quotes for award purposes by adding the unit price x the quantity resulting in an extended price for each CLIN. All CLINs will be added together resulting in a total contract price. In case of discrepancy between a unit price and an extended price, the unit price will be presumed to be correct. Pricing for all items is required, otherwise the quote will be considered ineligible for award.

Prior to award, the Government may request additional information/data to support price reasonableness such as copies of paid invoices for the same/similar items, sales history for the same or similar items, price list with effective date and or copies of catalogue pages along with any applicable discounts. The Government may evaluate any and all information submitted by the vendor to support the reasonableness of prices quoted. The method of evaluation is solely within the discretion of the Contracting Officer.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.232-18 Availability of Funds (APR 1984)

Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting

Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
