3. Contract and Change Order

All Contracts comprise of: Agreement between County Board of Health and Contractor (appendix B), Scope of Work utilizing the HUD Scope Item Descriptions and Costs (appendix B-3), and reference to this Contractor Handbook.

The Lead Hazard Control and Healthy Homes Program may use one of the following methods to award projects under this program. Listed below are the methods which may be used:

Option 1: Contracts assigned through lowest quote: The Program Manager will email a detailed Scope of Work with project location, date and time for a “walk-through” to all contractors from the Active Contractor List. The contractor must accept the invitation, via email and within 48 hours. If a contractor does not respond, they will not be eligible to attend the walk-through. All quotes are due at the Program Managers’ office Seven calendar (7) days from the walk-through by 9:00 am. The contractor with the lowest quote will be awarded the project. If it is determined that more than one contractor has the lowest quote, the Program Manager will make the final decision. Once awarded, the contractor has fifteen

(15) days to start the project and ten (10) days to complete it and achieve a clearance.

Note: If the Program Manager believes that all quotes are excessive, those quotes will be rejected, and another walk-through will be scheduled.

Option 2: Contract assigned through rotation using negotiated costs: The Lead Safe Program offers an optional procedure to obtain fair Scope Item costs. If all active contractors have a consensus for reasonable costs per Scope Item Description through negotiation; all active contractors will receive projects via a Contractor Rotation List. The list will offer the next available Scope of Work to the next available contractor. Contractors will be moved to next available after completing a project(s). If all contractors have at least 2 projects under contract, the rotation will continue as default rotation. All Scopes of Work and Contracts will be drafted utilizing these negotiated costs. The scope item will have the location, item, measurements/amount, total value and defined expectations of completion. The contractor will verify all information on the Scope of Work before accepting the project. Any measuring errors must be presented to the Program Manager for verification and change. Once the Scope of Work is accepted, the contractor will be responsible to complete the project “as is”.

The contractor has five (5) days to accept the project. Acceptance of the project must be made through email or fax to the Program Manager. Fax: 309-679-6174 or email:

leadsafe@peoriacounty.org. Once accepted, the contractor has ten (10) business days to sign the contract after they accept the project and fifteen (15) days to start the project, five (5) days to complete interior work and ten (10) days to complete entire project and request a clearance. Due to supply issues, the 15 day start time frame from accepting the project will be waived with the approval from the Program Manager.

http://www.peoriagov.org/equal-opportunity/ mailto:leadsafe@peoriacounty.org

Change Orders Contractors will not receive compensation for any unapproved changes and/or repair made without prior approval from the Program Manager. Any quotes determined unreasonable will be rejected. All unforeseen and additional repairs not on the Scope of Work must be coordinated through the Program Manager. These modifications will be submitted on a Change Order (Appendix B-4).

4. IDPH Notice of Commencement

A Notice of Commencement (Appendix 6) is required by IDPH from the contractor at least seven

(7) calendar days prior to beginning of all lead work. The start date will be derived from the Notice of Commencement defining the dates for all work. When the contractor sends the Notice of Commencement to IDPH, a copy of the Notice of Commencement must be provided to, the Peoria City/County Health Department lead program team, preferably via email at leadsafe@peoriacounty.org.

5. Required Work Practices and Serious Violations

The Program Manager monitors all projects several times during mitigation. All work must be in compliance with federal, state, and local governing regulations, authorities, and codes. These include, HUD Guidelines, EPA (40 CFR Part 745), OSHA (29 CFR 1926), IDPH (410 ILCS 45/), Peoria Building Codes and other project specifications.

IDPH, HUD and EPA (examples)

A. Worksite Preparation must be carried out as called for in IDPH, HUD and EPA's Guidelines.

1. Pre-Cleaning

2. Poly must be put down in all pathways to and from work areas

3. Poly must be properly secured to the floor/ground/walls to prevent paint chips and dust to escape the work area

4. Ventilation systems must be contained including HVAC, windows doors etc

5. When preparing for window replacement, a rigid barrier (plywood or equivalent) must be placed on the inside of the window, so that the interior of the house is not considered a work area.

B. Wet Methods: Lead painted surfaces must be kept wet (moist) while they are being scraped or manually sanded.

C. Occupant Protection Plan: All non-licensed individuals are prohibited within the lead containment area. A copy of the Occupant Protection Plan is required at the job site.

D. Cleaning Procedures: All cleaning should be conducted using IDPH's HUD and EPA cleaning guidelines. This includes following the daily cleaning procedures.

E. Lead Abatement Waste must be handled as follows:

1. All paint chip debris should be double bagged for disposal before exiting the contained area.

2. All lead painted components should be kept in a closed and locked container while on site.

3. All lead-based paint debris (chips and components) must be disposed of in a municipal solid waste landfill.

OSHA Requirements

A. Respiratory Protection: If applicable, all workers should be wearing the appropriate respiratory protection equipment as required by OSHA.

B. Protective Clothing: All workers should be wearing the appropriate protective clothing as required by OSHA.

1. Shoe covers should be worn in the work area at all times until the project passes clearance.

mailto:leadsafe@peoriacounty.org

2. Protective suits, including gloves, must be worn whenever lead paint is being disturbed.

C. Removing Protective Clothing: Workers cannot exit the work area while still wearing protective clothing. Removed protective clothing must remain inside the work area (on plastic) and disposed of in plastic bags.

D. Housekeeping: Daily cleaning of the work areas is required to keep the area as free as practicable of accumulations of lead dust and debris.

E. Hand Washing Facilities: An operating hand washing facility is always required on the job site. The facility must be located just outside the containment area. A pressure sprayer is not considered an acceptable hand washing facility. All water used for cleaning or hand washing must be passed through a five (5) micron filter before it is released.

F. Signs and Labeling: All work areas and containers must have the appropriate signs and labels as required by OSHA. Barrier tape must be used to designate exterior work areas and the tape should be kept in place until the project receives clearance. When the family has not been relocated, barrier tape must be used for interior rooms that are awaiting clearance results.

Serious Violations Non-compliance of Lead Hazard Control and Healthy Homes Program:

A. Work Knowledge: If it is determined by the Program Manager that a contractor cannot perform the job functions related to the Scope of Work (e.g. window replacement, siding installation) and/or the work is not in compliance with the HUD Guidelines, Peoria Building Codes and Property Maintenance Code, will be cause for removal from the Lead Hazard Removal Program. The contractor will be issued a Stop Work Order. The contractor must collect all of their personal property and clean the worksite. The contractor will be removed from the Lead Hazard Removal Program.

B. Safety Violations: Violation of work practices as required by IDPH, HUD, OSHA, EPA, and PC/CHD will be cause for removal from the Lead Hazard Control and Healthy Homes Program. Examples of violations include: Plastic containment violations, unlicensed workers on the job site, dry cutting/sanding, uncontained lead components outside work area, leaving any tools or debris at the job site overnight including paint chips. The contractor will be issued a Stop Work Order. The contractor must collect all of their personal property and clean the worksite. The contractor will be removed from the Lead Hazard Removal Program.

C. Excessive time to complete projects: the contractor has fifteen (15) days to start work, five

(5) days to complete interior work and ten (10) days to complete entire project and request a clearance. After twenty (20) working days from start, the contractor will be issued a Stop Work Order. The contractor must collect all of their personal property and clean the worksite. The contractor will be removed from the Lead Hazard Control and Healthy Homes Program.

A formal letter outlining these issues will be mailed to the company. The owner will have an opportunity to discuss these issues with the Program Manager. During this time, the contractor will be non-active pending a final decision by PC/CHD. The job will be completed by another contractor. Payment to each contractor for the completed work will be determined by the Program Manager and addressed through a project Change Order amending the original contract amount.

Any contractor who is formally removed from the Lead Safe Program will not be eligible to participate for three (3) years from the removal date.

6. Clearance Testing

Step 1: The contractor will schedule the final job inspection and clearance testing with the Program Manager 24-hour in advance. The Program Manager is not responsible to set up the clearance testing with neither homeowner nor tenant.

Step 2: The Program Manager will collect the Lead Supervisor Written Assurance Statement (Appendix B-8) and then verify the Scope of Work has been completed.

Step 3: The Program Manager or other PC/CHD staff will then conduct the clearance test. If areas are visible with paint chips, dust, debris or residue; the clearance will not be performed.

The contractor will have to clean these areas.

Where Wipes Are Taken As directed by IDPH and HUD, the contractor is responsible for cleaning 100% of all horizontal surfaces in all work areas, adjacent areas, and pathways to work area. This includes corners, closets, windowsills, tops of baseboards/trim, furniture, owner's personal property and other areas where dust may have accumulated.

a. Adjacent Area is six (6) feet of the area outside of the containment work zone.

b. Pathway is the route taken from the entryway to the work area(s) and between work area(s).

c. A clearance wipe is representative of the entire work area and the possible lead dust levels. Dust wipes are taken in a spot that looks least likely to have been cleaned well.

This is referred to as "worst case representative sampling". If the worst case spot passes clearance, then the odds are good that the rest of the area will also pass.

Program Manager will notify the contractor of the results from the clearance testing by emailing a copy of the results to the contractor along with the clearance report. Clearance level is < 10 μg/ft² for interior floors, < 40 μg/ft² for interior/exterior porch floors, and < 100 μg/ft² for all other horizontal surfaces. If the clearance testing fails, all room/areas that fail the permissible limits will require re-cleaning and re-testing. Another clearance must be completed with-in three

(3) days of notification (fees will be assessed after day 3). Re-cleaning and re-testing must continue until all work areas are below IDPH permissible limits.

Fines/Fees

• All failed clearances will incur a $100.00 fee.

• A clearance must be retaken with-in three (3) days of notification of failure; a $100.00 fee per day thereafter.

• Contractor requests a clearance but is not ready will incur a $100.00 fee per visit.

NOTE: The Program Manager may waive any fee/penalty for reasonable explanations or situations.
