NOTICE TO OFFEROR
NOTICE TO OFFEROR
1. Naval Facilities Engineering Systems Command (NAVFAC) Northwest hereby submits a solicitation for the procurement of non-personnel services to identify and remove aquatic invasive plants on site at Acoustic Research Facility (ARD) Bayview located on Lake Pend Oreille in Bayview Idaho in accordance with the Performance Work Statement (PWS) dated 29 June 2022.
2. SAM REQUIREMENT:
Prospective contractors who have not completed electronic annual representations and certifications at www.sam.gov in conjunction with required registration in the SYSTEM for AWARD MANAGEMENT (SAM) database, shall complete and submit 52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (DEC 2019) and 252.204-7007 ALTERNATE A, ANNUAL REPRESENTATIONS AND CERTIFICATIONS (JUN 2019) in SAM to be eligible to receive an award for this solicitation.
3. PREPROPOSAL INQUIRIES (PPIs):
All questions, concerns, verification or clarification of information regarding this solicitation, scope and any documents included in the solicitation package shall be submitted in writing to caitlin.e.gann.civ@us.navy.mil no later than 12:00 pm, July 21, 2022. Include in the subject line of the email the Government’s solicitation number; failure to do so will lessen the Government’s ability to ensure all questions are considered during the bidding process. Provide your company name, POC and contact information in the body of the email.
4. EVALUATION FACTORS:
The Government will evaluate proposals received in response to this solicitation on the basis of low price technically acceptable. Bidders shall submit two volumes: volume one, Technical Capability; Volume two, Price. The Government will review CPARS and SAM. The bidder’s failure to include information required by this solicitation may result in the bid submission being found non-responsive and may therefore be ineligible for award.
Factor 1- Propose means and methods to achieve invasive aquatic plant removal IAW with PWS, not to exceed 20 pages (8.5” by 11”, 12 point, times new roman with 1” margins). Any pages past 1-20 will not be reviewed.
The Government will evaluate the method of removal that is prescribed in the PWS, Task 2 (b). If the method of removal of the milfoil is acceptable according to the requirements of the PWS, this evaluation factor will be considered a pass. If the proposed method of removal does not meet the requirements of the PWS, this factor will be considered a fail.
Factor 2- The vendor will provide a list of key personnel that are considered necessary to performing the methods and means to accomplish the tasks in the PWS. The Government will review the certifications and licenses for valid dates and certifying organization. If the key personnel meet the qualifications required in the PWS, this factor will be considered a pass. If the Government determines that the key personnel do not meet the qualifications in the PWS, then this factor will be considered a fail.
Factor 3- Provide 3 projects in the last 5 years of similar scope and magnitude (Similar plants underwater, magnitude is within 20% of the area and type of area being called for work in the PWS). Provide contract number, or agency/private company name. Location of Service, Awarded price, no more than a one page write up of scope and methodology to accomplish it. (8.5” by 11”, 12 point, times new roman with 1” margins)
Factors 1, 2 and 3 are equally important. Failure to achieve a pass on all three factors will result in a fail for the technical factor, and will receive no further consideration. Proposals that are evaluated and receive a pass for technical factor 1 will be evaluated for past performance.
Past Performance:
The contracting officer has determined that Past Performance review is required for this proposal. The Government will evaluate the last 5 years of available CPARS (Contractor Performance Assessment Reporting System) to determine if there are any unsatisfactory CPARS being accepted, and SAM (System for Awards Management) System for Award Management Exclusions in accordance with FAR 9.404 in the last 5 years or notices not to award to that are current. In accordance with FAR 13.503 (a)(2)(ii), if an unsatisfactory CPARS or SAM warning is discovered, the proposer will be contacted and given the opportunity to confirm or deny the existence of the information. In accordance with FAR 13.503 (a)(2)(ii) any vendor that does not have a recorded CPARS should submit any Federal, State, local or private contracts within the same 5 year review period. In accordance with FAR 13.503 (a)(2)(iv), if no past performance is available the proposal will not be considered satisfactory or unsatisfactory.
CPARS is determined to be unsatisfactory if any accepted and recorded reports are listed unsatisfactory.
Satisfactory reports will have satisfactory or higher accepted and recorded results. SAM will be determined unsatisfactory if there are any exclusions in accordance with FAR 9.404. Satisfactory SAM reports will be determined not to have any exclusions in accordance with FAR 9.404. Proposals that are determined to have unsatisfactory CPARS or disbarment/ineligible to receive award will be considered unsatisfactory and will receive no further evaluation. Proposals with satisfactory CPARS and SAM review for the periods described above, may be considered for price evaluation.
Price:
The contractor will submit a separate price volume with fully priced line items and signature. The Government will evaluate price proposal to ensure all line items are priced and that a total price equals total of all line items combined and the proposal is signed. The lowest price that is determined to be technically acceptable and has satisfactory CPARS will be evaluated first. If that proposal is determined to be the lowest price technically acceptable, further evaluations will not be made, and an apparent awardee will be determined.
Factor 1- Did the proposal demonstrate the method of removal that is prescribed in the PWS? If the method of removal of the milfoil is acceptable according the requirements of the PWS, this evaluation factor will be considered a pass. If the proposed method of removal does not meet the requirements of the PWS this factor will be considered a fail.
Factor 2- Did the proposal demonstrate the qualifications of the resume’s and licenses of the key personnel called for in the PWS? Key personnel are considered individually but all individuals must be qualified per the PWS at the time of the closing of the proposal. If the key personnel meet the minimum qualifications required in the PWS, this factor will be considered a pass. If the Government determines that the key personnel do not meet the minimum qualifications in the PWS, then this factor will be considered a fail.
Factor 3- Did the proposal Provide 3 projects in the last 5 years of similar scope and magnitude (Similar plants underwater, magnitude is within 20% of the area and type of area being called for work in the PWS)? Provide contract number, or agency/private company name. Location of service, awarded price, no more than a one page write up of scope and methodology to accomplish it. (8.5” by 11”, 12 point, times new roman with 1” margins)
Factors 1, 2 and 3 are equally important. Failure to achieve a pass on all three factors will result in a fail for the technical factor, and will receive no further consideration. Proposals that are evaluated and receive a pass for technical factor 1 will be evaluated for past performance
Past Performance:
Did the Government evaluate the last 5 years of available CPARS (Contractor Performance Assessment Reporting System) to determine if there are any unsatisfactory CPARS being accepted, and SAM (System for Awards Management) System for Award Management Exclusions in accordance with FAR 9.404 in the last 5 years or notices not to award to that are current? In accordance with FAR 13.503 (a)(2)(ii) if an unsatisfactory CPARS or SAM warning is discovered, the proposer will be contacted and given the opportunity to confirm or deny the existence of the information. In accordance with FAR 13.503 (a)(2)(ii) any vendor that does not have a recorded CPARS should submit any Federal, State. Local or private contracts within the same 5 year review period. In accordance with FAR 13.503 (a)(2)(iv), if not past performance is available the proposal will not be considered satisfactory or unsatisfactory.

The lowest price that is determined to be technically acceptable and has satisfactory CPARS will be evaluated first. If that proposal is determined to be the lowest price technically acceptable, further evaluations will not be made, and an apparent awardee will be determined.
Determination of awardee:
