PROJECT OVERVIEW

The State of Nevada Purchasing Division is seeking proposals from qualified vendors to provide Fire Fuel Reduction, Vegetation, Wildlife Capture, Surveys, and Transport Services statewide. The intent of this RFQ is to qualify vendors in which agencies will request bids on an as needed basis from the list of qualified vendors. The RFQ does not hold awarded vendors to any prices, nor does it obligate the State to purchase goods or services from all awarded vendors. The purchase amount will be controlled by the individual using agencies through a purchase order submitted or specific scope of work and accepted by the vendor once an individual project has been bid and awarded and the vendor enters into a Services Agreement with the using Agency, refer to Service Agreement for Statewide Contracts and Mini Bid Process.

The State may award one (1) or more contracts in conjunction with this RFQ, as determined in the best interests of the State. It is the intention of the State to award contract(s) on a statewide basis; however, proposals may be considered regionally (Northern, Southern, Rural). The vendor’s proposal must identify the geographic region(s) in which services are being offered.

This contract(s) will be mandatory for State agencies located in geographic regions serviced by the contract. The University and Community College System, the Court System, the Legislative Counsel Bureau, and Political Subdivisions (i.e., cities, counties, school districts, etc.) may use the contract(s) resulting from this RFQ; however, they are not required to do so.

The State Purchasing Division will administer contract(s) resulting from this RFQ. The resulting contract(s), anticipated to begin February 13, 2024, subject to Board of Examiners approval, with an option to renew for two (2) additional years, if agreed upon by both parties and in the best interests of the State.

The State reserves the right to accept vendor proposals for qualification on an ongoing basis. Any future contract awards will be written based upon termination dates concurrent with contracts awarded as a result of the original RFQ.

GOALS AND OBJECTIVES

All work is to be performed in a professional manner, with due diligence paid to protecting Government and private property and ensuring a safe working environment for crew members. Equipment and crew must be fully compliant with State and local employer safety and fire prevention codes and ordinances. Key personnel are required to ensure crew safety, as well as an industry accepted level of production. Routine inspections will be conducted by the contracting agency to determine quality of work, production levels, and compliance with site protection requirements. Vendors will be required to have appropriate license(s) and insurance to qualify for all work in this RFQ. Copy of appropriate license(s) must be submitted with proposal. Vendors may also be required to provide a Performance Security in the form of a Surety Bond, Certificate of Deposit or Treasury Note. This requirement will be on a project-by-project basis and will be in an amount up to 100% of the project total.

BASIC REQUIREMENTS

For vendors to qualify for performing any service outlined in this RFQ, proposing vendors must provide evidence of the required employee knowledge and skills through experience (attach resumes and/or CV), as well as a detailed description of services in the scope of work being proposed upon. A minimum of three (3) years’ experience in each of the scopes of work being proposed is preferred.

Work is to be performed in a professional manner, with due diligence paid to protecting private property and ensuring a safe working environment for crew members. Equipment and crew must be fully compliant with State and local employer safety and fire prevention codes and ordinances. On-site crew supervision is required to ensure crew safety, as well as an industry accepted level of production. Routine inspections will be conducted to determine quality of work, production levels, and compliance with site protection requirements. Any slash or high stumps that are left will constitute an incomplete job and payment will not be approved until complete.

The state acknowledges that all vendors may not be able to provide all listed services. Vendors may apply for one or more of the services listed, depending on personnel experience and aircraft capabilities.

The process by which proposals shall be considered for award under this solicitation consists of two (2) distinct stages.

First stage: Determine whether the vendor qualifies under the set of General Minimum Qualifications (refer to Section 2.11). If a vendor is determined to not meet any of the General Minimum Qualifications, the response in its entirety shall not be considered for award.

Second stage: if all General Minimum Qualifications are met, the proposal shall be evaluated to determine if it meets the Technical Minimum Qualifications (refer to Section 2.12). Responses that do not contain the required information shall not be considered for award. Each response shall be reviewed independently in the Technical Minimum Qualifications section.

GENERAL MINIMUM QUALIFICATIONS

Technical Minimum Qualifications

Vendors proposing to receive an award through this solicitation shall provide a detailed description of their qualifications, which shall include, at a minimum, the following information. It is mandatory that each component listed below in the Technical Minimum Qualifications be addressed. Failure to address each component shall result in disqualification of the response:

Vendors will provide helicopter aircraft and experienced, trained personnel capable of flying wildlife count surveys located near the ground in mountainous terrain. (Radio-telemetry surveys are covered separately below).

Fixed-wing aircraft for radio-telemetry surveys will be capable of transporting a pilot and up to two (2) observers each weighing 200 lbs.

Air speeds of 25 to 60 knots will be required, as will altitudes under 100 feet above ground level (AGL) at elevations up to 12,000 feet above mean sea level.

Vendors will provide helicopter aircraft (where appropriate) and experienced, trained personnel capable of transporting NDOW personnel, NDOW volunteers and equipment to specific locations or any other using entity. Vendors must be capable of safely transporting NDOW personnel and materials under a wide range of temperatures (< 32ºF to >100ºF) into remote mountainous locations (e.g., wildlife water development site) or other using entities.

Vendors should anticipate providing a helicopter and pilot for yearly inspections of wildlife water developments involving low altitude hovering, ferrying of personnel, and occasional landings and shutdowns to allow inspection personnel to conduct minor repairs.

When applicable, vendors will provide helicopter aircraft and experienced, trained personnel capable in low-level flight operations of transporting NDOW personnel and externally loaded (sling-loaded) materials and tools to remote locations, including water development sites in rugged terrain or other using entities. Vendors must be capable of transporting NDOW personnel, materials, and tools under a wide range of temperatures (< 32ºF to >100ºF) and by external loads (sling loads) into remote mountainous locations. Aircraft shall be capable of transporting loads that weigh a minimum of 750 standard pounds, with preference given for performance capabilities that meet or exceed 1,000 standard pounds, at elevations up to 12,000 feet above mean sea level.

The agency may give preference to prospective vendors during the selection process for individual projects that can provide the services described in this RFQ while minimizing ferry charges and overnight travel costs. It is desired that vendors will either have aircraft stationed in Nevada, or nearby in an adjacent state and in close enough proximity to project sites to minimize ferrying costs.

When scheduled 30 or more calendar days in advance, the vendor shall:

Notify the agency immediately of prior commitments which could conflict with the agency’s aerial operational needs, and.

Adhere to the agency’s flight schedule, unless both parties concur with the proposed alteration(s), and with the understanding that unapproved delays may result in the contractor being charged by the agency for liquidated damages at State of Nevada rates. Excused delays could include non-scheduled repairs or weather-related causes.

The agency reserves the right to postpone, reschedule, or cancel scheduled operations for any reason including availability of preferred pilots or aircraft. A reasonable effort will be made to provide advance notification of schedule changes.

Other similar duties may be requested as needed.

Pilot Qualifications:

Vendor pilots must be able to operate their aircraft under a wide variety of elevations and temperatures.

Vendors must provide specialized equipment used during operations (e.g., slings, miscellaneous hardware, GPS instrumentation, etc.).

Graduation from high school or equivalent education.

2500 hours logged, pilot-in-command total rotorcraft or fixed -wing multi-and/or single-engine aircraft flight time.

Must be Office of Aviation Services (OAS) certified.

Flight experience must include:

250 hours low-level flight.

250 hours conducting external load operations.

500 hours of mountain flying above 5,000 feet mean sea level.

100 hours of flight time within the preceding 12 months.

Resumes: Names of pilots that will be completing work under these contracts must be listed and a resume attached describing their qualifications and experience. All pilots hired after contracts are awarded and that haven’t been previously vetted through the evaluation process of this solicitation, must submit a resume and describe their qualifications and experience and be approved by NDOW or any using entity prior to using the new pilots under these contracts.

Military Clearance: Certain projects will occur within military controlled lands and airspace (e.g., Naval Air Station Fallon and Nellis Air Force Base/National Test and Training Range. Pilots and additional crew members (e.g., fuel truck driver) must be able to obtain a valid badge prior to accessing the military areas. The requirements for obtaining a badge typically include passing a federal background check and being born in the United States. NDOW personnel will facilitate badging requirements with the Department of Defense, which includes filling out a 074 Form. In some instances, federally employed personnel also fly in the helicopter, so pilots that are OAS carded are preferred. These requirements do not apply to most project work being conducted.

Aircraft Qualifications:

Roto craft (where applicate): Examples of the minimum acceptable models of helicopters needed to accomplish the minimum required tasks described in this RFQ include the Bell 206L4 Long Ranger, the Bell 407, Bell 407HP, and the Euro copter AS350B3. Aircraft will be capable of operating at altitudes of at least 12,000 ft. above mean sea level.

Fixed Wing (where applicable): Air speeds of 60 to 90 mph for fixed wing aircraft and heights under 100 feet at ground level (AGL).

Roto craft Performance Charts: Vendors must provide the following charts and forms for each helicopter included in this application: Hover in Ground, Hover out of Ground, and a completed load calculation form using temperature and elevation listed above including 1 pilot and 2 passengers, each weighing 200 lbs., 2 hours of useable fuel onboard, plus a 20-minute reserve based on included helicopter burn rate chart.

Licensing Permits: All aircraft must pass the necessary and pertinent Federal Aviation Administration (FAA) requirements and possess the necessary FAA licenses for work under this RFQ. Should unintentional omission or failure occur in identifying other requisite licenses, permits, certified inspections, or other documentation to perform work within this RFQ, it is the sole responsibility of the vendor to ensure they possess all necessary State, Federal and local licenses, permits, and authorizations necessary for operation of all work required under this RFQ.

Vendor Disqualification: any using agency reserves the right to disqualify vendors who have had any violations or license or permits suspended.

Communications: Aircraft used under any resulting contract are required to be outfitted with remote flight-tracking with a 2-min. or less reporting interval and programmable FM radio.

Additional Qualifications Common to All Jobs

GPS Navigational Equipment: Awarded vendors (pilots) must be proficient in the use of real-time, Wide Area Augmentation System (WAAS) enabled by GPS navigational equipment, with up-to-date software, and must have such equipment on board aircraft. GPS navigational equipment will be used in logging location points for linking with data derived from wildlife surveys, and to inventory areas and flight paths. Awarded vendor’s software must be able to upload waypoints, survey areas, and transects as either .gpx, .kmz, or .shp files. The agency will be provided with a finalized digital file of waypoints, flight paths, data points for areas flown, etc. upon completion of a job if requested.

Safety: The awarded vendors must have flight-safety plans, inclusive of an emergency response strategy/protocol, and provide necessary safety briefings with their staff to operate safely. The awarded vendors and/or the State of Nevada reserve the right to halt work at any point if legitimate safety concerns exist. Work will not be resumed until the safety concerns have been resolved and acceptable to the State of Nevada.

The awarded vendors are responsible for coordinating and communicating effectively with other aircraft that may be affected by the operations. At a minimum, daily flight plans will be shared with the State of Nevada and an agreed upon radio frequency will be established to ensure effective communication and to avoid conflicts and overlap with contractors/agencies/others working in or adjacent to the project area.

Awarded vendors will provide fuel trucks and mechanics if necessary and any specialized equipment needed to complete projects (e.g., water buckets, slings, and related hardware).

Awarded vendors will be required to supply all aircraft, equipment, fuel, per diem, labor (including ground crews) necessary to complete projects.

Awarded vendors shall be required to mobilize and demobilize equipment to a site determined mutually suitable by the State and Vendors. It will be the responsibility of the awarded vendors to decide if the landing area is suitable and at which can be safely operated.

Awarded vendors will shuttle agency personnel and volunteers to and from predetermined sites during regularly scheduled project work on an as-needed basis.

Awarded vendors must possess and submit with their proposals proof of valid insurance. See Insurance Schedule attachment.

Flight Hazards: Any ground or aerial hazards that pose a danger to an awarded vendor’s personnel or operating equipment must be identified and avoided or mitigated by the awarded vendor. Identification of flight hazards is the sole responsibility of the awarded vendor, but the State of Nevada may provide sight specific knowledge to the vendor to assist in the identification of such hazards.

Base of Operation: The awarded vendors shall provide such operation facilities as may be required for competent performance of the contract. Use of any area as an operation area shall be arranged by and at the discretion and risk of the awarded vendor. The State of Nevada shall not be held responsible for any loss, mishap, or accident due to conditions of any operating facility used by the awarded vendors, and the awarded vendors will hold harmless the State of Nevada for any such instance. The awarded vendors shall provide appropriate warning signs for traffic if roads are used as operating sites and coordinate with the appropriate entity for such use and subsequent requirements. Project locations are often in remote areas with dirt landing strips away from airports, municipalities, and other services. The use of remote dirt roadways, dirt landing strips, and gravel pits often provide the most cost-effective opportunity for site-specific needs. As such, awarded vendors must be capable of landing and operating in variable terrain and substrate to efficiently conduct work under this RFQ. It will be the sole responsibility of the awarded vendors to determine a landing location for a site-specific project and determine if the landing area is suitable and at which operations can be performed safely.

Fuel: The awarded vendors shall ensure fuel availability in remote areas for aircraft and equipment. If fuel is not readily available from a commercial supplier, the awarded vendors shall be required to provide sufficient fuel for a minimum of 8-hrs of flight time by either using a fuel service provider or by hauling the fuel themselves.

Work Camp: Camping will be allowed during project implementation only at sites that have been approved in advance by the State of Nevada and applicable land manager (e.g., BLM, USFS). All fire regulations and permits shall be followed. All garbage and refuse shall be removed from the camp site by the awarded vendors within one (1) week of project completion. In the equipment maintenance area, special precautions shall be taken to contain spilled fuel, lubricants, and wash water. Final payment will be reserved subject to inspection of these sites by the State of Nevada and applicable land manager as appropriate and receive approval of site cleanup.

Project Completion:

The project will be considered completed and payment initiated when:

All products furnished by the awarded vendor to the State of Nevada have been applied to the standards specified in this RFQ.

When all areas designated under the contract have been completed to specifications, or, if performance under the contract is ordered to be terminated by the State of Nevada; and When the awarded vendor has furnished the State of Nevada with the Shapefiles, flight paths, requested information, etc.

For site specific projects, the State of Nevada will provide awarded vendors the appropriate shapefiles of work boundaries, flight paths, guzzler sites, etc. It is the awarded vendor’s responsibility to ensure they are operating within the work boundaries. Any deviation from the specifications and project layout boundaries provided by the State of Nevada to the awarded vendor will be the sole responsibility of the awarded vendor and will not be invoiceable to the State.

Awarded vendors are responsible for inspections, Quality Assurance, and Quality Control of their own equipment.

The awarded vendors will be required to remain in contact with the State of Nevada daily while performing work for site-specific projects. The State of Nevada, or its designated representative, may elect to have a Project Inspector (PI) on site during work performance of the awarded vendors. Additionally, inspections of work may be completed at any time, unannounced.

Accidents and Fuel Spills: The awarded vendors shall be responsible if accidents and fuel spills occur. The awarded vendors shall immediately report any spills and accidents to the State of Nevada Project Inspector, applicable land manager, [e.g., Bureau of Land Management (BLM), United States Forest Service (USFS)], and appropriate local authorities. The awarded vendors shall provide immediate treatment of contaminated or injured persons and seek professional medical attention when necessary. The awarded vendors shall control fuel spills quickly and shall secure additional help when the awarded vendors cannot effectively or safely handle the spill cleanup. The spills will be the responsibility of the awarded vendors and shall be cleaned to the satisfaction of the local authorities.

No hazardous materials shall be stored or disposed of on-site. Fuel, oil, and grease needed for equipment maintenance during the working period may be stored on site where no leakage or spillage will contaminate the ground, preferably in spill containment barriers. No equipment maintenance will be performed within, or near, any stream channel or waters where petroleum products or other pollutants from equipment may enter these waters.

All vehicles and equipment used for implementation of the project shall be washed offsite prior to accessing the project area to remove any vegetation and potential noxious weed and invasive species parts prior to beginning the work as well as following completion of the work.

Staging/Storage area for equipment and materials should be located outside/away from streams or any wetland/riparian habitat areas. Any equipment or vehicles driven and/or operated within, or adjacent to streams or other water should be checked and maintained daily to prevent leaks.

No overland travel in any Wilderness or Wilderness Study Areas is allowed.

Payment

Measurement for payment for aerial transport and capture of wildlife will be on a per animal basis, or on an hourly basis if animal densities are low. The measurement of payment for remaining SOW shall be on an hourly basis as specified in the Bid Schedule and shall include the cost of all work described in the paragraph and the Detailed Specifications.

INVERSE PREFERENCE

The State applies an inverse preference to vendors that have a principal place of business in a state other than Nevada and that state applies an in-state preference not afforded to Nevada based vendors, pursuant to AB28 passed in the 81st session of the Nevada Legislature.

The amount of the inverse preference is correlated to the amount of preference applied in the other state.

Vendors who meet this criterion must indicate it on their submitted Quote in NevadaEPro.

This preference cannot be combined with any other preference, granted for the award of a contract using federal funds, or granted for the award of a contract procured on a multi-state basis.

MANDATORY MINIMUM REQUIREMENTS

Pursuant to NRS 333.311 a contract cannot be awarded to a proposal that does not comply with the requirements listed in this section. The proposal shall include confirmation of compliance with all mandatory minimum requirements.

NEVADA LAW AND STATE INDEMNITY. Pursuant to NRS 333.339, any contract that is entered into may not: (1) Require the filing of any action or the arbitration of any dispute that arises from the contract to be instituted or heard in another state or nation; or (2) Require the State to indemnify another party against liability for damages.

NO BOYCOTT OF ISRAEL. Pursuant to NRS 333.338, the State of Nevada cannot enter a contract with a company unless that company agrees for the duration of the contract not to engage in a boycott of Israel. By submitting a proposal or bid, vendor agrees that if it is awarded a contract, it will not engage in a boycott of Israel as defined in NRS 333.338(3)(a).

INDEMNIFICATION. Required contract terms on Indemnification: "To the fullest extent permitted by law, Contractor shall indemnify, hold harmless and defend, not excluding the State’s right to participate, the State from and against all liability, claims, actions, damages, losses, and expenses, including, without limitation, reasonable attorneys’ fees and costs, arising out of any breach of the obligations of Contractor under this contract, or any alleged negligent or willful acts or omissions of Contractor, its officers, employees and agents. Contractor’s obligation to indemnify the State shall apply in all cases except for claims arising solely from the State’s own negligence or willful misconduct. Contractor waives any rights of subrogation against the State. Contractor’s duty to defend begins when the State requests defense of any claim arising from this Contract."

LIMITED LIABILITY. Required contract terms on Limited Liability: "The State will not waive and intends to assert available NRS Chapter 41 liability limitations in all cases. The contract liability of both parties shall not be subject to punitive damages. Damages for any State breach shall never exceed the amount of funds appropriated for payment under this Contract, but not yet paid to Contractor, for the Fiscal Year budget in existence at the time of the breach. Contractor’s tort liability shall not be limited."
