Terms and Conditions

THE ROLE OF GOVERNMENT PERSONNEL AND RESPONSIBILITY FOR

CONTRACT ADMINISTRATION

A. Contracting Officer (CO)

1. The CO for this award is: Marcus Mason; marcus.l.mason@fps.dhs.gov; (972) 868-7718

2. The CO has the overall responsibility for the administration of the contract. The CO alone is authorized to take action on behalf of the Government to amend, modify or deviate from the contract’s terms and conditions; make final decisions on unsatisfactory performance; terminate the contract or task order for convenience or cause; and issue final decisions regarding questions or matters under dispute. The CO may delegate certain other responsibilities to an authorized representative.

B. Contracting Officer’s Representative

1. The COR for the order is: Leigh Hackney; leigh.hackney@fps.dhs.gov.

Task order and agency specific provisions and clauses. In addition to the Statement of Work, the following Federal Acquisition Regulation (FAR) and Homeland Security Acquisition Regulation (HSAR) provisions and clauses are incorporated into the purchase order. FAR Part 12 Commercial provisions/clauses apply to this purchase order.

DESCRIPTION OF SERVICES

The Department of Homeland Security (DHS), Management Directorate, Federal Protective Service (FPS), Training and Professional Division, Specialized and Advanced Training Division (Bren Mar) has identified a need for continued weekly firing range maintenance services at the Federal Protective Service (FPS), Consolidated Training Facility, 6315 Bren Mar Drive, Suite 100, Alexandria, VA.

The Contractor shall perform preventive and corrective maintenance services for two (2) indoor FPS Firing Ranges. These maintenance services will be used to test, inspect, repair, and perform preventative maintenance on the installed range target equipment, to restore equipment to fully operational condition to replace or repair parts of equipment subject to normal wear and tear and to provide bullet trap maintenance at the FPS Firing Ranges.

ADDENDUM TO FAR 52.212-4 CONTRACT TERMS AND CONDITIONS —

COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

FAR 52.212-4, Paragraph (d) Disputes: Notwithstanding the claim period stated in FAR 52.233-1, Disputes, and pursuant to FAR 33.206, Initiation of a Claim, the Contractor agrees to submit any claim related to this contract [or “order”] within 12 months after accrual of the claim.

SUBMISSION OF INVOICES:

A. Invoicing.

Invoices shall be submitted for payment within 30 days after the Government’s receipt of delivery. Invoices shall not contain any Personally Identifiable information (PII). Invoices shall be submitted via one of the two (2) following methods:

The subject invoice number shall be annotated in the subject line of the e-mail. Only one (1) invoice shall be submitted per e-mail message. The invoice attached to the e-mail shall be in the Portable Document Format (PDF).

Invoices submitted by other than these two (2) methods will not be processed and will be returned.

The Contractor shall provide an informational copy of each invoice to the Contracting Officer, Marcus.L.Mason@fps.dhs.gov, and the COR, Leigh.Hackney@fps.dhs.gov concurrent with submission to the designated billing office referenced above. 52.202-1

In addition to the information required for a proper invoice as identified in FAR 52.212- 4(g)(1), Contract Terms and Conditions – Commercial Products and Commercial Services, the Contractor shall include the following information:

1. Annotate “FPS-HQ” on the face of each invoice.

2. Clearly identify the date the services were delivered to the Government.

3. Cite the identical CLIN number and description on the invoice as what is cited within the CLIN description listed in the purchase order.

Contractor shall submit only one invoice per CLIN. Failure to comply with these submission requirements will result in rejection of the invoice.

Final invoices shall be marked “FINAL” and be accompanied by an executed “Contractor’s Release” (DHS Form 700-3 (12/07)) available at http://dhsconnect.dhs.gov/org/comp/mgmt/ocio/forms/Forms/DHS%20Form%20700-3.pdf or by request to the Contracting Officer.

52.217-8 Option to Extend Services (Nov 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. STATEMENT OF WORK (SOW)

BREN MAR RANGE MAINTENANCE

1.0 GENERAL

1.1 BACKGROUND

The Federal Protective Service (FPS) was established in 1971 as the uniformed force of the General Services Administration (GSA). The Homeland Security Act of 2002 moved FPS to the Department of Homeland Security (DHS). FPS transferred to the Management Directorate with the mission of performing primary mission essential functions in support of the Federal Executive Branch.

1.2 SCOPE

The Department of Homeland Security (DHS), Management Directorate, Federal Protective Service (FPS), Training and Professional Division, Specialized and Advanced Training Division (Bren Mar) has identified a need for continued weekly firing range maintenance services at the Federal Protective Service (FPS), Consolidated Training Facility, 6315 Bren Mar Drive, Suite 100, Alexandria, VA.

2.0 SPECIFIC REQUIREMENTS/TASKS

The Contractor shall perform preventive and corrective maintenance services for two (2) indoor FPS Firing Ranges. These maintenance services will be used to test, inspect, repair, and perform preventative maintenance on the installed range target equipment, to restore equipment to fully operational condition to replace or repair parts of equipment subject to normal wear and tear and to provide bullet trap maintenance at the FPS Firing Ranges.

The Contractor shall provide all labor, services, any parts necessary for replacement (such as but not limited to wheels, hardware, or pulleys), supplies and shipment of items necessary to check the overall functional operation of the Firing Ranges and to accomplish the scheduled maintenance tasks required.

The Contractor shall provide any maintenance or replacement parts on hand as part of the scheduled maintenance associated with these ranges. When replacement parts are deemed necessary; like units, assemblies, and subassemblies shall be physically and functionally interchangeable as complete items, without modification.

The Contractor shall provide qualified and certified technicians on the firing range system.

“Caswell “certified technicians are not required.

During work, the Contractor shall provide the customer with basic instruction of maintenance and operation procedures.

2.1 TASK 1. WEEKLY TARGET RANGE PREVENTATIVE MAINTENCE AND

RANGE CLEANING

The Contractor shall provide weekly maintenance services that will be used to test, inspect, repair, and perform preventive maintenance on the Caswell range target equipment, to restore equipment to fully operational condition to replace or repair parts of equipment subject to normal wear and tear and to provide bullet trap maintenance at the FPS Firing Ranges. The weekly range cleaning services will be used to reduce, to the greatest extent possible, the lead contaminates from surfaces within the ranges, the weapons cleaning rooms, and the control room/booth. The contractor shall design a checklist of the work to be performed and the contractors’ employees shall complete the checklist of the work completed and provide the checklist to an FPS representative on a weekly basis.

The Contractor shall perform weekly preventative maintenance and range cleaning sessions for two (2) twelve-point indoor ranges with installed target range equipment, to include the following tasks:

• Test for proper operation of all components of the target conveying systems.

• Check and adjust drive belts, cables, electrical connections, target stops, and carriers.

• Repair any non-functioning target lane or component thereof, including electronic assemblies and the master control console, as necessary.

• HEPA Vacuum the floors of both interior ranges to pick up dust, particles, and particulate left on the ranges after weapons firings to remove lead contaminated waste.

o Dry method of cleaning may be used 3 of the 4 weekly range cleanings per month.

o Wet method of cleaning shall be used for at least one of the weekly cleanings per month.

• Wet wipe shooter’s booths, and all horizontal and vertical surfaces on the firing line, all materials used to clean lead contaminated areas are required to be discarded in the designated hazardous materials waste barrel.

• Clean and wet wipe materials used on the tables, walls, and floors within both weapons cleaning rooms and the control room/booth to remove lead contaminated oils, particles and particulate left behind after cleaning of firearms are to be discarded in the designated hazardous materials waste barrel.

• Provide the FPS COR or his/her designated technical representative a weekly written checklist of the items that were repaired, replaced and any other tasks performed during the weekly cleaning sessions.

When issues, problems or repairs are identified during the weekly preventative maintenance and range cleaning sessions, the Contractor shall provide FPS with written notice of the actions being taken and will provide FPS with a projected timeline for the repair(s) and/or resolution.

The Government will give the Contractor no more than five (5) consecutive days unescorted access to the firing range facilities for maintenance/repair/cleaning. Mondays are the preferred day of service as they are the days the ranges are least used. If Monday is a federal holiday, Tuesday will be acceptable to the government. The quarterly maintenance is done over multiple days spanning a 2-week period. A more in-depth maintenance is required for range 1 and range

2. The contractor shall notify the COR/TPOC of the alternate day/date of the service.

2.2 TASK 2. WASTE CHARACTERIZATION FOR NON-HAZARDOUS MATERIAL

(BRASS) AND HAZARDOUS MATERIAL (LEAD)

The Contractor must characterize each waste stream to determine if in fact the generated waste is hazardous. The initial characterization shall be determined by proper methodology (EPA approved test [i.e., TCLP]), not user knowledge. Each waste stream shall be re-characterized at least at least every three years and/or whenever requested by the COR.

The Contractor shall collect and recycle lead from the abatement and bullet traps in accordance with applicable local, state, and federal rules, regulations, and laws. When the lead is recycled, the procedures and processes for brass recycling shall be followed for lead. If no lead recycling options are available, the contractor shall provide documentation quarterly of efforts to locate a lead recycler (i.e.: memos, web searches, etc.).

If disposal of lead is the only option, the Contractor shall provide the CO and COR with the appropriate manifests and reports associated with lead disposal, including appropriately permitted and authorized transportation of lead waste. FPS estimates it generates about 300 pounds of lead annually.

2.3 TASK 3. QUARTERLY RECYCLE AND DISPOSAL REQUIREMENT FOR NON –

HAZARDOUS MATERIAL (BRASS SHELL CASINGS) AND HAZARDOUS MATERIAL

(LEAD)

After characterization of waste, any waste that has been characterized as recyclable by the Contractor shall be recycled at a proper recycling facility in the local area. After recycling, the Contractor shall provide a copy of the receipt from the recycling facility to the government that shows the weight recycled and the amount that the Contractor received for the government recyclables.

Contractor shall provide documentation from the previous quarter no later than the 15th day of the new quarter.

BRASS SHELL CASINGS

The Contractor shall remove and recycle brass shell casings accumulated and being stored in 55-gallon drums or barrels on the premises on a quarterly basis or more frequently if needed. The Contractor shall provide all supplies, equipment and materials required to remove and recycle brass casing services described herein.

At a minimum of once per quarter (or more frequently as the need arises or as requested by the government’s COR/TPOC), the Contractor shall transport, via an authorized conveyance to carry the brass materials, the barrels or drums to an authorized recycling center and shall replace the full barrels or drums with empty ones.

The price for transportation of the recyclables less any recoveries for recycling the brass castings shall be included in the price of CLINX001, Quarterly Recycle and Disposal for Non-Hazardous Material (Brass Shell Casings) and Hazardous Material (Lead).

Pricing for this CLIN shall consider the costs of transporting the recycling less any monetary recoveries for recycling the brass casings. Historically 1,500 lbs. of brass casings are recycled a quarter. This historical data is provided to assist in pricing; however, the Government does not guarantee that this level of recycled brass casings and market prices will continue into the future.

The Contractor shall provide the COR with a copy of the recycling report as an attachment to the credited invoice. FPS estimates it will generate approximately 500 pounds of recycling brass per month.

3.0 TASK 4. QUARTERLY TARGET RANGE PREVENTATIVE MAINTENANCE

The Contractor shall perform quarterly preventative maintenance sessions for two (2) twelve-point indoor ranges with Caswell target range equipment, to include the following tasks:

• Test for proper operation of all components of the target conveying systems.

• Check and adjust drive belts, cables, electrical connections, target stops, and carriers.

• Remove assemblies and all other components of the conveying system not mentioned herein.

• Lubricate all components requiring lubrication, as necessary.

• Clean the overhead track system to remove debris as necessary.

• Repair any non-functioning target lane or component thereof, including electronic assemblies and the master control console, as necessary.

• Inspect all ballistic protection equipment including the bullet trap for improper wear and tear from the accumulation of lead and/or other debris.

• Inspect and change ventilation filters as necessary.

• Inspect rubber blocks located in front of the running man on each range for wear and tear; replace as necessary.

• Remove and dispose of worn rubber blocks, as necessary or as requested by FPS personnel, which are to be discarded in the designated hazardous materials waste barrel. The cost for the removal and disposal shall be included under CLIN X001 – Quarterly Recycle and Disposal for Non-Hazard Material (Brass Shell Casings) and Hazardous Material (Lead, since these materials are contaminated with lead.

• The Government will give the Contractor no more than five (5) consecutive days to access the firing range facilities for maintenance/repair.

4.0 TASK 4. QUARTERLY AIR FILTER REPLACEMENT

Filters shall be replaced quarterly in accordance with 2.5 Task Quarterly Air Filter Replacement.

The range is in use all year around. Replace the bullet information to include the following sizes and quantities of filters.

The Contractor shall replace the air filter at both ranges quarterly in accordance with Code of Federal Regulations (29 CFR 50.12). The contractor shall notify the COR/TPOC when this service has been completed.

5.0 TASK 5. QUARTERLY BULLET TRAP PREVENTATIVE MAINTENANCE

The Contractor shall perform quarterly preventative bullet trap maintenance sessions, to include the following tasks:

• Recycle 5 cubic yards (135 cubic feet) of granulated rubber per lane.

• Containerize spent projectiles and deliver to a metal recycler.

• Patch gum rubber as needed.

• HEPA vacuum range and bullet trap floors and walls

• Wet wipe shooter’s booths, and all horizontal and vertical surfaces from the firing line to the back wall and from the bottom of the safety ceiling to the floor

• HEPA vacuum the floor outside the entrance to the range.

• Replace and/or tighten any loose or missing nuts and bolts on the bullet trap.

• Add granular rubber to the bullet trap annually or as requested by FPS personnel.

• Wet wipe ceiling baffles when recycling the 5 cubic yards of granulated rubber.

• Wet wipe target tracks and cross-braces.

• Package decontamination supplies and personal protective gear as lead contaminated hazardous waste for disposal in the designated hazardous materials waste barrel.

6.0 TASK 6. SEMI- ANNUAL GUM RUBBER CURTAIN REPLACEMENT

The Contractor shall replace all Gum Rubber Curtain on both ranges semi-annually and/or as needed.

• Replace gum rubber curtains during preventative maintenance sessions. Replaced gum rubber curtains are to be discarded in the designated hazardous materials waste barrel.

• If they are not replaced, these rubber curtains need to be swapped out to other lanes where less shooting is being done. (Example moving lanes 4-8 in the middle out to lanes 1-3, 10-12 if necessary or requested by the government.)

7.0 OTHER DIRECT COST (ODC) FOR CORRECTIVE MAINTENANCE AND

MATERALS NEEDED

The Contractor shall be available to respond and repair any range deficiencies that affect mission requirements within (24) hours upon notification by the government to include the following tasks:

• Test for proper operation of all components of the target conveying systems.

• Check and adjust drive belts, cables, electrical connections, target stops, and carriers.

• Repair any non-functioning target lane or component thereof, including electronic assemblies and the master control console, as necessary.

Material costs used for corrective maintenance repair and replacement needs less than $500 do not require COR or CO approval prior to purchase, however monthly itemized purchase lists and invoices are required for submittal to the COR and CO.

In the event purchases must be made immediately, within one (1) hour to ensure that security is not compromised, the Contractor may purchase material without COR and CO approval. In this instance, the Contractor shall provide a written justification for purchase and receipt to the COR and CO within 24 hours from the purchase.

The Contractor shall submit an excel spreadsheet no later than the 15th of each month to the COR and CO detailing all monthly and cumulative material cost expenditures and balance remaining for materials purchased and invoiced for repair and replacement under Other Direct Cost.

8.0 HAZARDOUS MATERIAL CONTROL MANAGEMENT (HMCM) PROGRAM

All surfaces and equipment located inside the firing ranges are considered contaminated by lead;

therefore, work shall be performed in compliance with the applicable Occupational Safety and Health Administration (OSHA) Standards pertaining to Occupational Lead Exposure and Controls. The Contractor shall establish and maintain a HMCM Program for total life cycle control of all hazardous material and hazardous wastes located at the facility and shall provide an employee experienced in the management of lead projects.

The Contractor shall remove all hazardous/nonhazardous materials and waste from the job site at the end of each maintenance session. The Contractor shall ensure that the maintenance activities are scheduled so that the waste generation does not make the facility a RCRA “Large Quantity Generator.” The Contractor shall submit documentation to the COR that the hazardous waste was transported, recycled, and disposed of in accordance with all applicable federal OSHA, DOT, and EPA and state hazardous material and waste regulations, upon request. The Contractor shall provide the COR, PM and facility manager accurate totals of the type and weight of waste removed from the facility each day. Recycled or waste weights shall not include the container and shall not be unsubstantiated estimates.

Contractor shall conduct Toxicity Characteristic Leaching Procedure (TCLP) testing when new materials are used (i.e.: PPE, the wipes, and the mop heads) or manufacturer changes material composition or at least once every three years.

Contractor shall test the heating, ventilation, and air conditioning (HVAC) related waste whenever it is generated. Contractor shall coordinate with the company responsible for the filtration system to re-set filter parameters for continuous monitoring system functionality.

All repair work shall be carefully planned to prevent unnecessary damage to the facility. After work completion, the Contractor shall return the facility to its condition prior to removing, recycling, and disposing of all resultant unused material, dirt, and debris, leaving the premises in a clean and safe condition satisfactory to FPS.

9.0 HAZARDOUS WASTE DISPOSAL DOCUMENTATION

The Contractor shall store and label all wastes, hazardous and non-hazardous, in accordance with all applicable state, federal, and local regulations.

The Contractor shall submit documentation that all hazardous waste was recycled or disposed of according to all applicable local, state, and federal laws within 30 days of each maintenance session. This documentation shall be submitted to the designated COR, with a copy to the Contract Specialist. All written reports shall be in electronic format with read/write capability using applications that are compatible with (Windows XP and Microsoft Office Applications).

Contractor shall keep all records for a minimum of three years and have readily available, upon request.

10.0 PERIOD OF PERFORMANCE

The period of performance for the planned Purchase Order includes a base period of twelve (12) months with four (4) one-year option periods and a six (6) month option to extend services, if exercised by the Government.

11.0 PLACE OF PERFORMANCE

All cleaning and maintenance services shall be performed at the weapons firing ranges at the following location:

12.0 HOURS OF OPERATION

The weekly cleaning sessions may begin at 6:00 am on Mondays so that most of the work will be completed prior to the beginning of training sessions. The contractor may begin earlier with prior coordination with the COR/OPOC. The majority of remaining maintenance work shall take place during normal business hours, 6:00 am – 3:00 pm Monday through Friday, EST (Eastern Standard Time).
