2. PROJECT DESCRIPTION

2.1 Background Information

Ecology is removing two dilapidated bridges, herein referred to as the “Twin Bridges” on the South Fork Sauk River in Snohomish County. The Twin Bridges were originally constructed as part of the Everett and Monte Cristo Railway used to transport mine concentrates from the Monte Cristo Mining Area (MCMA) to the smelter in Everett, Washington via railcar. From about the 1930’s until 1980, the Twin Bridges carried vehicular traffic into Monte Cristo. The access route is a county right-of-way within the

RFQ 2504 TCP PAGE 4 OF 20

Mt. Baker-Snoqualmie National Forest; however, it no longer provides vehicular access to the project area.

In 2016, the United States Department of Agriculture, Forest Service (Forest Service) completed a non-time-critical Removal Action (RA) for the MCMA. Cleanup included excavating and consolidating metals contaminated mine waste and soils into an onsite repository. The RA was performed for the Forest Service under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) cleanup authority.

Work conducted on private inholdings was completed under the Model Toxics Control Act (MTCA). Cleanup activities were not conducted at the Twin Bridges; however, the Twin Bridges include creosote treated lumber that is potentially contaminating surface water in the South Fork Sauk River.

Funding for previous and future cleanup work in the MCMA, including removing the Twin Bridges, is provided by the American Smelting and Refining Company (Asarco) 2009 bankruptcy settlement account.

3.4 Selection Process and Criteria

An A/E firm will be selected using a two-phase qualifications based selection scoring and ranking process, consisting of a Statement of Qualifications Phase followed by the Interview Phase. The two phases are further described as follows:

3.4.1 Statement of Qualifications (SOQ) Phase. During this phase, submitted information will be scored and ranked based upon the following criteria, as indicated, for 100 possible points. Based on SOQ scoring and ranking process the evaluators will recommend firms that appear qualified to perform the work. The goal of the SOQ Phase, is to identify a Short-List of the top three (3) to five (5) ranked firms, who will advance to the Interview Phase. If the goal of three Short-Listed firms is not met, the TCP Contracts Officer may re-evaluate the solicitation and response prior to finalizing the Short-List. Based on the assessment, Ecology may cancel the solicitation and re-post the solicitation or Ecology may proceed to the Interview Phase with a Short-List of less than three (3) qualified firms. All firms submitting a SOQ will be notified of the Short-List results.

3.4.2 Interview Phase. Following the Statement of Qualifications Phase, the selection panel will interview the firms from the Short-List. There will be no presentations necessary for this solicitation. The interview will be a question and answer format. Interviews will be held virtually, with a web link provided by Ecology in the invitation to interview.

The Interview Phase criteria and instructions will be provided with invitation letters to the Short-Listed firms. The invitation instructions may contain requirements related to the size and makeup of the interview team. Reference checks will be conducted as part of the Interview Phase and will factor into the scoring as described in more detail below. The top ranked firm following the Interview Phase will be selected as the apparent most qualified firm.

The evaluation criteria in the Interview Phase will include evaluation of the firm’s management plan. As part of the management plan evaluation, firms will discuss their policies and procedures for managing current and potential conflicts of interest, and maintaining confidentiality of information. The firm’s policies and procedures must be detailed and robust, including, but not limited to:

A process for identifying conflicts of interest.

A management plan for avoiding or neutralizing a conflict.

A process for maintaining confidentiality of information.

A program of staff training on conflicts of interest and confidentiality issues.

To assist Ecology in evaluating the firm’s processes and plans for addressing conflicts of interest, Short-Listed firms are required to provide Ecology a list of conflicts of interest and potential conflicts of interest in advance of the interviews.

Short-Listed A/E firms must provide a certified list of all entities with which it has relationships that create, or appear to create, a conflict of interest with the work that is contemplated in this RFQ. This list should indicate the name of the entity, the relationship, and a discussion of the conflict.

Even firms with no conflicts of interest are required to submit a certified statement indicating they have no conflicts at this time. If a firm cannot divulge the name of an entity(ies) due to current confidentiality agreements, a firm must state this in their certified statement.

The firm’s evaluation of a conflict of interest should consider the following questions to aid in their evaluation and preparation of their list:

Is the firm currently managing neighboring sites or working for other potentially liable parties involved with this project that would pose a conflict with the services for Ecology at the Monte Cristo Mining Area Site?

Is there any project employee of the firm who has a (family/financial/former Ecology employee) relationship with Ecology’s project team or the project?

RFQ 2504 TCP PAGE 12 OF 20

Ecology considers conflicts of interest critical to evaluating the management plan criteria during the interview phase.

3.4.3 References for Short-Listed firms. Each firm on the Short-List will be required to submit at least three project owner references for work completed by your firm. References should be selected from projects prominent in your Statement of Qualifications (SOQ) and should NOT be Ecology employees. Cited references should include project name, reference name and title, project role, current contact telephone number, and email.

Ecology will check references on a Pass/Fail basis. In the event that information obtained from reference checks reveals concerns about the firm’s past performance or their ability to successfully perform the contract to be executed based on this RFQ, Ecology may, at its sole discretion, determine that the firm is not the most qualified firm and may select the next highest-ranked firm whose reference checks validate the ability of the firm to successfully perform the contract to be executed based on this RFQ. In conducting references checks, Ecology may include itself as a reference check if the firm has performed work for Ecology, even if the firm did not identify Ecology as a reference. Likewise, Ecology reserves the right to check references for the firm from other owners and designers even if they were not identified by the firm as references in the SOQ submitted.

3.4.4 Negotiation of Contract. After the notification of the apparent most qualified A/E firm, ECOLOGY may enter into contract negotiations with the A/E firm, which may include discussion regarding the terms of the Contract.

Should contract negotiations fail to be completed within one (1) month after initiation, ECOLOGY may immediately cease contract negotiations and declare the firm with the next highest score as the new apparent most qualified firm and enter into contract negotiations with that firm.

The apparent most qualified firm will be expected to execute the Contract within ten

(10) Business Days of its receipt of the final Contract. If the selected A/E firm fails to sign the Contract within the allotted ten (10) days timeframe, ECOLOGY may elect to cancel the award, and award the Contract to the next ranked A/E firm, or cancel or reissue this RFQ.

3.5 Other Information

Future Services: Ecology reserves the right to continue with the A/E firm selected for this project or may conduct a new A/E firm selection process, for future services beyond those services advertised herein for this project.
