0001 Custom-designed and fabricated stainless-steel swine penning with Tenderfoot or similar decking/flooring, this penning will be a modular design with each module being approximately 22.8 square feet (approximately 5.01 ft X 5.83 ft).
Initial design documents for review then one initial module for mockup and review with 39 additional modules following acceptance of the design. Please see attached specifications.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. INSTRUCTIONS FOR THE PREPARATION OF OFFERS (FAR 52.212-1)

Offerors shall provide all requested information referenced in this section. Failure to provide all requested information may result in the offer not being considered for further evaluation.

OFFER SUBMISSION DOCUMENTS
1. One (1) original fully completed and signed SF 1449 Offer page (complete block 30), acknowledgment of all amendments by completing blocks 15a, b, and c of the Amendment SF30
2. Quote pricing document. Document shall provide detailed pricing breakout in accordance with the CLIN structure and items requested. Please include Attachment 2 Schedule of Items with quote pricing.
3. Technical Proposal. Contractor must submit initial design documents for review then one initial module for mockup and review with 39 additional modules following acceptance of the design. Please see attached specifications. The technical proposal shall describe the approach through the use of narrative, in sufficient detail for the Government to understand and evaluate the nature of the approach regarding the contractor’s capability to manufacture the swine pens, as required by the specifications. All modules must be delivered by September 30, 2021. Offerors with a more comprehensive Technical Proposal will be evaluated higher, IAW with the evaluation terms.
4. Documentation that offeror understands that first item produced required for final acceptance testing before full-rate production initiation.
5. Proposed production schedule to ensure timely delivery to Manhattan, KS for all swine pen modules.
6. Past performance information projects for fabricated swine pens of similar size and scope, or of similar pens. Include dollar value, POCs, contract numbers, etc.
FAR 52.212-2 -- Evaluation -- Commercial Items (Addendum).
Evaluation -- Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical Capability, Delivery, Past Performance, and Price.
Technical Capability, Delivery, and past performance, when combined, are more important than price.
As stated in FAR 13.106-2, “If using price and other factors, ensure that quotations or offers can be evaluated in an efficient and minimally burdensome fashion. Formal evaluation plans and establishing a competitive range, conducting discussions, and scoring quotations or offers are not required. Contracting offices may conduct comparative evaluations of offers.”
The In accordance with FAR Part 13 the Government will award a firm fixed price contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1) Meeting all requirements as defined in the solicitation, to include Quote submission documents referenced in 52.212-1. Failure to submit ANY of the required document listed in “Offer Submission Documents (52.212-1) will render your quote non-responsive and thus not eligible for award. Failure to acknowledge any and all amendments will render your quote non-responsive and thus not eligible for award.
2) Offers that fail to provide a realistic pricing approach for Submission Document #2 for this effort will be found not acceptable. The Contractor must demonstrate the price proposed will not lead to inferior product or materials, and delivery lead times. Offerors that do not provide a pricing approach that is realistic will be rated lower.
3) Technical Proposal Evaluation. The Contractor shall provide a plan that address all the aspects identified in Submission Document #1. Offerors that fail to address any aspects or the proposed solution is not compatible with the specifications will be found unacceptable. Offerors that provide a more robust Initial Design drawing document that does not simply restate the Government specifications, but incorporates the specifications and demonstrates understanding of the requirements and provides construction methods, materials utilized, dimensions, and any other pertinent information required will be evaluated higher. Offerors that do not provide an initial design drawing with specifications will be found “Unacceptable”. Offers must incorporate a proposed schedule that meets the delivery date of September 30, 2021 for all modules. Offerors with a more comprehensive technical proposal will be evaluated higher, compared to technical proposal that do not provide details of the swine pen production and fabrication.
4) Offerors that cannot meet the timeline for delivery of all 40 modules will be found “Unacceptable”.
5) Past performance will be evaluated in accordance with FAR 13.106-2. Offerors with highly rated past performance in similar scope will be evaluated higher, than offers will minimal or no past performance. The apparent successful, prospective contractor must have acceptable past performance. System for Award Management (SAM.gov) exclusions list, Federal Awardee Performance and Integrity Information System, and Contractor Performance Assessment Reporting System (CPARS) shall be considered as part of the past performance evaluation process. Any past performance that is found to be “negative”, shall result in the entire Past Performance rating as “Unacceptable”. “Negative” is defined as any CPARS past performance evaluation rated less than “Satisfactory”, any Terminations for Default/Cause, or any negative performance references will be rated as ‘Unacceptable’. Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance.
Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
FAR 52.212-3 (Jan 2021) Reps and Certs Details The offeror shall ensure that their business has completed their online Representations and Certifications at the System and Awards Management (SAM) website which may be found at https://www.sam.gov/portal/public/SAM/. It is the Offeror’s responsibility to ensure that the information provided in each certification/representation is completed truthfully and completely. Failure of an Offeror to complete their online certification/representations prior to the close of the Solicitation (to include listing of the applicable NAICS code, “active status”, or applicable size standards) will result in their offer being deemed non-responsive and eliminated from consideration of the award.

Forced or indentured child labor means all work or service—

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Reasonable inquiry has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

Service-disabled veteran-owned small business concern—

Small business concern—
